BINDING BIDS
By registering or placing a bid, each bidder acknowledges that a bid is a legally binding offer to purchase the lot. The successful bidder is obligated to complete the purchase and pay all applicable charges.

BUYER’S PREMIUM AND TAXES
The buyer’s premium displayed for the auction on LiveAuctioneers will be added to the hammer price. Applicable Arizona and local transaction privilege or sales taxes will also be charged unless a valid resale or tax-exemption certificate is provided and accepted before invoicing.

PAYMENT
Payment is due within forty-eight (48) hours after the auction closes. When LivePayments is enabled, the buyer’s payment method may be charged automatically in accordance with LiveAuctioneers’ payment terms. Accepted payment methods will be those shown on the LiveAuctioneers invoice. If a particular payment method or additional payment verification is required for a high-value or international purchase, that requirement will be stated on the invoice or communicated through LiveAuctioneers. No property will be released until payment has cleared in full.

QUESTIONS AND DUE DILIGENCE
Bidders are responsible for completing their due diligence before bidding. Questions and requests for additional information should be submitted to lisa@intouchestatesales.com at least forty-eight (48) hours before the auction closes. We will make reasonable efforts to respond promptly; however, questions received during the final twenty-four (24) hours may not be answered before bidding closes.

SHIPPING AND PICKUP
LiveShipping is the exclusive shipping service for this auction. Shipping quotes, charges, labels, tracking, insurance claims, refunds, and shipping-related support will be administered through LiveAuctioneers. Buyers should follow the shipping instructions provided on their LiveAuctioneers invoice and account.

Certain oversized furniture or other lots may be designated “Local Pickup Only". Pickup-only restrictions will be identified in the applicable lot description. Local pickup will take place by appointment in Mesa, Arizona. The exact address and pickup instructions will be provided to successful bidders after payment is received.

In Touch Estate Sales, LLC does not control LiveShipping quotes, carrier selection, shipping charges, delivery times, or insurance-claim determinations. Questions concerning LiveShipping charges, refunds, tracking, or delivery should be directed to LiveAuctioneers Support.

For any lot designated “Local Pickup Only", the buyer or the buyer’s authorized pickup representative is responsible for bringing the labor, tools, equipment, packing materials, and vehicle necessary to safely remove the property at the scheduled appointment. In Touch Estate Sales, LLC and property representatives are not obligated to lift, disassemble, pack, load, or transport pickup-only property. Unscheduled pickups are not guaranteed and may be required to reschedule.

UNPAID ACCOUNTS AND UNCOLLECTED PROPERTY
Accounts not paid in full within ten (10) calendar days may be deemed in default. Property not collected or shipped within the stated timeframe may be subject to reasonable storage charges, cancellation, resale, or other disposition following notice to the buyer and as permitted by applicable law.

AS IS; CONDITION; FINAL SALE
Auction property commonly comes from estates and should not be expected to be in perfect condition. All property is sold as is, where is, with no warranty regarding condition except as expressly stated in the catalog. All sales are final, subject to the Auction House’s warranty of clear title, its right to convey clear title, and the requirement that the property materially conforms to the catalog description.

In Touch Estate Sales, LLC acts as agent for the consignor and not as principal. Prospective buyers are responsible for evaluating the physical condition, suitability, and value of each lot before bidding by reviewing the photographs and catalog information and requesting any desired additional information.

In Touch Estate Sales, LLC strives to describe property accurately, completely, and without misleading omissions. Vintage and antique property commonly displays signs of age, use, and wear. The absence of a condition statement does not mean that an item is in perfect condition or free from defects.

Photographs form part of the catalog and condition information and should be reviewed carefully. Condition statements are provided as a courtesy and may not identify every instance of wear, repair, restoration, odor, fading, surface variation, loss, or other condition associated with age or use. Colors and appearance may vary because of lighting, photography, and screen settings. These condition qualifications do not limit the Auction House’s obligations concerning clear title, its right to convey clear title, or the property’s material conformity to the catalog description.

1. CONDUCT OF THE AUCTION
In Touch Estate Sales, LLC and the auctioneer may advance or reject bids; determine bidding increments; resolve bidding disputes; withdraw, combine, divide, reopen, or reoffer lots; correct clerical or catalog errors; and reschedule, pause, or continue the auction in the event of technical difficulties. The auctioneer’s decision regarding the conduct of the sale is final to the extent permitted by law and applicable LiveAuctioneers terms.

