Terms & Conditions
All property offered by YaShawn Auction House is sold subject to the following Terms and Conditions. By registering for, placing a bid in, or otherwise participating in any auction conducted by YaShawn Auction House, whether in person, by absentee bid, telephone bid, internet platform, or through an agent, the bidder agrees to be legally bound by these Terms and Conditions.
By placing a bid, the bidder acknowledges that they have read, understood, and agreed to these Terms and Conditions. Each bid constitutes a binding contract. Do not bid if you do not intend to purchase.
YaShawn Auction House reserves the right to refuse service, reject any bid, cancel any sale, withdraw any lot, or revoke bidding privileges at its sole discretion.
Registration
All bidders must register prior to bidding. Individual bidders may be required to provide valid government-issued photo identification and proof of address if such address is not shown on the identification. Corporate or business bidders may be required to provide documentation verifying the legal existence of the entity and the authority of the representative acting on behalf of such entity.
YaShawn Auction House may require first-time bidders, international bidders, or bidders seeking approval for high-value lots to provide additional information, references, credit card authorization, or a deposit prior to bidding. YaShawn Auction House may require a credit card authorization hold of up to $3,000 in order to approve bidding. This authorization hold is not an actual charge and will normally be released within approximately 3 to 7 business days if the bidder does not win any lots, depending on the bidder's bank or card issuer.
YaShawn Auction House reserves the right to refuse registration, reject any bid, request additional bidder verification, or revoke bidding privileges at any time and for any reason.
Bidding
All property is sold to the highest bidder acknowledged by the auctioneer or by the applicable online bidding platform. The auctioneer may refuse any bid, withdraw any lot, reopen bidding, resolve disputed bids, or determine the successful bidder at his or her sole discretion.
The fall of the hammer, the closing of a timed auction lot, or the platform's confirmation of the successful bid constitutes acceptance of the highest bid and forms a legally binding contract between the buyer and YaShawn Auction House, acting as agent for the consignor.
YaShawn Auction House is not responsible for missed bids, late bids, internet delays, platform outages, software errors, technical failures, or any other issue related to online bidding services or third-party platforms.
Absentee and telephone bids may be accepted as a courtesy. YaShawn Auction House is not responsible for failure to execute absentee or telephone bids, errors in execution, or inability to reach the bidder by telephone. Telephone and absentee bidders may be required to provide a valid credit card and may be required to submit a deposit of up to twenty percent (20%) of the estimated value of certain lots prior to bidding.
By placing a bid, the bidder agrees that the bid is binding and cannot be withdrawn, cancelled, or disputed after acceptance.
Buyer's Premium
A buyer's premium will be added to the hammer price of each lot. Unless otherwise stated in the auction listing or on the applicable bidding platform, the buyer's premium shall be twenty-eight percent (28%) of the hammer price.
Online bidding platforms, including but not limited to LiveAuctioneers, Invaluable, or other third-party platforms, may charge additional service fees, convenience fees, or platform fees according to their own policies. Such fees are the responsibility of the buyer.
Applicable sales tax will be added where required by law. Buyers claiming resale or tax-exempt status must provide valid documentation before the invoice is paid. Tax exemption will not be applied retroactively unless approved by the applicable platform or by YaShawn Auction House in writing.
Condition, Authenticity, Attribution and Inspection
All property is sold AS IS, WHERE IS, WITH ALL FAULTS. All sales are final. No returns, refunds, exchanges, cancellations, or rescissions will be accepted unless expressly stated in writing by YaShawn Auction House.
Neither YaShawn Auction House nor the consignor makes any warranty, guarantee, or representation, express or implied, regarding authenticity, authorship, attribution, provenance, origin, age, period, culture, condition, size, weight, material, completeness, functionality, restoration, or value.
Catalog descriptions, condition reports, photographs, videos, estimates, labels, certificates, provenance statements, and any oral or written statements made by YaShawn Auction House are statements of opinion only and shall not be relied upon as statements of fact. Such information is provided for bidder convenience and does not constitute a warranty or guarantee.
