Terms & Conditions
Bonn Auctions, referred to hereinafter as the Company, operates in accordance with the following terms, conditions, and understandings. Bidders affirm, represent compliance, and abide by the following stipulations:
Format
This auction is online only. Inspection and bidding are performed on the LiveAuctioneers website(s). Delivery is handled through 3rd party carriers unless local delivery has been arranged at least 24 hours prior to close of the auction.
Eligibility
1. In addition to LiveAuctioneers requirements, auction participants must:
- have a spotless LiveAuctioneers payment record. Any non-payment reports, closed or open, will prevent participation in the auction
- have the ability and willingness to conduct bidding, payment, and communication on the LiveAuctioneers website
- have the ability and willingness to pay for all lots bid on the auction as further described below
- have registered on LiveAuctioneers before the start of the auction and have a spotless payment record. Those without a purchase history may petition to register but will be limited in bid amounts
- have a credit card or debit card on file with LiveAuctioneers
Merchandise
1. Merchandise descriptions are provided as a starting point for research and are without guarantee or warranty. The Bidder shall conduct due diligence on any lot to confirm to his satisfaction the proper identity of any property on which he wishes to bid or purchase. The Company will provide as much information as it has to aid potential buyers to make informed decisions about bidding, including provision of additional photographs.
2. The Bidder shall bid if and only if he has made prior and full satisfaction of suitability, merchantability, and condition of all properties to be purchased.
3. All items, lots, or merchandise are sold AS-IS WHERE IS without warranty unless explicitly stated as having one.
4. All previews of lots are conducted via the pictures and descriptions provided online. We do not offer onsite inspection of lots for this auction. You may inform us of your interest in live onsite auctions.
Bidding
1. All sales are final without option of refund or exchange unless the Company at its sole discretion determines otherwise.
2. The accepted highest bid is a legally binding contract between the Company and the bidder to purchase the auctioned lot. Any bidder failing to honor the contract will be prohibited from future sales and pursued for breach of contract and damages at the discretion of the Company.
3. Bidding closes by time meaning that all bids must be received prior to the scheduled close of bidding.
4. The Company may refuse any bid for any lot.
5. The Auctioneer may withdraw from sale any lot at any time prior to the declaration of SOLD unless it has been explicitly declared to be sold ABSOLUTE. liveauctioneers may impose a further time restriction of 2 hours prior to close.
6. All lots for this sale are sold with reserve and are NOT sold as ABSOLUTE.
7. The Company shall owe no obligation to the bidder should the LiveAuctioneers auction platform fail to execute its normal auctioneering duties.
Payment
1. Sales tax will be collected according to local and federal laws in the jurisdiction of both the buyer and seller.
2. Payment is due when the buyer is presented with an invoice.
3. The final price owed for the purchase of all lots includes the hammer price, applicable buyer's premium, shipping and handling, sales tax, payment processing fees paid to LiveAuctioneers, and any fees specified for the lot.
4. If the Buyer has not paid for his purchases within the terms stipulated by the invoice and these terms and conditions, the Company may levy a storage fee of up to 25 dollars per lot per day which must be paid in full prior to release of the property.
5. All sales are conducted in US dollars.
6. All payments will be processed through LiveAuctioneers regardless of any other options presented to the buyer before or after the auction. Do not call the Company for special arrangements or request alternative methods used with other auction houses. No exceptions will be made to this policy.
7. ACH payments take longer to clear and to release property for shipment. We only ship when LiveAuctioneers clears the lots for shipment which is based on settlement of payments. Credit card payments are usually instant but are not guaranteed to be so.
Non Payment and Late Payment
1. Lots on unpaid invoices may revert to the consigner or Company 7 days after issuance of invoices according to the time reckoning of the Company. Please make arrangements prior to bidding for other terms. This term is especially the case when there is no communication with the Company concerning status of payment.
2. Unpaid lots are subject to storage fees and abandonment.
3. Unpaid invoices are subject to late payment fees of 2 percent of the hammer values of the invoiced lots. Payment of this fee is required for release of property. The invoice will be updated with the late fee after the first failed attempt to collect the invoice.
4. Non paying complaints will be filed for those failing to pay invoices.
5. Paid property not retrieved by the buyer after 30 days may be declared abandoned and be subject to disposal solely at the discretion of the Company.
Shipping
1. Purchases must be paid in full before shipment.
2. Shipment usually occurs within 1 to 3 business days of payment depending upon the complexity of the packaging required to safely ship purchase. Shipping may take up to 5 to 7 days with heavy or complex volume.
3. The Company ships normally all merchandise by USPS Priority Mail insured if that option is chosen during invoice payment and the value of the shipment is under 1000 USD, or FedEx in the case of lots exceeding 1000 USD. The Company may be available for a modest fee for local delivery in metropolitan Atlanta for awkward or delicate items. Other shipping options include LiveShipping full service which will be selected at the discretion of the Company based upon size, value, and complexity of packaging.
4. In most cases, self-arranged shipment is not available, even if the invoice offers it as an option. Please contact us prior to the auction close for special case arrangements.
5. Lots will indicate the shipping model. In some cases, we will stipulate the delivery option. Please see the lot description for restrictions.
6. Local pick-up is not supported. However, the Company may meet at a mutually agreeable location for delivery of purchases. A delivery fee may be charged and is payable in advance or at the time of delivery in cash.
7. This auction uses Live Shipping which entails conveyance of properties to its designated logistics provider. This process usually incurs delays of a few days governed in part by the timing of payment.
Legal
1. This auction is governed by the laws and regulations of the State of Georgia.
