TERMS & CONDITIONS
Auctioneer, Bidder, Buyer, and Seller agree to be bound by the following Terms and Conditions. Please review carefully before bidding. Registering to bid and/or placing a bid constitutes full understanding and acceptance of these Terms.
1. REGISTRATION
Bidders must register before placing bids. Valid identification and credit card information are required. Kings Road Auctions reserves the right to decline registration or bidding for any reason.
2. PROPERTY CONDITION
All items are sold ?As is, Where is?? without warranty or guarantee of any kind. Internet descriptions, printed materials, and statements by staff are offered as helpful guides but are not guaranteed to be complete or accurate. The absence of condition notes does not imply an item is free of flaws. Buyers are responsible for examining all items before bidding. Condition reports are available upon request.
3. BUYER?S PREMIUM
A 25% buyer?s premium will be added to the hammer price of each lot, plus applicable sales tax.
4. PAYMENT TERMS
Accepted forms of payment include Visa, MasterCard, American Express, Discover, wire transfer, certified check, and cash (in person). A 3% processing fee is added to all credit card payments.
Invoices must be paid within 5 business days of the auction. Invoices over $3,000 must be paid via wire transfer or certified funds.
Do not send payment before receiving an official invoice from Kings Road Auctions. A notice from LiveAuctioneers or any other platform that you have won a lot is not a guarantee of ownership.
If payment is not received within 10 calendar days, a 5% late fee will be added and a dispute may be filed with the bidding platform. After 10 days, Kings Road Auctions reserves the right to charge any credit card on file for the full invoice amount. By bidding, the purchaser waives the right to dispute this charge.
If no payment is arranged within 3 days of invoice, Kings Road Auctions will charge the credit card used during registration.
5. BIDDING INCREMENTS
Bids must follow these set increments:

$101?500: $25
$501?1,000: $50
$1,001?3,000: $100
$3,001?5,000: $250
$5,001?10,000: $500
$10,001?20,000: $1,000
$20,001?50,000: $2,500
$50,001?100,000: $5,000
$100,001?200,000: $7,500
$200,001?500,000: $10,000
Over $500,000: $20,000
6. TIE BIDS
In the event of a tie between a floor, phone, or absentee bidder and an internet bidder, the floor or gallery bid takes precedence. Auctioneer?s on-site records are final in the case of discrepancies.
7. INTERNET BIDDING
Internet bidding is offered as a service. Kings Road Auctions is not responsible for any errors, delays, or technical malfunctions. If you leave absentee bids online and later choose to bid by phone or in person, it is your responsibility to cancel those bids.
8. SHIPPING & PICKUP
Kings Road Auctions does not pack or ship items. Buyers are responsible for arranging pickup, packing, and shipping through a third-party service. Contact us for local shipper recommendations.
All purchases must be picked up within 14 calendar days of the auction. After that, storage fees of $10 per lot, per day will apply. Items not retrieved within 60 days will be considered abandoned and resold to recover storage and administrative costs. Kings Road Auctions is not responsible for items left beyond the pickup deadline.
9. SALES TAX
A 6% Florida state sales tax will be applied to all purchases unless the buyer provides a valid resale certificate prior to payment. Out-of-state buyers are exempt unless picking up in person. In that case, a signed affidavit and valid resale certificate must be submitted to avoid tax.
10. TITLE & RISK
Ownership, risk, and responsibility for purchased lots pass to the Buyer when the Auctioneer declares the lot sold. Kings Road Auctions is not responsible for any loss or damage thereafter.
11. GUARANTEES
All property is sold ?As is, Where is.?? No guarantees of age, origin, condition, value, or authenticity are expressed or implied. Statements made by Auctioneer or staff are opinions and not warranties. Descriptions including dimensions, metal content, condition, etc., are approximate.
Kings Road Auctions does not guarantee the working condition of clocks or watches, or the authenticity of Oriental rug patterns or names. Jewelry weights, sizes, and grades are approximate.
12. LIMITED RETURNS
Returns are accepted only under the following conditions:
(a) The buyer requested and received a written condition report prior to the auction,
(b) The physical condition materially differs from that report,
(c) Notice of return is given within 24 hours of delivery,
(d) The item is returned in the same condition within 10 days of delivery.
Shipping is non-refundable. Failure to notify Kings Road Auctions within 5 days of delivery constitutes acceptance of the item. Buyers have no recourse if items are not retrieved or shipped within the stated time frame.
13. RESERVES
Some lots are subject to reserve prices, which are never higher than the published low estimate. Kings Road Auctions may bid on behalf of the consignor to protect the reserve.
14. LEGAL DISPUTES
Any legal action arising out of this auction must be brought in Collier County, Florida, and governed by the laws of the State of Florida. Bidders agree to binding arbitration with no appeal, except as allowed under Florida statute. The prevailing party is entitled to attorney?s fees and arbitration costs. For collection purposes, Kings Road Auctions may pursue traditional court remedies and charge a 33?% attorney fee plus 2% monthly interest on unpaid balances.
15. DAMAGES & LIABILITY
Kings Road Auctions and its staff are not liable for damage or loss resulting from handling or loading items. We are also not responsible for any loss or damage to items not picked up within the 14-day pickup period.
16. POOLING & BID RIGGING
Any form of bid rigging or collusion is a federal offense and will be reported. Kings Road Auctions reserves the right to report and act against any suspicious activity.