Buyers are strongly encouraged to inspect property before bidding, request additional photographs or condition reports, and conduct their own independent research. The absence of a condition statement, or the absence of reference to defects, damage, restoration, repair, wear, or imperfections, does not imply that a lot is free from faults.
By placing a bid, the buyer acknowledges that they have had the opportunity to inspect the property, request additional information, and satisfy themselves as to the condition, authenticity, attribution, and value of the lot. Failure to inspect the property or failure to request additional information shall not constitute grounds for cancellation of the sale, refusal of payment, return of property, or any claim against YaShawn Auction House.
Special Disclaimer for Asian Art, Antiques and Collectible Property
Due to the complex nature of authentication in Asian art, Chinese works of art, antiques, collectibles, decorative objects, paintings, calligraphy, bronzes, ceramics, jade, coins, paper currency, sculptures, religious objects, jewelry, watches, autographs, memorabilia, and related collectible property, all catalog descriptions and attributions regarding artist, maker, dynasty, period, origin, age, material, provenance, or authenticity represent the opinion of the cataloger based on information available at the time of cataloging.
Differences of scholarly opinion, expert opinion, market opinion, or later research are common in these categories. YaShawn Auction House does not guarantee authorship, age, origin, period, dynasty, maker, material, provenance, completeness, or authenticity of such property.
Any certificate, appraisal, provenance document, letter, label, receipt, prior auction record, or third-party statement accompanying a lot may be provided by the consignor or prior owner and is presented as received for bidder review. Unless expressly stated otherwise in writing, YaShawn Auction House has not independently verified such documents and does not warrant their accuracy.
By bidding, the buyer acknowledges that no return, refund, cancellation, or rescission will be accepted based on authenticity disputes, attribution disputes, differences of expert opinion, third-party opinions, later changes in scholarship, or dissatisfaction with the property after the sale.
Estimates
Pre-sale estimates are intended only as a general guide for prospective bidders. Estimates do not represent a guarantee of value, market price, resale value, or final selling price. Lots may sell above, below, or within the estimated range.
YaShawn Auction House reserves the right to revise estimates at any time before the auction.
Reserves
Some lots may be subject to a confidential reserve price, which is the minimum price agreed upon by YaShawn Auction House and the consignor. YaShawn Auction House may bid on behalf of the consignor up to the reserve price, where permitted by law and platform rules.
If the reserve is not met, the lot may be passed, withdrawn, or made available for post-auction sale at the discretion of YaShawn Auction House and the consignor.
Payment
YaShawn Auction House accepts payment methods as stated on the invoice or applicable bidding platform. Accepted payment methods may include cash, personal check, certified check, bank wire transfer, PayPal, debit card, and major credit cards, including Visa, MasterCard, American Express, and Discover.
All payments must be made in United States Dollars (USD).
A processing fee may apply to credit card, debit card, PayPal, or other electronic payments. Unless otherwise stated on the invoice, a processing fee of four percent (4%) may apply to U.S. debit or credit card payments, and a transaction fee of four and one-half percent (4.5%) may apply to international card payments outside the United States.
Domestic wire transfers may incur a $30 bank processing fee. International wire transfers may incur a $50 bank processing fee. The buyer is responsible for all bank fees, intermediary bank charges, exchange fees, or payment processing charges associated with the transaction.
Checks must be payable to the legal entity or payee listed on the invoice. Property will not be released until full payment has been received and cleared.
Payment Deadline and Default
All invoices must be paid in full within seven (7) days after receipt of the invoice, and no later than 5:00 PM on the seventh day. Invoices are normally issued within two (2) business days after the auction.
Failure by the buyer to make full payment within the required time period shall constitute a breach of contract.
If the buyer refuses to pay, fails to complete payment, initiates an improper payment dispute, or otherwise defaults on the purchase, the buyer shall be liable for liquidated damages equal to one-third (1/3) of the hammer price. The buyer agrees that this amount represents a reasonable estimate of damages resulting from such breach, including administrative burden, lost opportunity, consignor damages, relisting costs, platform consequences, and market risk.
YaShawn Auction House may retain any deposit or partial payment already received as part of such liquidated damages.
