These Terms and Conditions govern the relationship between House of Agape Estate Sale Company ("we," "us," or "our") and our clients ("you" or "your") regarding the services we provide. By engaging our services, you agree to these terms.

2. Services Provided
We specialize in organizing, managing, and conducting estate sales, including but not limited to:

Inventory assessment and pricing
Marketing and advertising of the sale
On-site sale management
Post-sale cleanup and donation coordination
3. Client Responsibilities
As the client, you agree to:

Provide accurate and complete information about the estate and items for sale.
Grant us access to the property for preparation, sale, and cleanup.
Remove any items you do not wish to sell prior to the sale.
Ensure the property is safe and accessible for staff and buyers.
4. Fees and Payment

Our fees are based on a percentage of the total sales proceeds or a flat fee, as agreed upon in writing.
A detailed accounting of sales will be provided after the sale.
Payment of our fees is due upon completion of the sale, unless otherwise agreed in writing.
5. Item Pricing and Sales

We reserve the right to price items based on market value, condition, and demand.
All sales are final. No refunds or returns will be issued.
Items not sold during the sale may be donated, discarded, or returned to the client, as agreed upon in advance.
6. Liability

We are not responsible for any damage, loss, or theft of items before, during, or after the sale, except in cases of gross negligence or willful misconduct.
We are not liable for any injuries or accidents that occur on the property during the sale.
Clients are encouraged to secure their own insurance coverage for the property and items.
7. Cancellation Policy

If you cancel the estate sale after signing an agreement, a cancellation fee may apply, depending on the stage of preparation.
We reserve the right to cancel or reschedule the sale due to unforeseen circumstances (e.g., weather, safety concerns).
8. Dispute Resolution

Any disputes arising from our services will be resolved through mediation or arbitration in accordance with California law.
Both parties agree to waive the right to a jury trial.
9. Governing Law
These Terms and Conditions are governed by the laws of the State of California.

10. Amendments
We reserve the right to update or modify these Terms and Conditions at any time. Clients will be notified of any significant changes.

11. Entire Agreement
This document constitutes the entire agreement between House of Agape Estate Sale Company and the client, superseding any prior agreements or understandings.
