1. All Sales Are Final
All items are sold as-is, where-is, with no warranties, guarantees, or representations of any kind, express or implied. ProFound Finds makes reasonable efforts to accurately describe and photograph items, but buyers are responsible for evaluating condition, authenticity, age, and suitability prior to purchase. No refunds, returns, or exchanges will be issued for any reason, including but not limited to dissatisfaction with condition, size, color, or functionality.

2. Item Descriptions & Condition
Descriptions are provided in good faith based on available information. ProFound Finds does not independently authenticate, appraise, or guarantee the provenance, age, maker, or value of any item. Dimensions are approximate. Buyers are encouraged to ask questions prior to bidding or purchasing. All sales are final once payment is processed.

3. Payment

Payment is due in full at the time of purchase or, for online sales, upon invoice.
Accepted payment methods will be specified per sale event.
Items will not be released until payment is confirmed and cleared.
Failure to complete payment forfeits your purchase and may result in being blocked from future sales.

4. Pickup & Removal Policy
Buyers are solely responsible for the removal of all purchased items.

Pickup must occur during the designated pickup window specified for each sale. Pickup dates, times, and location will be communicated at the time of purchase confirmation.
ProFound Finds does not provide moving, loading, carrying, or delivery services of any kind. Buyers must bring their own help, equipment, and appropriate vehicles to safely remove their items.
Items must be removed in a safe and professional manner. Buyers are responsible for any damage caused to the property or to other items during removal.
Items not retrieved within the designated pickup window will be considered forfeited and will be donated, discarded, or resold at ProFound Finds' sole discretion, with no refund issued.

5. Online Estate Sales – Additional Terms

All online bids and purchases constitute a binding agreement to buy.
Winning bidders will be notified by email and must respond within 24 hours to confirm pickup arrangements. Failure to respond may result in forfeiture of the item with no refund.
Photos are provided for reference. Online buyers are especially encouraged to ask for additional photos or measurements before bidding, as condition questions cannot be resolved after purchase.
Proxy bidding, sniping, and bid retraction policies will be disclosed on the platform hosting each sale.

6. In-Person Estate Sales – Additional Terms

All sales are cash-and-carry unless otherwise stated. Buyers must be prepared to remove items the same day of purchase.
ProFound Finds reserves the right to limit capacity, require timed entry, or modify sale hours at its discretion.
Items may not be held or reserved without payment in full.
Buyers assume all risk upon taking possession of an item.

7. Liability Waiver
By participating in any ProFound Finds sale — online or in person — buyers agree that ProFound Finds and Top Tier Transitions LLC, their employees, agents, and representatives, shall not be held liable for:

Any injury, accident, or property damage occurring during a sale event or pickup
Any loss resulting from item condition, authenticity disputes, or undisclosed defects
Any incidental, consequential, or special damages of any kind

Buyers participate and take possession of items at their own risk.

8. Conduct
ProFound Finds reserves the right to remove any buyer from a sale event or ban any buyer from future sales for disruptive, unsafe, aggressive, or dishonest behavior, including bid manipulation or misrepresentation.

9. Photography & Privacy
Photos taken at in-person sale events may not include other attendees without their consent. ProFound Finds reserves the right to photograph items and sale events for marketing purposes.

10. Governing Law
These Terms & Conditions are governed by the laws of the State of Illinois. Any disputes arising from a ProFound Finds sale shall be subject to the jurisdiction of the courts of Cook County, Illinois.
