1.1. All accepted bids are final and legally binding in the state of CA. The location of the bidder is irrelevant.
1.2. No bid may be altered, withdrawn, or canceled once accepted by the Auctioneer for any reason.
2. CONDITION OF ITEMS / "AS-IS" SALES
2.1. All property is sold "AS IS, WHERE IS," with all faults and defects, without warranties of any kind, express or implied.
2.2. No refunds, exchanges, or credits will be given under any circumstances.
2.3. The Buyer is solely responsible for determining the condition, authenticity, provenance, and suitability of all items before bidding.
2.4. Measurements and descriptions are provided as a service to bidders and are believed to be accurate, but no guarantees or warranties are made, all measurements are approximate and may not be exact.
2.5. Items described as authentic are presented in good faith, but authenticity is not guaranteed. All bidders understand and agree that authenticity disputes will not be grounds for cancellation or refund.
2.6. In-person inspection is encouraged. Additional photographs may be provided upon request prior to bidding.
3. AUCTIONEER'S DISCRETION
3.1. Orrill's Auction reserves the right to reject or void any bid, whether winning or not, if it is believed not to be in good faith, to manipulate the auction process, or to violate applicable law.
4. BUYER'S PREMIUM AND PAYMENT TERMS
4.1. A 20 percent buyer's premium will be added to all winning bids.
4.2. Payment is due in full within 24 hours of the auction's conclusion.
4.3. Invoices of 10,000 dollars or more must be paid via wire transfer or cash.
4.4. Vehicle purchases must be paid by cash, cashier's check, or wire transfer.
4.5. Certain invoices may require payment by cash, cashier's check, or wire transfer at the Auctioneer's discretion.
5. PICKUP TERMS
5.1. All won items must be picked up within two (2) business days after sale close (e.g., Wednesday and Thursday).
5.2. Buyer is responsible for bringing all necessary labor, equipment, and packing materials to remove their items.
5.3. Any items not picked up within the required timeframe may incur a storage fee of $10 per item per day.
5.4. Items not picked up by the Monday following the auction will be deemed forfeited, and storage fees will still apply.
5.5. Buyer (or Buyer’s agents) is liable for any damage or injury caused during removal. Orrill’s Auction and the Seller are not responsible for accidents, injuries, or property damage during pickup or transport.
6. SHIPPING TERMS
6.1. If shipping is desired, Buyer must notify Orrill's Auction prior to auction close.
6.2. Orrill's Auction will assign items to a third-party shipping company only after the Buyer’s auction invoice is paid in full.
6.3. Buyer agrees to pay all shipping and handling costs directly to the third-party shipper within 24 hours of receiving the shipper’s invoice.
6.4. Orrill's Auction is not responsible for loss or damage once items are in the possession of the shipper. Once items leave our warehouse, any claims or disputes would be only addressible to the shipper.
7. CREDIT CARD CHARGEBACK WAIVER
7.1. Buyer agrees not to initiate any credit card chargeback for auction purchases under any circumstances.
7.2. If a chargeback is initiated in violation of these Terms, Buyer remains fully liable for the purchase price and all related costs, including attorneys' fees, incurred by Auctioneer or the Seller in disputing the chargeback and collecting payment.
7.3. Buyer acknowledges that acceptance of these Terms is a condition of bidder registration, and Auctioneer is relying on this agreement in allowing Buyer to participate in the auction.
