PAYMENT OF HIGHER-VALUED ITEMS
Higher-valued items or invoices with a high-value total may require an irrevocable wire transfer at the auctioneer's discretion. Auctioneer may also require an irrevocable wire transfer on any items that have had significant bid retractions prior to the beginning of the live auction.
PAYMENT
This auction uses Autopay by LiveAuctioneers. If you place a winning bid, your card will be charged shortly after the conclusion of the auction. Unless a wire transfer is required, at auctioneers discretion. Once payment has been cleared for item invoice, our in-house shipping team will generate a shipping charge for your order and you will receive a second invoice through Liveauctioneers. Pay Now button will be embedded into your invoices for easy and quick payment for shipping. When using Liveauctioneers pay now payment service, buyer to pay a 5.0% credit card processing fee (or current processing rate) which will be reflected on the invoice.

WE WILL NOT GUARANTEE OR REFUND INACCURATELY MARKED ITEMS. All weights, measurements, and sizes stated are considered to be approximate and are not guaranteed. We weigh our items on an Ohaus Navigator XT premium digital scale. We will not guarantee our scales are in exact calibration with any other scales. If you expect exact weights, sizes or measurements, DO NOT BID. We will NOT refund or guarantee for any reason any weights, measurements or sizes. Also, we do not professionally test precious metals or precious stones, we sell our precious metals based on their markings (unless we otherwise state that we tested an individual item) NO REFUNDS OR GUARANTEES. Our firm handles a high volume of merchandise in a short period of time. While our intent is to describe items, authenticity, and condition to have a successful and mutually satisfying transaction, it is economically impossible for us to achieve perfection on every item. Our firm lists items far in advance of the sale so that the buyer can ask questions BEFORE bidding. Interested bidders are strongly encouraged to request a condition report on any lots upon which they intend to bid, prior to placing a bid. At our expense, we do provide staffing to get the buyers the information BEFORE they bid. When bidding online and not inspecting in person, please understand that you are assuming all risk. Scheerer McCulloch, Inc. is not an authenticator. BIDDER IS ENCOURAGED TO CONTACT SCHEERER MCCULLOCH WITH ANY QUESTIONS REGARDING LISTED LOTS PRIOR TO EXECUTING A BID.
3. All auctions are conducted pursuant to applicable laws and regulations of the State of Indiana.
4. All firearms must be shipped by FFL dealer to FFL dealer. Buyer is responsible for registration fee plus shipping & handling and any fee from receiving dealer.
5. Scheerer accepts PayNow, or cash for payment (NOTE: Bidders paying by credit card with PayNow payments will be charged the current 3.0% credit card processing fee (or current processing rate) in addition to the buyer's premium, sales tax & bid price). Bidders paying with credit card directly (at our onsite location, in person ONLY) to Scheerer will be charged 5% credit card processing fee in addition to the buyer's premium, sales tax & bid price). Credit card must have a chip. Personal checks will be acceptable only if credit has been established with Scheerer. Items paid for by check will be held by Scheerer for 10 business banking days. The purchaser agrees to pay Scheerer a handling charge of $25.00 for any check dishonored by the drawee. Winning bidder agrees to pay Scheerer within 3 calendar days from auction date. We pay our consignors 14 days after the auction, at that point all sales issues are closed.
6. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Scheerer may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, (b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale, (c) demanding specific performance from the purchaser and/or (d) collecting from purchaser all reasonable costs and attorney fees incurred in pursuit of the remedies set forth in this paragraph.
7. In no event will the liability of Scheerer to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.
8. Some of the lots (very few) in this sale are offered subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Scheerer below which the lot will not be sold. Scheerer reserves the right to execute such reserves by bidding for the consignor. In any event and whether or not a lot is subject to a reserve, the Auctioneer may reject any bid or raise not commensurate with the value of such lot.
9. Except as provided in paragraph 8 above, the highest bidder as determined by the Auctioneer shall be the purchaser. In the case of a disputed bid, the Auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or re-offer the lot for sale. The Auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. Any bidder that plans on spending in excess of $5,000 should make arrangements with the Scheerer at least five (5) days in advance of the sale, as a deposit may be required to participate.
10. All merchandise purchased must be paid for and removed from the premises on the day of the auction. Scheerer may impose, and the purchaser agrees to pay, a monthly storage charge of 1.5% of the purchase price of any lot or portion of a lot not removed by the purchaser within five (3) business days after the date of sale. Scheerer shall have no liability for any damage to property left on its premises for more than three (3) days after the date of sale. At the option of Scheerer, the merchandise may be transferred to and stored at a bonded warehouse and the purchaser agrees to pay all transfer and storage expenses. Scheerer may impose, and the purchaser agrees to pay, a monthly interest charge of 1.5% of the purchase price of any lot or item not paid by the purchaser within thirty-five (3) days of the date of sale.
