Terms and Conditions of Auction

1. Please read our terms and instructions before placing a bid. We do not negotiate once a lot is sold.

2. All items are sold 'as-is,' meaning they are in the condition they are in at the time of sale. All items are shipped in-house. The buyer's premium is 27% for all bids submitted through this Auctionmobility.com bidding portal. We charge 3.3% on all credit and debit card payments. By placing a bid, you accept our terms and confirm that you have read, understood, and abide by those terms.

3. This is a live auction. If you have questions, please contact us before the auction! We provide additional images upon request up to 72 hours before the live auction. We cannot respond to photo requests made 24 hours or less before the auction or answer questions during the auction.

4. This auction is conducted under the laws of the State of Maryland. All lots are sold as-is, where-is. The property described in this catalog, as amended by any posted notices or oral announcements during the sale, will be sold by Fairhill Auction LLC as an agent for various owners (the consignors). All property is sold 'as is,' and neither Fairhill Auction LLC nor the consignor makes any warranties or representations of any kind concerning the property or its value, and in no event shall they be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property, or estimate of value. No statement (oral or written) in the catalog, at the sale, or elsewhere shall be deemed such a warranty, representation, or any assumption of responsibility.

5. The total buyer's premium for all bids submitted through this portal, provided by Auctionmobility.com, is 27% and will be added to your final invoice. Our in-house buyer's premium is 25%, and Auctionmobility.com charges an additional 2% fee for providing their service when placing a bid. Those fees are itemized separately on your invoice.

A 3.3% processing fee is added to all invoices paid by credit card or debit card.
We accept payment by cash, check, or money order to avoid card processing fees.

Invoices over $2,000 must be paid by check or bank transfer. The buyer pays all originating bank transfer fees plus a $20 incoming wire fee.
The minimum invoice amount for wire transfers is $600.

6. The Auctioneer, as the ultimate authority in determining the final hammer price, reserves the right to reject any bid for any reason before or during the auction. In the event of clerking errors, third-party bidding platform errors, miscommunication, technical malfunctions, or any other errors, the auctioneer reserves the right to withdraw the lot after the hammer falls. The auctioneer is the ultimate authority in determining the final hammer price.

7. The Auctioneer reserves the right to withdraw any lot for any reason at any time.

8. Our auctions are offered simultaneously on multiple proxy bidding sites. We also provide direct absentee with Fairhill Auction LLC. In the event of duplicate high bids, the earliest bid received will be the winner, as determined by the auctioneer's bidding records. Only absentee bids submitted through our website at Fairhillauction.com, or directly by phone or email, that we confirm will be treated as early absentee bids and tracked by time and date stamps. Don't hesitate to contact us before bidding if you need clarification or have further questions.

9. All lots carry a hidden reserve. If bids on a lot do not meet the reserve, the lot will not be sold unless the auctioneer lowers the reserve and sells it below the reserve. The auctioneer decides to sell a lot under the reserve. Reserves and maximum bids will not be disclosed. You may see a current high bid on Fairhillauction.com; this is only current information for Fairhillauction.com and does not include competing bids from proxy bidding sites or absentee bids received directly by Fairhill Auction LLC. The auctioneer will announce the current bid status when a lot is opened for live bidding. The auctioneer may bid on any lot on behalf of the consignor up to the reserve or retract a bid if the auctioneer cuts the reserve on behalf of the consignor.

10. All lots are sold as-is, where-is, unless otherwise stated in the lot description. If you have questions, please email us at bid@fairhillauction.com before bidding. We are not responsible for typographical or photo errors in the description and catalog; descriptions are provided as a courtesy. All descriptions and photographs are personal opinions and not statements of fact. By participating in the auction and placing a bid, you acknowledge that you are satisfied with the item and have thoroughly inspected it.

11. All items are in used condition unless stated otherwise. That means that they are not in brand-new condition. They may have signs of use, damage not described, or hard-to-see damage. Items housed in frames have not been examined outside of the frames. Lots may have defects or damage that are not visible due to framing, matting, or other obstructions.

12. Posters and paper ephemera were created using inexpensive materials and were not intended to last more than a few days, weeks, or months, let alone a hundred years or survive a war. Posters often show signs of use and handling, including pinholes, stains, or spotting. Old paper is often sunned or foxed; chipping and tearing are possible on all items. Some posters may have loss, folds, tears, waving, dampness stains, or any other signs not mentioned here or in the description. Many posters can be restored and repaired. Not every poster is linen-backed, but we usually mention it in the description. None of the damage is grounds for a return. Ask before you bid if you have condition questions.

