These Terms and Conditions of Sale (“Terms”) govern all auctions conducted by DOCKERY GROUP, LLC, a Georgia limited liability company doing business as Dockery Auctions (“Dockery Group,” “we,” “us,” or “Auctioneer”). By registering for or participating in any Dockery Group auction, you (“Buyer” or “Bidder”) agree to be bound by these Terms.

Important Disclaimer
Dockery Group reserves the right to refuse individual admission and participation in our auctions, to reject bids at any time, and to withdraw any lot from auction at any time.

If Buyer fails to make arrangements to pick up or ship purchased items within the designated time frame, those items will be forfeited with no refund.

By accepting these Terms and participating in this auction, Buyer agrees not to dispute any payments charged to the payment method on file.

Dockery Group may modify these Terms without prior notice. Auctions may be recorded in both audio and video for security and quality assurance purposes.

Section 01
Registration
By registering to participate and bid in a Dockery Group auction, Buyer agrees to these Terms and Conditions of Sale.

Dockery Group reserves the right to request a copy of a valid driver’s license and credit card to keep on file, and is hereby authorized to process up to twenty percent (20%) of the low estimate on all lots requested for phone and/or absentee bidding.

Dockery Group further reserves the right to process payment using the credit card on file if Buyer fails to pay the invoice in full within twelve (12) hours of the invoice being sent.

Section 02
Warranties & Representations
All property is sold AS IS, WHERE IS, and without recourse.

Dockery Group, for itself and as agent for the seller, makes no warranties or representations of any kind with respect to any Lot. Buyer agrees that in no event shall Dockery Group be held responsible or liable for the correctness, description, genuineness, authorship, attribution, provenance, period, culture, source, origin, value, or condition of any Lot.

Nothing said or done by Dockery Group shall be deemed a warranty, a representation, or an assumption of liability by Dockery Group.

Section 03
Condition
Condition reports state our professional opinion and should not be treated as a statement of fact. Dockery Group is not responsible for any omissions or errors in these condition reports.

The absence of any reference to the condition of a Lot does not imply that the Lot is in perfect condition or free of imperfections.

Section 04
Buyer’s Premium
Buyer agrees to pay Dockery Group a buyer’s premium based on the winning bid amount as follows:

Twenty percent (20%) on hammer prices up to $100,000.
Section 05
Sales Tax
All purchases are subject to the sales tax rate stipulated by the applicable city and/or state, unless a valid tax-exempt certificate is supplied to Auctioneer.

Section 06
Payment & Pickup Policy
Please Note
ALL SALES ARE FINAL AND NON-NEGOTIABLE.

By participating in this auction and accepting these Terms, Buyer agrees not to file any claim or chargeback against payments charged to Buyer’s credit card. If Buyer fails to pick up items or arrange shipping within the scheduled time frame, payment will remain processed and the items will be considered forfeited.

Invoices will be emailed immediately following the auction. It is Buyer’s responsibility to remit payment and remove merchandise in accordance with these Terms. If Buyer does not comply, payment will not be refunded and items will be considered forfeited.

If Buyer fails to pick up large furniture items, Buyer will be charged $100 per item not removed.

ALL BUYERS: Full payment of the invoice is required within twelve (12) hours after the auction has concluded. Removal of goods is required by the specified pickup date given by the Auctioneer.

Failure to remove purchased merchandise within the stated pickup time frame will result in forfeiture of items, no refund, and removal charges.

Section 07
Payment Methods
By placing a bid, Bidder accepts full responsibility, risk, and liability for the Lot, and agrees to remit full payment — including hammer price, applicable sales tax, and buyer’s premium — in the event Bidder is acknowledged as the highest bidder by the Auctioneer.

ALL BIDS ARE CONSIDERED LEGALLY BINDING AND NON-NEGOTIABLE.

Dockery Group accepts credit card, wire transfer, Zelle transfer, and Venmo transfer.

Please note: a flat $35 fee applies to domestic wire transfers and a flat $50 fee applies to international wire transfers.

Dockery Group will not release any item for shipment until payment has cleared through the respective financial institution.

Section 08
Failure to Pay
Should Buyer fail to pay the balance of the invoice before item pickup, or otherwise fail to comply with these Terms, Dockery Group shall be entitled to one or more of the following remedies:

To recover from Buyer all monetary loss arising from the resale of the Lot, including all costs of any resale or attempted resale;
To retain any deposit or partial payment paid by Buyer;
To recover from Buyer all costs and expenses of collection, including attorney’s fees of fifteen percent (15%) of the outstanding balance, interest on the outstanding balance of up to three percent (3%) per month, and other related costs;
All other relief and remedies allowed by law.
Georgia law governs these Terms. Jurisdiction and venue over all disputes involving these Terms and Conditions shall lie exclusively in Fulton County, Georgia.

NOTE: It is Bidder’s responsibility to ensure that the Auctioneer is provided with a correct email address for invoice delivery.

Section 09
Liability
Dockery Group assumes no liability for damage to sold property beyond the pickup time frames provided in these Terms.

Section 10
Autopay
If Buyer has not contacted Dockery Group to arrange payment within twelve (12) hours of the time the invoice is sent, Dockery Group will charge the credit card used to register for the auction for the full amount of the invoice.