11. LOCAL PICKUP - ALL pickups must be scheduled with Scheerer McCulloch PRIOR to pickup day. Pickup is on Tuesday, June 24th, 9:30 am - 4 pm, Fort Wayne, IN 46814. Full location will be disclosed and added to each winning bidder's invoices.
12. Some items, such as exceptionally fragile items, items won by International bidders, or large items will be shipped by a third party for profit shipping company, Pak Mail, by default. Scheerer will send a notification to winning bidders email registered with liveauctioneers notifying bidder that items will be shipped by Pakmail, if items on invoice do not meet our in-house shipping criteria.
13. For items designated to ship through Pakmail: Some items may be designated to be shipped by our designated 3rd party shipper PakMail, Dupont Rd, Ft Wayne, IN (260) 637-4809. As a convenience to the buyer, the Auction House will, without any consent, give your property to PakMail, Dupont Village, Fort Wayne, Indiana for those items designated by Scheerer to be shipped through Pakmail. You may obtain a shipping estimate from PakMail up until 48 hours PRIOR to the auction or AFTER you have successfully purchased and paid for the item. PakMail will contact you with an estimate for packaging and shipping via email or phone after the Auction House has been paid in full. PakMail will pack and ship via UPS, FedEx, or other carrier, fully insured, for a fee payable in advance by credit card. Buyer will be contacted within approximately 30 days for shipping arrangements, with shipping to follow. PakMail and Auction House are not responsible for any damage or loss that occurs while your objects are in another's care. The Auction House and PakMail will also NOT be responsible for any damage or loss that occurs if you choose a shipping method that we have advised against and Auction House/ PakMail will require a waiver from the buyer acknowledging this. All international customs, duties, and other tariffs are the responsibility of the buyer. The selling price plus the buyers premium will be the declared value for insurance, customs, duties, and other tariffs during shipping in all cases. International bidders will need to contact Pak Mail for a shipping quote prior to placing a bid. Alternate arrangements MUST be made within 5 business days. If bidder does not pay the shipping costs or is unable to be reached by phone and email to collect shipping costs, items are returned to Scheerer. Items will be subject to a storage charge, and any additional transportation fees of items. Items will be held for 30 days, after returned by PakMail, at which point Scheerer will re-list the items to sell in another upcoming auction. Scheerer reserves the right to place a dispute with Liveauctioneers on incomplete transaction. Scheerer also reserves the right to charge former bidder commission to re-sell the item. International bidders will need to contact Pak Mail for a shipping quote prior to placing a bid.
14. Buyers premium:18% buyers premium will be charged on the final bid price to online & off location bidders. 14. Indiana sales tax will be charged to all buyers (live and online buyers).
15. Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, by internet, or other absentee bids.
16. Scheerer and its consignors make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. Scheerer expressly reserves the right to reproduce any image of the lots sold in this catalog. The copyright in all images, illustrations and written material produced by or for Scheerer relating to a lot, including the contents of this catalog, is, and shall remain at all times, the property of Scheerer and shall not be used by the purchaser, nor by anyone else, without our prior written consent.
17. These conditions of sale shall be governed by the laws of the State of Indiana. The purchaser/bidder agrees that any suit for the enforcement of this agreement may be brought, and any action against Scheerer in connection with the transactions contemplated by this agreement shall be brought, in the courts of the State of Indiana or any federal court sitting therein. The purchaser/bidder consents to the nonexclusive jurisdiction of such courts and waives objections that it may now or hereafter have to the venue of any such suit.
18. Scheerer reserves the right to withdraw any property before the auction.
19. Internet/online bids: Scheerer will use reasonable efforts to execute online bids, but Scheerer is not liable for equipment failure, inability to access the internet, software malfunctions or anything pertaining to executing online bids. Please note that there is a slight delay when bidding online, so please bid quickly. To reduce online bidders risk of not getting bids executed, auctioneer recommends online bidders to enter their bids online prior to the auction.
20. Auctioneer highly recommends pre-registration before auction. Auctioneer cannot guarantee the ability of the buyer to register on the day of the auction.
21. Scheerer will not transfer the sale of any item to a 3rd party. The winning bidder is responsible for payment and shipping of all items purchased.
22. Any items with significant bid reductions or retractions prior to or during the live auction are subject to termination of the transaction between Scheerer and the high bidder. The sale of the item may be canceled by the auctioneer at the auctioneer's discretion. Subsequently, the auctioneer can cancel or withdraw any transaction for any reason, even if an invoice was sent to the high bidder.
