Terms & Conditions
These Terms & Conditions of Sale (the “Terms??) apply to every auction, bid, purchase, and related transaction conducted by Easton Gallery (“Easton Gallery,?? “we,?? “us,?? or the “Auctioneer??), whether participation occurs in person, online, by telephone, or through an absentee bidding arrangement. A person who registers, bids, or purchases property (“Buyer??) accepts these Terms and agrees to comply with them.
Easton Gallery may decline a registration, refuse a bid, cancel or rescind a transaction where permitted, or suspend future bidding privileges when a Buyer violates these Terms or otherwise creates a risk to the sale process.
Unless a lot is identified as owned by Easton Gallery, property is generally offered on behalf of an independent owner or consignor, and Easton Gallery acts as the selling agent for that property.
1. BEFORE YOU BID
Buyers should inspect property personally, or arrange for an inspection by a qualified representative, before submitting a bid. Each lot is offered and sold AS IS, WHERE IS, WITH ALL FAULTS. Except where Easton Gallery expressly agrees otherwise in writing, every sale is final.
Descriptions, photographs, measurements, catalogue notes, condition observations, advertising, and verbal statements are provided as a convenience only. They should not be treated as a warranty or guarantee regarding condition, quality, size, rarity, age, maker, artist, medium, material, authenticity, attribution, provenance, origin, historical importance, or any other characteristic of a lot.
No consignor, employee, contractor, or representative may create a warranty on behalf of Easton Gallery unless the warranty is specifically stated in writing by Easton Gallery for the lot in question.
The Buyer is responsible for independent research, inspection, and due diligence. Facts learned after the sale—including information obtained from a later appraisal, expert opinion, laboratory test, or other research—do not, by themselves, create a right to cancel the sale, obtain a refund, or receive a price adjustment.
2. BIDDING OPTIONS & REGISTRATION
Absentee and Telephone Bidding
Easton Gallery may offer absentee and telephone bidding when operationally feasible. Requests should be received no later than 6:00 p.m. on the day before the scheduled auction. Required bidder information, forms, and acceptance of these Terms must be completed through a method approved by Easton Gallery before the request is considered active.
We will use reasonable care to place a properly submitted absentee bid or to reach a telephone bidder, but these services are provided as a convenience and are not guaranteed. Easton Gallery is not responsible for missed calls, transmission problems, clerical mistakes, equipment or platform failures, or other circumstances that prevent a bid from being placed or received.
A request to withdraw an absentee or telephone bid must be received in writing at least twenty-four (24) hours before the auction begins. Written cancellation requests may be sent to info@easton-gallery.com. A cancellation is effective only when timely received and acknowledged by Easton Gallery.
Online Bidding
Internet bidding may be made available through LiveAuctioneers.com or another online marketplace selected by Easton Gallery. Creating an account or submitting a platform registration does not guarantee approval to bid. Easton Gallery may approve, reject, limit, or condition online bidding access at its discretion and may request additional identification, documentation, or a separate bidder approval form.
For the best chance of approval, online registration should be completed at least twenty-four (24) hours before the sale. Requests received closer to the auction may be reviewed, but approval is not assured.
The Buyer is responsible for all bids placed through the Buyer’s online account. Once transmitted and accepted, an online bid is binding. Easton Gallery is not liable for internet interruptions, software or platform errors, delays in transmission, website outages, device failures, or similar technical issues affecting participation.
3. AUCTION CONDUCT
Easton Gallery conducts the sale as auctioneer and, for consigned property, as agent for the consignor. Easton Gallery is not responsible for a consignor’s separate acts or omissions.
Where lawful and unless announced otherwise, a lot may be offered subject to a confidential reserve or minimum selling requirement.
To protect the integrity and orderly conduct of the auction, Easton Gallery may, as circumstances require:
• withdraw a lot before or during the auction;
• decline or disregard any bid;
• refuse admission or discontinue a person’s participation;
• resolve competing-bid or bidding-sequence disputes;
• reopen bidding when appropriate; and
• correct, clarify, update, or supplement information about a lot before the lot is sold.
If a disagreement arises about bidding, the successful bidder, or the conduct of the sale, Easton Gallery’s decision will control to the fullest extent permitted by law.
Lot descriptions, estimates, announcements, catalogue entries, and related information may be revised at any time before the hammer falls. The lot is sold based on the information and announcements in effect at the time of sale.
A bid communicated in person, online, by telephone, by email, by fax, or through an absentee arrangement becomes binding when accepted. Buyers are responsible for mistakes made when entering, transmitting, or communicating a bid.
4. PURCHASE PRICE, PAYMENT & DEFAULT
The amount owed by the successful Buyer consists of the hammer price, the applicable buyer’s premium, required taxes, and any additional charges or fees properly shown on the invoice. All sales are final.
Easton Gallery does not accept PayPal and will not accept credit-card information sent by telephone, email, or fax. Property may be held until checks, wires, or other non-cash payments have fully cleared and Easton Gallery has confirmed receipt of available funds.
Unless a specific auction states different terms, payment must be received within ten (10) business days after the auction. If timely payment is not made, Easton Gallery may cancel the sale, offer the property for resale privately or at a later auction, and exercise any other remedy permitted by these Terms or applicable law.
A Buyer who refuses or fails to complete payment may be charged liquidated damages equal to thirty percent (30%) of the hammer price, to the extent enforceable under applicable law. If an invoice remains unpaid or incomplete for fifteen (15) days, Easton Gallery may also report or dispute the transaction with the applicable bidding platform and may suspend or revoke future bidding privileges.
Payment Terms by Bidding Method
A. Floor Buyers. A 25% buyer’s premium applies. Payment is due on the auction date. Accepted forms of payment include cash and checks approved by Easton Gallery and drawn on a United States bank. Easton Gallery may require a cashier’s check, money order, or bank wire transfer for any transaction.
