Next Bid Auctions – Terms and Conditions of Sale

1. Licensing and Identification
In compliance with Florida Statute Chapter 468, all auctions are conducted by Next Bid Auctions, Florida License No. AB4232, and Auctioneer Shelly Earp, Florida License No. AU5619.

2. Buyer’s Premium & Pricing Examples
A non-refundable buyer's premium is added to the high bid ("hammer price") of every lot sold:

15% Buyer’s Premium.

Calculation Example:

A $100 winning bid results in a $115.00 subtotal (plus tax).

3. Online Bidding & "Soft Close" Feature
To ensure all bidders have a fair opportunity, Next Bid Auctions utilizes a "Soft Close" for online auctions. If a bid is placed within the final 3 minutes of a lot's closing time, the bidding period for that specific lot will automatically extend for an additional 3 minutes. This process continues until no further bids are received during the extension period.

4. Payment Terms & Checkout Instructions
All purchases must be settled in full at the close of the auction.

Checkout Process: Winning bidders will receive a printed invoice (live) or an emailed invoice (online). A paid receipt is required for item removal.

Accepted Methods: Cash, Debit, Personal/Business Check, Cashier’s Check, and Major Credit Cards.

Check Policy: If paying by personal or business check, item(s) may only be removed once the check has cleared our financial institution.

Default: Failure to pay in full at the close of the auction may result in forfeiture of the lot and a permanent ban from future auctions.

By registering for an online auction, the bidder authorizes Next Bid Auctions to charge the credit card on file for the full amount of any winning bids, including buyer’s premiums and applicable taxes, immediately upon the close of the auction.

5. Reserved Rights and Dispute Resolution
Next Bid Auctions reserves the right to reject any bid at its sole discretion. In the event of a dispute between bidders, the Auctioneer has the final authority to determine the winner or re-open the bidding. The Auctioneer’s decision is final and absolute.

6. Clerical Errors and Technology Failures
Next Bid Auctions is not responsible for clerical errors, omissions, or inaccuracies in descriptions. In the event of a technology failure, software malfunction, or internet interruption, Next Bid Auctions reserves the right to pause, cancel, or extend bidding to maintain the integrity of the sale.

7. "As-Is, Where-Is" Sales
All property is sold "AS-IS, WHERE-IS" with all faults. Next Bid Auctions and the Seller make no warranties or representations concerning condition or fitness for purpose. Bidders are responsible for inspecting items during scheduled preview times.

8. Removal, Pickup, and Abandonment

Onsite Item Removal & Pickup

Live Auction Gallery Pickup Location: 1706 N. Magnolia Avenue Ste 300, Ocala, FL 34475.

Live Auctions: All purchased items must be removed on the day of the live auction unless arrangements have been made between Next Bid Auctions and the buyer.

Online Auctions: Specific pickup dates and times will be outlined in the individual terms of each online auction.

Abandonment: Any items not removed by these specified deadlines will be owned by Next Bid Auctions, deemed abandoned, and resold without further notice or refund to the buyer.

Offsite Item Removal & Pickup

Offsite Location Defined: Certain items or auctions may be located at an "Offsite" location (private residence, business, or third-party facility) rather than the main Next Bid Auction Gallery. These locations will be clearly marked in the auction description.

Same-Day Removal: All items purchased at an offsite auction must be paid for and removed from the premises on the day of the auction during the designated pickup window.

No Late Access: Because offsite locations are often private property, there is no access to the site after the scheduled pickup window concludes.

Loading and Removal of Purchased Items

Buyer’s Sole Responsibility: The Purchaser is solely responsible for the disassembling, packing, moving, and loading of all purchased items.

Labor and Equipment: Next Bid Auctions does not provide labor, lifting equipment (such as forklifts or dollies), or packing materials (such as boxes, bubble wrap, or tie-downs). Buyers must bring sufficient assistance and appropriate equipment to safely remove their items during the designated pickup window.

Safety and Liability: Any damage to the item, the premises, or injury to persons occurring during the loading process is the sole responsibility of the Buyer. By participating in the auction, the Buyer agrees to hold Next Bid Auctions and the property owner harmless for any such incidents.

9. Waiver of Liability and Assumption of Risk

Assumption of Risk: All persons attending an auction, whether at the Next Bid Auctions, LLC or any offsite location, do so at their own risk. By entering the premises, you acknowledge that auction sites can be hazardous environments (containing heavy machinery, moving vehicles, or uneven terrain) and you voluntarily assume all risks of loss, damage, or injury.

Gallery Liability: Next Bid Auctions, its owners, employees, and agents shall not be held liable for any accidents, personal injuries, or property damage sustained by any person while on the premises of the Next Bid Auctions Gallery.

Offsite Auction Liability: For auctions held at offsite locations (private residences, farms, or businesses), Next Bid Auctions acts only as an agent for the seller. Next Bid Auctions shall not be liable for any injuries or accidents occurring at these locations.

Property Owner Indemnification: The Property Owner of any offsite auction location is not liable for any accidents, injuries, or damages to persons or property. By attending an offsite auction, you expressly waive any and all claims against the Property Owner and agree to hold them harmless from any current or future claims arising from your presence on the site or the removal of items.

Minor Children and Guests: Bidders are responsible for the safety and actions of any minor children or guests accompanying them. The same waivers of liability apply to all guests and invitees of the registered bidder.

10. Sales Tax
Applicable Florida sales tax will be added to the total purchase price unless a valid Florida Sales Tax Exemption Certificate is provided to Next Bid Auctions at the time of registration.

11. Legal Venue
These terms and conditions are governed by the laws of the State of Florida. Venue for any legal action arising from any auction conducted by Next Bid Auctions shall be in Marion County, Florida.
