AUCTION TERMS AND CONDITIONS
The following Terms and Conditions of Sale apply to all property offered in this auction, including items listed in this catalogue. Habatat Galleries, Inc. reserves the right to determine and modify the Terms of Sale at its discretion.
INTERNET BIDS: Images of the works will be hosted online. All bids must be submitted electronically and received no later than twenty-four (24) hours prior to the start of the auction. In the event that two or more identical bids are received, priority will be given to the bid first received by Habatat Galleries.
RESERVES: Certain lots are subject to a confidential reserve price, which is the minimum price below which the lot will not be sold.
AUTHENTICITY & CONDITION REPORTS: All works in this auction have been reviewed by the staff of Habatat Galleries. Each piece is deemed to be in good condition unless otherwise noted in the catalogue. Habatat Galleries certifies that each work has been created by the artist to whom it is attributed. Condition reports are provided as a courtesy and reflect the opinion of the gallery at the time of inspection.
SALES TAX: All objects are subject to applicable sales tax unless a valid exemption certificate is provided.
BUYER?S PREMIUM: A buyer?s premium, applicable credit card processing fees, and LiveAuctioneers platform fees (for purchases made via LiveAuctioneers.com) will be added to the final hammer price of all lots sold. All purchases must be paid for in full immediately following the auction.
ESTIMATES: Catalogue descriptions include estimated price ranges intended solely as a guide for prospective bidders. Estimates should not be relied upon as predictions of the final selling price and may be revised prior to the sale.
GENERAL AUCTION RULES: The reserve represents the minimum price the consignor is willing to accept. In the event of identical winning bids, priority will be given to the bid first received by Habatat Galleries.
TIMING: Purchased works will be shipped within approximately thirty (30) days of the auction date. Gallery communication will occur during normal business hours and within thirty (30) days of the sale. Delays in contact do not invalidate a winning bid.
BINDING AGREEMENT: By placing a bid, bidders acknowledge that they have reviewed and accepted all details of the artwork, including but not limited to condition, dimensions (including bases or stands), materials, and other attributes. All bids are binding, and all sales are final. No refunds, returns, or exchanges will be permitted. It is the bidder?s responsibility to resolve all questions prior to bidding.
STORAGE FEES & LATE PAYMENTS: Storage fees of $300 per piece, per month will apply beginning fifteen (15) days after payment. Unpaid invoices are subject to a 5% monthly late fee beginning seven (7) days after the sale. Any artwork not picked up within sixty-one (61) days will be considered abandoned and may be re-auctioned.
All items are sold AS IS to the highest bidder. Descriptions are provided in good faith, and every effort has been made to accurately describe each work. Packing, shipping, and insurance costs are the responsibility of the purchaser. Responsibility for the artwork transfers to the selected pickup or shipping provider once the work leaves the gallery premises.
