AUCTION TERMS OF SALE
These Terms of Sale govern all purchases made through our auction services, whether in person, online, by phone, absentee bid, or any other method. Your participation signifies acknowledgment and agreement to these terms. We reserve the right to amend or update these terms at any time before or during a sale. References to "we," "our," or "the auction house" denote the entity conducting the auction.
Unless specifically stated, we act solely as an agent for the consignor. All transactions are governed by California law, irrespective of the buyer's location or purchase method.
KEY DEFINITIONS
Final Bid Price: The highest accepted bid declared by the auctioneer when a lot is sold.
Buyer's Premium: An additional percentage added to the final bid, payable by the buyer.
Total Purchase Price: The sum of the final bid, buyer's premium, applicable taxes, and any additional charges.
Reserve: A confidential minimum price required for a lot to be sold.
Bidder/Buyer: An individual or entity submitting a bid or making a purchase.
Consignor: The individual or entity that has consigned an item for sale.
Lot: A single item or a grouped set of items offered at auction.
Property: The actual item(s) included in a lot.
PARTICIPATION TERMS
Participation in our auctions confirms your acceptance of these Terms of Sale. The auction house reserves the right, at its sole discretion, to reject or revoke bidding privileges, cancel any sale, or deny future participation for any reason.
PRIOR TO BIDDING
All items are sold "AS-IS, WHERE-IS." We strongly encourage all potential buyers to inspect items beforehand, either in person or by reviewing available images and descriptions. While we strive for accuracy, we do not guarantee any information regarding age, condition, authenticity, origin, materials, or value.
Statements made by staff, consignors, or auction representatives are opinions only and do not constitute binding guarantees. Buyers are responsible for their own due diligence prior to bidding. All sales are final; no refunds, exchanges, or cancellations will be accepted post-sale.
ONLINE BIDDING
Online bids are accepted via LiveAuctioneers.com or other authorized platforms. Registration is subject to approval; we reserve the right to deny auction access without explanation. Bidders are encouraged to register at least 48 hours in advance for timely approval.
We are not responsible for internet interruptions, software failures, or technical delays preventing timely bidding. All online bids are binding and cannot be retracted due to input error or internet issues.
DURING THE AUCTION
Our auctions are conducted in accordance with all applicable commercial and penal codes. Each lot may carry a confidential reserve unless otherwise disclosed. We reserve the right to withdraw lots, reject any bid, or remove any individual from the auction process at our discretion.
In the event of a bidding or lot ownership dispute, the auctioneer's decision is final and binding. Item information may be updated or corrected prior to or during the sale; such updates supersede previously published details.
STORAGE
Purchased items must be removed within five business days of payment. Failure to collect merchandise will result in storage fees of $5.00 per day per item. After eighteen days, items will be deemed abandoned and may be resold or disposed of at our discretion, with proceeds retained as liquidated damages.
SHIPPING
We utilize a third-party shipping company for delivery services. Upon payment completion, the shipping company will contact you directly to coordinate logistics. Buyers may also arrange their own shipping, but we are not liable for any damage, loss, or delay once items have left our custody. A release form must be submitted prior to releasing items to any third party.
DISCLAIMER ON AUTHENTICITY
We do not guarantee the authenticity of any item unless explicitly stated. Descriptions, including details on artist, maker, period, and provenance, are provided as general guidance and are not binding. Buyers accept the risk that such information may be incorrect or incomplete and must bid accordingly.
COMPLIANCE WITH LAWS
We adhere to all state and federal regulations concerning the sale of items containing materials from protected species. It is the buyer's responsibility to ensure compliance with CITES or other import/export laws. We do not guarantee the issuance of permits and will not delay or reverse transactions due to regulatory issues.
FINAL NOTICE
Participation in our auctions constitutes a full and binding agreement to these terms. All sales are final, and buyers accept all risks associated with purchasing secondhand, vintage, or collectible items through auction.