13. Fairhill Auction LLC will not be responsible for premiums paid, shipping costs, appraisal fees, authentication fees, testing, or any other post-auction costs. Under no circumstances will the auctioneer be responsible for lost profits or other financial damages. We do not refund shipping charges, buyer premiums, fees, payment fees, or any other charges not mentioned here.

14. All items are shipped with a signature required upon delivery when available for the shipment method. If USPS, UPS, DHL, or FEDEX has proof of signature on file and marked a package as delivered to the final recipient, their contractual agreement has been fulfilled. None of the services will accept disputes or issue refunds, regardless of whether you paid for insurance. The carriers decide this. We are not responsible if a package is recorded as delivered and has proof of signature. Our responsibility ends when the carrier has picked up a package.

15. All items are shipped in-house. We ship with USPS, UPS, FedEx, and DHL. We pick the least expensive and safest option, which includes signature confirmation when available. We do ship internationally. Actual shipping charges, labor, and materials are added to your invoice. You may ship using your FedEx account or another service, but we will charge for labor and materials. Please inquire about the applicable fees. Orders are shipped as quickly as possible after we receive your payment, but not every package can be shipped immediately. An order may take up to 10 days to ship from our facility after payment.

All packages will be insured for the hammer price only unless requested otherwise. You may inquire with us for the complete insurance terms. Packages require a signature upon delivery.

We carefully package every item you purchase, which takes time. We are not responsible for any damage caused by reckless handling or opening of packages. If you destroy a poster because you tear the wrapping open, we cannot held accountable. Please inspect your box and packing material to ensure the completeness of your order. If you discard or burn packaging materials before reviewing the items you received, we cannot assist you.

If you have a special request, please contact us before shipping. It is the recipient's responsibility to communicate any requested changes to the shipment to us.

We do not contact you before a package is shipped.

International shipping is expensive, and we comply with the duty and tax rules of the US and the receiving country.

The volumetric dimension and destination determine shipping charges. If you would like a quote before placing a bid, please email bid@fairhillauction.com with the lot number and your complete shipping address.

We elect to ship via USPS, UPS, DHL, FedEx Ground, and FedEx Express for domestic and international shipments, based on our assessment of the most efficient method.

16. Any lot containing three or more items is not subject to return for any reason.

17. Dimensions provided in the description are approximate.

18. We don't sell frames or framing glass; the condition of the frame or the glass, including broken glass occurring during transport, is not a reason for a return or insurance claim.

Shipping costs for framed items or glass may vary significantly based on the frame's size and/or weight, and in some cases, these charges may exceed the hammer price plus the buyer's premium. Customers may request that we remove items from their frame to reduce shipping charges. We will accommodate customers for an additional charge of $10.00 per framed item. Please note that Fairhil Auction LLC will undertake such service at our sole discretion and only after full payment. Fairhill Auction LLC will exercise care in removing items from frames, but this is done ENTIRELY at the risk of the buyer, and the buyer fully indemnifies Fairhill Auction LLC for any damage that may occur as a result of any attempt by us to remove the item from a frame, mat, glass, etc.

19. Photographs of lots may have been adjusted for size, color, brightness, or contrast for display purposes only. Due to variations in external device color calibration, we cannot guarantee that the colors of lots displayed online match those of the items sold.

20. Estimated prices are only suggestions. Actual selling prices may be higher or lower than our estimates.

21. Placing a bid is a legal contract; you agree to purchase the lot at your highest bid, plus the buyer's premium and any associated charges, fees, and premiums. Please think before you bid! Fairhill Auction LLC cannot remove or cancel your bid.

22. The winning bid will always be one increment over the second-highest bid. Bidders may call us at 443-222-8240 during office hours, Monday through Friday, 10 A.M. - 5 P.M. EST. Live bidding: Bids entered during the sale by bidders on the floor, on the phone, or online will be accepted at the bid amount.

23. All winners will receive an invoice within 2-3 days from Fairhill Auction LLC by email after completing the auction, and the results are reconciled.

Please check your email and junk mail before calling.

Your email will include your invoice as a PDF and a secure credit card payment link. Please use the link to complete your payment. If you wish to pay by check, money order, or cash to avoid the card processing fee, please contact us for the discounted amount due.

It is the bidder's responsibility to follow up and pay promptly.

We may automatically charge the credit card on file at the time of registration, three days after invoices are issued. Please note that the credit card processor will deduct a non-refundable fee for requested refunds.

