Terms and Conditions – Nikki’s Naks Auctions

1. Registration and Bidding

Eligibility: All bidders must register before placing bids. Registration requires accurate contact and payment information. Bidders must be at least 18 years old.

Bidder Responsibility: Placing a bid constitutes a binding contract. Bidders are responsible for reviewing item descriptions and ensuring they have the funds to complete their purchase.

Auctioneer’s Discretion: Nikki’s Naks reserves the right to:

Reject or refuse bids at its discretion.

Withdraw or re-offer any item before or during the auction.

Determine bidding increments.

Resolve bidding disputes, including re-offering a disputed lot.

2. Payment Terms

Buyer's Premium: An 15% buyer’s premium will be added to the final bid price unless otherwise stated.

Sales Tax: A 6% Michigan sales tax applies to all applicable purchases unless the buyer provides a valid tax-exempt certificate.

Accepted Payment Methods:

Cash

Credit/debit cards (3% processing fee applies to card payments) ( A shipping charge will be added if you would like shipping. )

All payments must be made in full within 24 hours of the auction closing.

3. Item Descriptions and Condition

All Sales Final: All items are sold "AS IS – WHERE IS" with no warranties, expressed or implied.

Inspection Period: Buyers are encouraged to inspect items before bidding. Nikki’s Naks is not responsible for item descriptions provided by third parties.

4. Item Pickup and Shipping

Pickup Dates & Times: All items must be picked up on:

Saturday, March 29th, from 10:00 AM – 4:00 PM

Sunday, March 30th, from 10:00 AM – 4:00 PM

Large Items Furniture Pick Up preferred times are Sat/Sun 4:00-5:00PM

Pickup Location: Address will be provided to winning bidders after the auction closes.

Failure to Pick Up: Items not picked up by the final pickup day will be considered forfeited, and no refunds will be issued, unless otherwise specified by Nicole.

Shipping: Available on select items at the buyer’s expense. Buyers must confirm shipping availability before bidding. A second charge will be charged to buyer for shipping expenses. The heavier the package the more shipping will be.

5. Disputes and Cancellations

Bidding Errors: Bidders are responsible for their own bids. Nikki’s Naks is not liable for accidental or mistaken bids.

Non-Payment Consequences: Failure to pay within the allotted timeframe may result in:

Bidding restrictions on future auctions.

Legal action to recover outstanding balances.

Auction Cancellation: Nikki’s Naks reserves the right to cancel or reschedule auctions due to unforeseen circumstances.

6. Governing Law and Disputes

Jurisdiction: This agreement is governed by the laws of Michigan.

Arbitration Clause: Any disputes shall be settled through binding arbitration in Ypsilanti, Michigan.

7. Changes to Terms and Conditions

Nikki’s Naks reserves the right to update or modify these Terms and Conditions at any time without prior notice.