In addition to the liquidated damages, YaShawn Auction House reserves the right to cancel the sale, reoffer the property at public auction or private sale, and hold the defaulting buyer responsible for any deficiency, losses, administrative costs, storage charges, shipping charges, platform fees, collection costs, and reasonable attorney's fees incurred as a result of the buyer's failure to complete payment.
If payment remains unpaid after fourteen (14) days, YaShawn Auction House may report the buyer to the applicable bidding platform, suspend the buyer from future bidding, pursue collection, or refer the account to legal counsel or a professional collection agency.
Title Transfer
Title to the property transfers to the buyer only after YaShawn Auction House has received full and cleared payment of the purchase price, buyer's premium, applicable taxes, shipping charges, storage charges, processing fees, and all other applicable charges.
YaShawn Auction House reserves the right to retain possession of the property until all funds have fully cleared. Lots paid by check, draft, or bank transfer will be released only after bank clearance.
Possession, shipment, or delivery of a lot before full clearance of funds does not waive YaShawn Auction House's rights or remedies.
Risk of Loss
Risk of loss or damage passes to the buyer upon the fall of the hammer, the closing of the lot, or confirmation of the successful bid by the auction platform.
YaShawn Auction House is not responsible for loss, damage, theft, deterioration, breakage, or changes in condition occurring after the sale. Buyers are responsible for arranging appropriate insurance for purchased property.
Shipping
YaShawn Auction House may assist buyers with packing and shipping arrangements as a courtesy. Any shipping service provided by YaShawn Auction House is not part of the auction sale contract and is offered only as an accommodation to the buyer.
Shipping quotes may be provided only after the invoice is issued and, in some cases, only after full payment for the purchased property has been received. Buyers are responsible for all packing, handling, shipping, insurance, materials, and related costs.
Due to the volume of items sold, preparation for shipment may take up to three (3) weeks after full payment has been received. Large, fragile, oversized, high-value, framed, glass, stone, ceramic, or international shipments may require additional time.
YaShawn Auction House may, at its discretion, decline to ship certain items in-house and require the buyer to use a third-party shipper. Buyers may also be required to sign a shipping release or authorization form for certain fragile, oversized, or high-risk items.
YaShawn Auction House is not responsible for delays, loss, or damage caused by carriers, third-party shippers, customs authorities, weather, incorrect addresses, unpaid shipping invoices, or buyer delay in providing shipping instructions.
Collection and Storage
All purchased property must be collected, picked up, or have shipping arrangements made within forty-five (45) days after the auction unless otherwise agreed in writing by YaShawn Auction House.
Items remaining after forty-five (45) days may incur a storage fee of $10 per day per lot. Storage fees must be paid before the property is released.
If purchased property remains uncollected, unpaid for shipping, or otherwise undelivered after forty-five (45) days, YaShawn Auction House may, at its discretion, treat the property as abandoned. YaShawn Auction House may reauction, resell, dispose of, store, or otherwise handle the property in order to recover costs, storage fees, administrative expenses, and other charges. The buyer shall not be entitled to any refund or claim arising from such action.
If storage charges exceed the purchase price or value of the item, YaShawn Auction House reserves the right to reauction or dispose of the property to recover costs.
Import, Export and Restricted Materials
Certain items may be subject to import, export, wildlife, cultural property, endangered species, customs, or other governmental regulations. It is the buyer's sole responsibility to determine whether any item can be legally imported, exported, shipped, or possessed in the buyer's jurisdiction.
The buyer is solely responsible for obtaining all necessary permits, licenses, certificates, customs clearance, and government approvals. Failure or delay in obtaining such permits or approvals does not constitute grounds for cancellation of the sale, delay of payment, refusal of payment, or return of the property.
YaShawn Auction House makes no representation or warranty that any item may be legally imported, exported, or shipped to any particular country or state.
Limitation of Liability
In no event shall the liability of YaShawn Auction House, its owners, members, officers, employees, agents, representatives, affiliates, or consignors exceed the purchase price actually paid by the buyer for the lot in question.
YaShawn Auction House shall not be liable for incidental, consequential, indirect, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of opportunity, loss of use, emotional distress, shipping delays, customs delays, or diminution in value.