Payment is due immediately upon receipt of your invoice from Fairhill Auction LLC.

Maryland residents and any items picked up in Maryland are subject to 6% Maryland sales tax unless a resale number is on file with us before the auction.

Fairhill Auction LLC reserves the right to cancel invoices not paid within 10 days and will file a dispute if we don't hear from you.

Transfer of property only takes effect after payment, not by being the highest bidder.

Note: PayPal is NOT an option for payment.

24. Property purchased and paid for by successful bidders but remaining unclaimed after 90 days will be deemed abandoned, and the buyer will cede to Fairhill Auction LLC unless you make arrangements with Fairhill Auction LLC to hold items!

25. Although Fairhill Auction LLC has taken careful precautions in preparing this catalog, we assume no responsibility for omissions or errors. The absence of a condition statement does not imply that an item is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. Any condition statement is a courtesy; it is only a personal opinion and should not be considered a statement or fact.

26. By registering and/or placing a bid in our auction, you confirm that you have read, accept, and abide by our terms. By accepting these terms, you request and grant Fairhill Auction LLC implied and unconditional permission to send you emails now and in the future and to contact you by email now and in the future, in accordance with American, Canadian, and European regulations. You may contact us at any time to be removed from our mailing list.

FIREARMS:
• All firearms, including antiques, will be processed and shipped through our FFL partner in Delaware, in strict accordance with all Federal, State, and local laws. Be sure to check your state and local laws before bidding. If you are unable to import, purchase, or own a firearm according to your residency laws, do not bid on these items. If you bid and later learn that you cannot legally own/accept delivery, the bid remains a valid contract, and the buyer must pay. No exceptions. There are no pick-ups at Fairhill Auction in Maryland. All firearms are sold on behalf of estates and are not located in Maryland.

• We do not sell or export firearms outside the United States.

• If you are denied by an FBI / PICS background check, you will not be able to take possession of the firearm, and the firearm will be consigned to the next available firearm auction. You remain responsible for the hammer price, buyer’s premium, and any handling fees. Fairhill Auction will not cancel the sale for any reason. If you appeal against a decision, we will hold the firearm only if you pay in full.

• Any firearms being shipped are legally required to be shipped to a BATF licensed FFL dealer within your state of residence for transfer and pickup. You are responsible for all shipping and transfer costs incurred. Transfer, shipping, and handling fees for all handguns are $75 for the first and $35 for the second; fees and shipping for rifles are approximately $75, but may vary based on size, length, and weight, as with any other item we sell.

• IT IS THE BUYER’S RESPONSIBILITY TO CONTACT THEIR RECEIVING FFL AND ARRANGE TRANSFER AND FFL REMITTANCE. Upon receipt of the invoice, the buyer must confirm the FFL validity and the ship-to address listed on the invoice. The receiving dealer must submit a current copy of their FFL for each auction invoice to federalfirearm@rocketmail.com, with the paid invoice number and buyer name noted in the subject line.

• Long guns are only sold to persons 18 years of age or older. Handguns will be sold only to individuals 21 years of age or older.

• Since all firearms sold are ‘collectible’ items, Fairhill Auction does not test the safety or warrant functionality of these firearms. All firearm purchases should be examined by a certified gunsmith prior to shooting.

• DISASSEMBLY: Firearms, auction items, and accessories may be disassembled for shipping. This may include scopes, cases, barrels, and stocks.

• AMMUNITION: Ammunition does not ship with an associated gun. Separate charges apply to ammunition shipments and may incur additional fees based on weight or size.

• Fairhill Auction reserves the right to deny the sale of a firearm to any buyer.

GOODS MADE FROM OR CONTAINING MATERIALS FROM PROTECTED SPECIES:

• Fairhill Auction does not accept any responsibility or liability for the sale of items containing materials from protected species or for any omission in marking or labeling goods as containing materials from protected species. All items offered for sale are sold on behalf of estates and considered antiques and may or may not have CITES documentation as provided by the seller. It shall be the potential buyer's sole responsibility to research and satisfy the requirements of any laws and regulations that apply to the import and export of property as described. We do not sell these items outside the United States. Fairhill Auction cannot assist the buyer in obtaining appropriate licenses and/or certificates, and there is no assurance that an export license or certificate can be obtained. The inability or delay in obtaining permits, licenses, or other permissions to import or export goods containing these materials will not constitute a basis for rescission or cancellation of the sale of said goods or the delay in payment of purchased items in accordance with these Bidder Terms and Conditions.
