BIDDING
* Each buyer must register with LiveAuctioneers prior to bidding.
* The highest bidder on any lot shall be the buyer of the lot once the reserve or minimum price has been met.
* The purchase price shall be the sum of: the price at which the item is sold (hammer price) + the Buyer's Premium (30%) + the shipping and handling charges (billed on invoice) + applicable sales tax.
* Please see the SHIPPING section for applicable postage, material and handling charges.
* Santa Cruz Auction Company shall be the sole arbiter of any disputes. We reserve the right to withdraw property at any time before the sale and to reject a bid from any bidder.

PAYMENT
* Payment may be made by LivePayments (Live Auctioneers), Paypal, Credit Card, Wire Transfer, a Personal or Business Check.
* Invoices will be sent by e-mail within 24 hours of the end of the auction.
* The full amount of the invoice must be paid in full within seven days of the end of auction.

TAXES
* California sales tax of 9.0% will be applied if items are shipped to an address in California, unless the purchaser is exempt by law from such taxes (valid resale license must be submitted to us or be on file with Live Auctioneers.)

DOMESTIC & INTERNATIONAL SHIPPING
We make shipping your items to you as easy and inexpensive as possible.
* Most items are packed In-House so that we can personally execute careful, safe packing of your pieces.
* Shipping is by USPS Priority Mail or UPS Ground. All packages will be insured for the purchase amount.
*Shipping charges: Actual Postage + Cost of Packing Materials + Packing Fee.
* Packages are shipped as soon as possible, usually within 72 hours of payment being received (checks may take up to 7 days to clear).
*On average, a Bidder may expect to receive their items within 1-2 weeks following their payment. International shipments may take longer.
** In the event that an item is too large for our In-House Shipping services, that item will be identified in the auction description: "NO IN-HOUSE SHIPPING DUE TO SIZE". The buyer may have these items packed and shipped by one of our recommended shippers (see list below - you can contact them for a shipping quote). We will give the item to the shipper once they notify us that their separate invoice for shipping has been paid.

INTERNATIONAL SHIPPING
* International shipping is by USPS Priority International or USPS Global Express International. Please request shipping quote before bidding.
* Packages are declared at their actual value for customs purposes. All duties and customs import charges will be the responsibility of the buyer.
* Large items may not be able to be shipped internationally due to postal size limits.
* If the description contains: "INTERNATIONAL SHIPPING NOT OFFERED DUE TO SIZE" then we will not ship the item outside of the United States. However, if any bidder wants to make their own arrangements for shipping Internationally, the item will be available for pick-up from us once payment has been received and has cleared.

RISK OF LOSS
* In the event delivery cannot be made because of loss due to fire, theft, or any other reason, Santa Cruz Auction Company shall only be liable for the return of any payments made by the purchaser.

TERMS
* At Santa Cruz Auction Company we work hard to provide accurate descriptions of our lots, the items, their origins and their condition, however we do not assume any risk, liability, or responsibility as to authenticity, cultural origin, source or provenance, maker or artist attribution, date or period, purpose, or the exact measurements of any lot or item.
* The condition report does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Most items we offer are vintage or antique and will have expected wear. Please see the detailed photographs for condition and ask for more photographs if needed.
* Notwithstanding the preceding conditions, if within 21 days of the date of sale of any lot, the original purchaser gives notice in writing to us alleging that the identification of Authorship (as defined below) of such lot is not substantially correct based on a fair reading of the catalog, and with 10 days after such notice returns the lots to us in the same condition as at the time of sale, and establishes the allegation in the notice to our satisfaction, then the sale of such lot will be rescinded and the original purchase price refunded. Return shipping will be the buyer?s responsibility. Of course we want our clients to be happy with their purchases and will accept reasonable returns.
* Our best judgment is used in attributing paintings, drawings, sculpture and other items through the appropriate use of the glossary terms, and due care is taken to ensure the correctness of any supplemental material.
* If no provenance is stated, then we have no further information as to previous history. Many of our pieces come from estates and collections where the history is not available.

GLOSSARY TERMS

* by a certain artist - then we guarantee it is by that artist.

* attributed to a certain artist - we believe it is by that artist but don't guarantee the authorship.

* signed by a certain artist - we are not guaranteeing it is by that artist, although it bears his name.

* in the style of or in the manner of a certain artist - we do not believe it is by that artist (even if signed with that name) but is similar to the artists work.