2. REGISTRATION AND BIDDER RESPONSIBILITY
Bidders must provide accurate registration and payment information and are responsible for activity conducted through their accounts. In Touch Estate Sales, LLC may decline or revoke bidding privileges, request identity or funds verification, impose bidding limits, or require a deposit when reasonably necessary to protect the auction, consignor, or other bidders and when permitted by applicable LiveAuctioneers terms.

3. PAYMENT DEFAULT
If a buyer does not pay when due, In Touch Estate Sales, LLC may, following any required notice and to the extent permitted by applicable law and LiveAuctioneers’ terms, cancel the sale, retain a deposit or partial payment, charge an authorized payment method, resell the property, reject the buyer’s future bids, recover reasonable collection, storage, and resale costs, and pursue other lawful remedies. A defaulting buyer may be responsible for any deficiency between the original purchase obligation and the net proceeds of resale.

4. LOT DESCRIPTIONS AND INSPECTION
Catalog descriptions, measurements, dates, materials, artist or maker identifications, provenance statements, condition observations, and estimates are prepared from the information reasonably available to In Touch Estate Sales, LLC. Measurements are approximate unless expressly stated otherwise. In Touch Estate Sales, LLC is responsible for providing catalog information that is accurate, complete, and not misleading and warrants that each lot will materially conform to its catalog description. Prospective buyers should examine all photographs and request additional information when needed before bidding.

5. AUTHENTICITY AND ATTRIBUTION
Statements regarding authenticity, authorship, attribution, period, culture, origin, provenance, and medium are based on the information reasonably available when the catalog is prepared. Qualifying terms such as “attributed to," “after," “style of," “manner of," or “inspired by" carry their customary auction meanings and do not constitute a full attribution to the named artist or maker. Nothing in this section limits the Auction House’s warranties of clear title, its right to convey clear title, or material conformity with the catalog description.

6. ESTIMATES AND RESERVES
Auction estimates are provided as guides only and do not predict or guarantee a selling price. Some lots may be offered subject to a confidential reserve. Where permitted, the auctioneer may open bidding below the reserve and may place bids on behalf of the consignor up to, but not exceeding, the reserve.

7. WITHDRAWAL OR CANCELLATION
In Touch Estate Sales, LLC may withdraw a lot before or during the auction. It may cancel a transaction after the auction when the property is unavailable, was materially miscataloged, was offered or sold in error, cannot be released lawfully, fails a pre-release quality-control review, or is subject to a competing ownership or title claim. When In Touch Estate Sales, LLC cancels a completed sale, the buyer will receive the remedy required by applicable law and governing LiveAuctioneers terms, which may include a refund of amounts paid for the affected lot.

8. TITLE AND RISK OF LOSS
In Touch Estate Sales, LLC warrants that clear title to each lot can be conveyed to the successful buyer. Title passes only after payment has cleared in full and any other applicable release requirements have been satisfied. Risk of loss transfers in accordance with the applicable LiveAuctioneers and LiveShipping terms or, for a lot designated “Local Pickup Only," when the lot is released to the buyer or the buyer’s authorized pickup representative. Before release, In Touch Estate Sales, LLC will exercise reasonable care of the property.

9. LIMITATION OF LIABILITY
To the fullest extent permitted by law and applicable LiveAuctioneers terms, liability of In Touch Estate Sales, LLC or the consignor relating to a lot will not exceed the purchase price paid for that lot, except where a different remedy is required by law or governing purchase-protection terms. Neither party will be liable for incidental, consequential, special, or indirect damages, including lost profits or loss of use. This limitation does not disclaim the Auction House’s warranties of clear title, its right to convey clear title, or material conformity with the catalog description, and does not limit LiveAuctioneers’ administration of LiveShipping claims or refunds.

10. GOVERNING LAW AND VENUE
These terms and each auction transaction will be governed by Arizona law, without regard to conflict-of-law rules. Unless applicable law or governing LiveAuctioneers terms require otherwise, any dispute arising from the auction or a purchase will be brought in a state or federal court of competent jurisdiction located in Maricopa County, Arizona.

11. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. These Conditions of Sale, the individual lot description, applicable LiveAuctioneers platform and LiveShipping terms, and the buyer’s invoice constitute the agreement governing the transaction. If provisions conflict, applicable law and mandatory LiveAuctioneers terms control, followed by the lot-specific written terms and invoice to the extent permitted.
