BIDDING

Bidding advances shall be regulated by the auctioneer and shall be at their discretion. The auction is conducted under the following terms and conditions and is applicable in accordance with state law. Announcements or corrections from the podium and through online auctions supersede those in the catalog.

Any person that registers or participates for the auction agrees and accepts these Terms & Conditions. All bidders shall meet qualifying requirements issued by the auctioneer to bid. Any bidder who is not in good standing with the auctioneer may be disqualified at their discretion and shall not be awarded lots.

Before placing a bid, bidders who have not established validated credit with the auctioneer must provide information that is deemed satisfactory (e.g. a copy of a matching credit card with photo I.D.)

Some of the items offered at auction are subject to a reserve. A reserve is a minimum price agreed upon by the consignor of the property and the auction house. The auctioneer reserves the right to bid on behalf of the consignor to reach the minimum sale amount. If the minimum amount is not reached, the auctioneer may pass the item. The auctioneer also reserves the right to bid on behalf of clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid.

All registration cards contain the full name, address, phone number, and e-mail address. Absentee bids may be left via our website, or at our store location. Absentee bidders agree to all terms and conditions. In terms of a tie in bidding between an absentee bidder and the house, the house will win said item at their amount bid. The highest bidder acknowledged by the auctioneer shall be the purchaser.

In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or offer the lot for resale. The auctioneer shall also have sole discretion to refuse any bid, or refuse to acknowledge any bidder.


DESCRIPTIONS, CONDITION, MEASUREMENTS, AND ESTIMATES

First and foremost, items are described to the best of our knowledge and ability. Descriptions are not intended to be definitive and should be thought of as opinions based on the following; Genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property. Assessments of the condition, measurements, and estimates are given as a courtesy to a client. They are purely opinion based and should not be treated as a statement of fact. We assume no responsibility for any error in bidder judgment or omission.

The absence of a condition statement does not imply that the lot is in perfect condition, completely free from imperfections, or the effects of aging. Bidders are strongly encouraged to view the item in person or request additional photos or measurements before bidding.

No statement made in item leads, descriptions, estimates, or during the sale should not be considered an assumption of liability or warranty. Items that we deem to be questionable in nature will be described as unauthenticated. Usage of this term does not imply anything other than our opinion.

Buyer's Premium & Payment

Per end of auction, the hammer price will not be the final price of the overall invoice. The invoice is subject to buyer's premium, sales tax, shipping, or any fees deemed necessary by Affiliated Auctions (e.g. all Florida residents are subject to a 7.5% sales tax.)

Payment for all auction items must be received within two weeks (14 days) from the date of the auction ending. If an invoice remains unpaid for longer than this time, the item(s) will be considered forfeited and ownership of the property will revert to Affiliated Auctions.

Payment may be made by money order or check that is supported by a valid banker's card (up to card maximum). We also accept MasterCard, Visa, American Express, Discover, Paypal, and personal checks.

We reserve the right to verify funds on all personal checks. A $30 fee will apply to all returned checks. The full purchase price on all lots sold to the same buyer must be paid before the removal of any of the items.

A Buyer's Premium of 17.5% for card, 12.5% for cash/check/Zelle applies to bidders on the floor, phone, and absentee.

RETURNS

Items described as being sold "as-is" are being sold in their current state without any guarantee and cannot be returned. If a guaranteed item is deemed not to be authentic by a panel of three competent authorities, a full refund of the purchase price and buyer's premium shall be the limit of liability of the auction company and or its representatives. Returns must be authorized and made within 10 days. Please ask about our approved authenticators.


SHIPPING
1. Please allow up to 2 weeks after payment for shipping to occur. Affiliated Auctions and Realty, LLC. does not guarantee to ship any item.
2. As a courtesy to the buyer, we can arrange for a third-party shipper to receive your items and ship them at the buyer's expense. If the buyer does not want to use our provided third-party shipping, it is the buyer's responsibility to notify Affiliated Auctions before payment of the item. To obtain shipping estimates from third-party shippers, please contact the Tallahassee UPS Store (#2281) at (850) 224-9969.
3. To avoid shipping charges, any winning bidder, on-site or online, has the option of picking up their items at the Affiliated Auctions Gallery located at 2500 Apalachee Parkway, Tallahassee, FL 32301. If the buyer chooses to pick up auction items, they should notify Affiliated Auctions before making payment.
4. PLEASE NOTE: WITH THE EXCEPTION OF WINE, WE DO NOT SHIP ANY OTHER ALCOHOL, NOR DO WE ARRANGE SHIPPING FOR ALCOHOL.
5. Affiliated Auctions will ship firearms that require a Federal Firearms License (FFL) or Curio & Relics (C&R) License to the dealer provided by the buyer. The cost of shipment will include shipping, handling, insurance, and any other necessary service. Please contact Affiliated Auctions before bidding for estimates.
6. PLEASE NOTE: IVORY ITEMS WILL ONLY BE SHIPPED WITHIN THE UNITED STATES - WITH THE EXCEPTION OF CALIFORNIA, HAWAII, ILLINOIS, CONNECTICUT, NEVADA, NEW HAMPSHIRE, NEW JERSEY, NEW YORK, WASHINGTON D.C., OREGON, VERMONT, AND WASHINGTON. THIS LIST MAY NOT BE EXHAUSTIVE - PLEASE CHECK YOUR OWN STATE'S LAWS REGARDING IVORY BEFORE BIDDING!
7. When purchasing firearms, it is the buyer's responsibility to provide Affiliated Auctions & Realty with a current Federal Firearms License (FFL) or Curios & Relics License (C&R). Federal regulation prohibits the shipping of federally regulated firearms to a non-licensed individual. All firearms will be shipped to the license holder's Premises Address. We will NOT ship firearms unless we have a current FFL and/or C&R license. The license may either be faxed to (850) 656-8948 or e-mailed in an attachment to Firearms@affiliatedauctions.com.
8. All items shipped by Affiliated Auctions will be shipped within 10 business days after receipt of payment. We will schedule a pick-up of all items to be shipped by third-party shippers within 10 business days after receipt of payment; after which time Affiliated Auctions will consider the item shipped.
9. Shipping charges are the responsibility of the bidder. In the event an item is shipped by Affiliated Auctions, the shipping carrier will vary depending on the items purchased. Either UPS or USPS will be used. If multiple items purchased require more than one box, packing and handling will be charged on a per-box basis. If paying by check or money order, please contact the auction house for payment instructions on shipping.
10. All shipping and packing arrangements for oversized items are the responsibility of the buyer. All buyers are strongly encouraged to get quotes from shipping companies and make arrangements before bidding.
11. To help expedite our shipping process, we will be adding the cost of shipping and handling to items that we ship in-house. This will ensure that your winnings are sent out as soon as possible. This excludes items that are large or fragile as they will be shipped via a third-party shipper.

STORAGE FEES

After the item has been paid for, the buyer has 30 days to arrange for shipping. Affiliated Auctions will no longer be responsible for the item during this time. If the item remains in the gallery after this period, the item will be considered abandoned and ownership will revert to the auction house.