Copyright and Intellectual Property
YaShawn Auction House retains all rights to photographs, videos, catalog descriptions, condition reports, written materials, marketing materials, and other content relating to property offered for sale.
Such materials may not be copied, reproduced, distributed, published, modified, or used for commercial purposes without prior written consent from YaShawn Auction House.
The purchase of a lot does not transfer copyright, reproduction rights, trademark rights, publicity rights, or any other intellectual property rights unless expressly stated in writing.
Chargeback and Payment Dispute Protection
By bidding in the auction, the buyer agrees not to initiate credit card chargebacks, PayPal disputes, bank reversals, or other payment disputes relating to condition, authenticity, attribution, shipping delays, buyer's remorse, failure to inspect, or dissatisfaction with the purchased property.
Any dispute must first be addressed directly with YaShawn Auction House in writing. Buyers initiating chargebacks or payment disputes without first attempting resolution may be subject to legal action, recovery of administrative costs, payment processing fees, collection costs, reasonable attorney's fees, and permanent suspension from future bidding.
If a chargeback or payment dispute is initiated, YaShawn Auction House reserves the right to treat the buyer as in default and pursue all remedies available under these Terms and applicable law.
Consignor Protection and Agency Relationship
YaShawn Auction House acts solely as agent for the consignor unless otherwise stated. The consignor is the seller of the property, and YaShawn Auction House facilitates the sale as auctioneer or agent.
Any claims relating to property purchased shall be limited to the amount paid for the lot and shall be subject to the limitations and disclaimers stated in these Terms.
Buyers agree to indemnify, defend, and hold harmless YaShawn Auction House, its owners, officers, employees, agents, representatives, affiliates, and consignors from any claims, damages, losses, liabilities, costs, or expenses arising from the buyer's breach of these Terms, failure to pay, improper chargeback, improper import or export, or misuse of purchased property.

Bidders using online platforms are also subject to the terms and conditions of those platforms. In the event of a conflict between platform terms and YaShawn Auction House's Terms, YaShawn Auction House's Terms shall govern the relationship between the buyer and YaShawn Auction House to the fullest extent permitted by law.
Private Sale and Post-Auction Offers
For selected items, YaShawn Auction House may accept offers to purchase property outright either before or after the auction. Any private sale, post-auction sale, or accepted offer is subject to these Terms and Conditions unless otherwise agreed in writing.
YaShawn Auction House reserves the right to accept, reject, negotiate, or decline any offer at its sole discretion and subject to consignor approval where applicable.
Withdrawal of Lots and Cancellation
YaShawn Auction House reserves the right to withdraw any lot before or during the auction for any reason. YaShawn Auction House may also cancel a sale if there is an error in the listing, title, description, reserve, estimate, platform data, consignor instruction, legal status, ownership issue, or any other matter affecting the sale.
If a sale is cancelled by YaShawn Auction House, the buyer's sole remedy shall be the refund of any amount actually paid for the cancelled lot.
Errors and Omissions
YaShawn Auction House makes reasonable efforts to provide accurate descriptions, photographs, measurements, and information. However, errors may occur. YaShawn Auction House reserves the right to correct any errors, omissions, or inaccuracies at any time.
Measurements, weights, dates, materials, and descriptions are approximate and should not be relied upon as exact statements of fact.
Governing Law and Jurisdiction
YaShawn Auction House is a Massachusetts-formed company registered to conduct business in Maryland. These Terms and Conditions, and any auction conducted from or through YaShawn Auction House's Maryland operations, shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
Any dispute arising from or relating to the auction, purchase, payment, property, shipping, storage, collection, or these Terms and Conditions shall be brought exclusively in the state or federal courts located in Maryland, unless YaShawn Auction House elects another venue permitted by law.
The buyer consents to personal jurisdiction in such courts and waives any objection based on lack of personal jurisdiction, improper venue, or inconvenient forum to the fullest extent permitted by law.
Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Amendments
YaShawn Auction House reserves the right to amend, modify, supplement, or update these Terms and Conditions at any time. Any such changes may be posted in the auction listing, announced before or during the auction, or included in written notices to bidders.
By continuing to bid, the bidder agrees to be bound by the Terms and Conditions in effect at the time of bidding.
