Estate Sales By Schmitz Auction Terms & Conditions

By registering for and participating in this auction, all bidders agree to the following Terms & Conditions:

1. All Sales Are Final
All property is sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied. All bids are final and binding. No returns, refunds, exchanges, or cancellations will be accepted. Buyers are encouraged to carefully review all photographs, descriptions, dimensions, and condition information before bidding.

2. Item Descriptions & Condition
Estate Sales By Schmitz makes reasonable efforts to accurately describe each lot. However, descriptions, dates, makers, materials, measurements, provenance, attribution, and condition statements are provided as opinions and are not guarantees. Photographs are considered part of the lot description. Bidders are responsible for conducting their own research and determining condition, authenticity, age, and value before bidding.

3. Buyer's Premium & Sales Tax
A buyer's premium will be added to the hammer price of each winning lot at the rate disclosed for the auction. Applicable sales tax will also be collected unless the buyer provides valid documentation establishing an exemption.

4. Payment
Payment is due promptly following the conclusion of the auction. Buyers are responsible for the hammer price, buyer's premium, applicable taxes, shipping, handling, and any other disclosed charges. Items will not be released or shipped until payment has been received and cleared.

5. Bidding
Placing a bid constitutes a legally binding commitment to purchase the lot if you are the successful bidder. Bidders are responsible for all bids placed through their accounts. Estate Sales By Schmitz reserves the right to reject or cancel bids when permitted by the auction platform and applicable law.

6. Pickup & Shipping
Buyers are responsible for pickup, packing, shipping, transportation, and associated costs unless otherwise stated. Buyers using third-party movers or shippers assume responsibility for coordinating those services. Items must be collected within the stated pickup period.

7. Failure to Pick Up Items
Items not collected within the designated timeframe may be subject to storage charges and, after reasonable notice and subject to applicable law, may be considered abandoned. No refund will be issued for items a buyer fails to collect.

8. Damage During Shipping or Removal
Estate Sales By Schmitz is not responsible for loss or damage occurring after an item has been released to the buyer, buyer's representative, carrier, or third-party shipping company. Buyers are encouraged to obtain appropriate shipping insurance.

9. Withdrawal or Modification of Lots
Estate Sales By Schmitz reserves the right, when permitted by the auction platform and applicable law, to withdraw, combine, divide, or correct a lot or its description before the lot is sold.

10. Technical Issues
Estate Sales By Schmitz is not responsible for internet interruptions, platform outages, delayed bids, device failures, or other technical problems outside its reasonable control.

11. Disputes
Any dispute regarding bidding, payment, pickup, or the interpretation of these terms will be handled in accordance with applicable law and any controlling terms or policies of LiveAuctioneers.

12. Acceptance of Terms
By registering, bidding, or purchasing through this auction, the bidder acknowledges that they have read, understood, and agreed to these Terms & Conditions and any additional terms displayed on the auction listing.
