Item Pricing: Upon appraisal and review of Client’s contents, the Parties will identify and agree to sell the Client’s sellable goods (the “Sellable Goods”), the Client furthermore agrees to any of the Seller’s pricing values and structure (the “Item Pricing”). Any Sellable Goods priced and set up for display may not be removed prior the Start Date, unless mutually agreed to by both Parties. In the event of removal of any Sellable Goods, the Client agrees to pay the Seller a compensatory commission fee equal to the Seller Fee based on the full price of the Seller’s Item Pricing.

Gross Estate Sales Proceeds: The Parties agree the Seller will accept payment of any Sellable Goods. The Seller will accept payments in the form of cash, certified check, and any electronic payments in the form of Venmo, Apple Pay, PayPal, and/or Mastercard and Visa debit and credit cards with a minimum twenty-and no/100 ($20) purchase (the “Gross Estate Sale Proceeds”). The Seller will deduct the Seller’s Fees from the Gross Estate Sales Proceeds, the Seller shall pay the remaining proceeds (the “Client’s Proceeds”) to the Client within seven (7) to ten (10) business days, or upon clearance of any check and or electronic payments received.

Responsibilities to the Client
a. To obtain any necessary permits to perform the Services.
b. To provide any tables, display cases, shelving, or items used to setup the estate sale.
c. The Seller is a licensed, bonded, and liability insured company. The Seller will not be held liable for any type of catastrophic, natural occurrences, Acts of God, personal injury, personal property or property damage, or any claims from any accidents or events that occur on or beyond premise of legal property owner location.
d. In the event the Seller finds questionable family items not previously identified as Sellable Goods, the Seller will immediately contact the Client to discuss further action.

Responsibilities to the Seller
a. The Client must provide full access to the Property within the specified Start and End Times.
b. The Property will have all utilities on and available to the Seller.
c. The Client agrees to furnish and pay for any trash removal service, including but not limited to any roll-off dumpsters, additional pick-ups, and any other waste removal services required.
d. Upon Commencement of this Agreement, the Client and its affiliates will not be allowed access to the Property until the State Date.