B. Telephone and Absentee Buyers. A 25% buyer’s premium applies. Full payment must be received within ten (10) business days after the sale. Approved checks, money orders, cashier’s checks, and bank wire transfers are accepted. Visa or Mastercard information will not be accepted by telephone. Easton Gallery may require a cashier’s check, money order, or bank wire transfer at its discretion.
C. Online Buyers. A 25% buyer’s premium applies unless a particular auction or online platform clearly states a different premium. Full payment must be received within ten (10) business days after the sale. Approved checks, money orders, cashier’s checks, and bank wires are accepted. Online Buyers will generally be sent an invoice by email within forty-eight (48) hours after the auction; however, not receiving an invoice does not relieve a Buyer of responsibility for a successful purchase or the deadline for payment.
International Payments
A Buyer sending funds from outside the United States must pay by bank wire transfer, regardless of how the bid was placed. Payment is complete only when the full invoice amount has been received by Easton Gallery in cleared funds.
The Buyer is responsible for bank charges, intermediary-bank fees, exchange-rate costs, currency-conversion expenses, and any other transfer fees. All invoices and payments are in U.S. dollars (USD). Foreign checks are not accepted. Purchased property may remain in Easton Gallery’s possession until all funds have cleared.
Taxes and Exemptions
Applicable state and local sales or use taxes will be collected when required by law, including on property picked up in person. A Buyer claiming a resale or other exemption must provide valid, current exemption documentation before the transaction is completed.
5. REMOVAL, HANDLING & STORAGE
Packing, lifting, loading, removal, and transportation of purchased property are the Buyer’s responsibility unless Easton Gallery agrees otherwise in writing. Any assistance provided by Easton Gallery or its staff is a courtesy. To the extent permitted by law, Easton Gallery is not responsible for injury to persons or damage to property arising from packing, handling, moving, loading, or transportation before or after the sale.
Buyers should arrange pickup promptly after cleared payment. Removal must occur at a time and in a manner acceptable to Easton Gallery, and all related costs and risks remain with the Buyer.
Property not collected within five (5) business days after payment has been completed may be assessed a storage fee of $10.00 per item, per day. Property left uncollected for more than thirty (30) days may be treated as abandoned, subject to applicable law. Where allowed, Easton Gallery may apply deposits or other funds it holds toward storage charges, losses, expenses, damages, or costs connected with unpaid or abandoned property.
6. SHIPPING
Shipping is not included in the purchase price unless the lot or invoice expressly states otherwise. Before arranging shipment, the Buyer should confirm all transportation charges and available insurance options. Shipping, packing, handling, insurance, and related costs are the Buyer’s responsibility.
Independent shipping companies are not agents or employees of Easton Gallery. The Buyer should review the selected shipper’s own terms, limits of liability, insurance provisions, claim procedures, and delivery requirements.
International Buyers are solely responsible for customs requirements and for compliance with all import, export, transportation, and other laws applicable to the destination. Easton Gallery may offer reasonable logistical assistance, but it does not guarantee delivery and is not responsible for customs holds, seizures, delays, denied entry, denied export, or other consequences caused by governmental or legal restrictions.
7. ENDANGERED, PROTECTED & REGULATED MATERIALS
Some property may contain or incorporate materials that are protected, endangered, restricted, or otherwise regulated, including ivory, rhinoceros horn, tortoiseshell, coral, whalebone, Huanghuali, Huali, other regulated woods, or other animal- or plant-derived materials.
Such property may be governed by federal, state, foreign, customs, CITES, import, export, transportation, possession, or resale restrictions. The Buyer alone is responsible for determining whether a lot can lawfully be purchased, possessed, transported, exported, imported, or resold in the Buyer’s jurisdiction and intended destination.
An export authorization from one jurisdiction does not assure that another jurisdiction will permit import. Failure to obtain a permit, certificate, license, or other governmental authorization does not cancel the sale or excuse the Buyer from full and timely payment.
When reasonably possible, Easton Gallery may assist with documentation or information, but it does not promise that any permit, certificate, or license will be issued. A catalogue notation concerning regulated materials is informational only and is not a legal determination or warranty regarding the status of the lot.
8. SPECIAL PROPERTY CATEGORIES
Jewelry, Jade & Similar Materials
Jade, gemstones, jewelry, and related materials may have been treated, enhanced, repaired, altered, dyed, bleached, impregnated, or otherwise processed. Unless Easton Gallery gives a specific written guarantee for a particular lot, Easton Gallery does not warrant color, age, quality, treatment status, composition, origin, or authenticity. These items are sold AS IS, WHERE IS, and all sales are final. Buyers should obtain any professional examination they consider necessary before bidding.
Paintings & Fine Art
Unless a particular lot includes an express written guarantee from Easton Gallery, no warranty is made regarding a painting or work of art’s authenticity, artist, attribution, authorship, origin, age, medium, condition, quality, provenance, or other characteristic. Buyers are encouraged to conduct independent research and seek professional opinions before bidding. A later difference of opinion regarding attribution, authenticity, or other characteristics does not create a right of return unless Easton Gallery has expressly agreed otherwise in writing.
9. BUYER ACKNOWLEDGMENT
By registering for an auction, submitting a bid, or completing a purchase, the Buyer confirms that the Buyer has read, understood, and accepted these Terms & Conditions of Sale.
The Buyer further confirms that the purchase is based on the Buyer’s own inspection, research, judgment, and due diligence. Except where Easton Gallery expressly states otherwise in writing, all property is sold AS IS, WHERE IS, WITH ALL FAULTS, and all sales are final.
