Please read through our auction terms and conditions as they apply to any auction activity you engage in with Nine Live Auction, LLC. By placing a bid, the bidder has READ ALL OF and AGREES TO these “Terms & Conditions” and agrees to pay the COST, ALL TAXES, and ALL FEES (if any) associated with the lot or item within the time period specified by Nine Lives Auction. The bidder accepts and assumes all risks and liabilities associated with bidding, picking up, and using lots or items from the auction. “Lot or item” and “Lots or items” refers to anything sold or used by Nine Lives Auction, and includes but is not limited to estate property, tools, firearms, vehicles, construction equipment. “The bidder”, “The winning bidder”, and “other parties” are considered interchangeable and includes, but is not limited to, customers, visitors, volunteers, outside businesses, and workers. Unless stated specifically in the lot or item description, Nine Lives Auction does not provide any shipping services. Terms and Conditions: The bidder agrees to provide accurate, current and the most up to date contact information to Nine Lives Auction, and accepts responsibility for any miscommunication, including receiving invoices. The bidder understands that all lots or items sold by Nine Lives Auction are considered to be “AS IS, WHERE IS” with NO GUARANTEES and NO WARRANTY. The bidder is responsible for determining how much they are willing to spend on any one lot or item. ALL SALES ARE FINAL. NO REFUNDS. NO EXCHANGES. The winning bidder agrees to pick up the lot or item(s) within the time period specified by Nine Lives Auction. The bidder agrees that failure to pick up the lot or item is considered forfeiture of ownership of the lot or item, NO REFUNDS will be given. Failure to pay for or pick up a lot or item will result in a permanent ban from future auctions. All bidders and other parties, such as but not limited to visitors and guests, agree not to hold Nine Lives Auction, its staff, the place of business, and/or property owner(s) responsible for ANY DAMAGE, HARM, LOSS, or INJURY resulting from being present on any property in use by Nine Lives Auction. All bidders and all other parties assume all liability when handling or picking up items. Bidders and individuals agree not to hold Nine Lives Auction, its staff, the place of business, and the owner(s) responsible for ANY DAMAGE, HARM, LOSS, or INJURY resulting from bidding on or using a lot or item. At their own discretion, Nine Lives Auction, retains the right to provide or refuse service to anyone at any time. ALL LOTS OR ITEMS SHOULD ASSUME TO HAVE A RESERVE. Pursuant to UCC § 2-328 and applicable state law, Nine Lives Auction may maintain reserves on lots or items by bidding on behalf of the seller or other vested party using one or multiple bidder numbers to place bids, until the lot or lots have reached a bid amount that is acceptable to the vested party. Nine Lives Auction, its sellers, and employees may have an interest in certain lots or items and retain the right to bid on those lots or items. Bidders and other parties agree that all legal disputes will be arbitrated on an individual basis in Phoenix, AZ using an accredited arbitration service to the fullest extent allowed by federal, state, and local laws. Bidders and other parties agree that the arbitrator cannot consolidate claims unless it is agreed upon by the claimant and Nine Lives Auction. Bidders and other parties agree the arbitration service will be selected at the sole discretion of Nine Lives Auction. Bidders and other parties agree to abide by the Rules of Arbitration, to the fullest extent allowed by federal, state, and local laws. Bidders and other parties agree to abide by any judgement, ruling, award, and/or agreement made during arbitration and accept it to be FINAL, non-appealable, and legally binding. Bidders and other parties agree that these “Terms & Conditions” is subject to change. Bidders and other parties agree that these “Terms & Conditions”, Nine Lives Auction’s website, and any information pertaining to specific lots or items cannot be used, shared, or stored without the express written permission of Nine Lives Auction.
