Terms and Conditions
By participating in this Auction, you ("Bidder") agree to the following terms and conditions. Please read them carefully before placing a bid.
1. Eligibility to Participate
The auction is open to individuals, businesses, contractors, and organizations capable of fulfilling the payment and pickup requirements. All Bidders must be at least 18 years of age. Bidders must create an account through the auction platform.
2. Bidding Process
All bids placed during the auction are legally binding and cannot be retracted or canceled. Bids are placed incrementally, and the highest bid at the auction's close wins the item. The Auctioneer or Auction Site may reject or remove bids deemed suspicious, fraudulent, or in violation of these terms. In the event of a technical issue, the Auctioneer reserves the right to extend or pause bidding.
3. Item Descriptions and Conditions
All items are sold AS-IS and WHERE-IS, with no warranties, guarantees, or returns offered. We do not guarantee the value, condition, or authenticity of any item. It is the sole responsibility of you, the buyer, to judge the value, condition, and authenticity of merchandise and bid accordingly. Descriptions and photographs of items are provided for informational purposes only. It is our intention to give an accurate description to the best of our knowledge and note any defects we may be aware of. However, the auctioneer makes no guarantee or warranty, expressed or implied, as to the accuracy of the information given on any merchandise found in the catalog. It is the Bidder’s responsibility to inspect items during any scheduled viewing periods, when available. Used items may not meet current codes or regulations and are sold without any certification. We do not guarantee authenticity of any signature. All measurements are approximated.
4. Appointments
Appointments need to be made with and confirmed by Mills Gregory Agent at info@millsgregory.com or by calling 763-383-4776. Appointments will not be made for Saturdays or Sundays. If prospect does not show up 10 minutes after agreed upon time, viewing, inspection, or pickup of item may not be possible unless another appointment is made.
5. Payment Terms
Winning bidders must pay the total purchase price, including applicable taxes and fees, within 2 business days of the auction’s close or at time of pickup whichever is earlier. Invoices will be sent out to winners with amounts through Square. We do NOT charge Hibid’s online credit cards. Accepted payment methods include Cash, Credit Card (Amex, Visa, MasterCard, Discover), Cashier’s Check, or Money Orders. Personal checks will not be accepted. Credit cards will be processed through Square prior to pick-up or at pick-up. Late payments may incur penalties or result in forfeiture of the winning bid. Payment not provided at pickup will result in forfeiture of the item(s).
6. Pickup and Removal of Items
Winning bidders are responsible for arranging the pickup with adequate help for loading or shipping of purchased items.

Mills Gregory does not offer shipping services. For items to be released to a shipper, a copy of the invoice for the items purchased with proof of payment and insurance is required. Buyer must provide to us written statement requesting items to be released accompanied by valid identification.
Items must be picked up no later than deadline specified with auction at the location specified by the Auctioneer. Any items not picked up by the deadline may incur daily storage fees or be considered abandoned, with no refund provided if pre-paid. Payment not provided at pickup with result in forfeiture of the item(s). Bidders must bring their own tools, labor, and transportation for disassembly and removal of items. Shipping service is NOT provided.
7. Taxes and Fees
All purchases are subject to state and local taxes where and when applicable. A buyer’s premium of 18% will be applied to the final bid amount.
8. Auctioneer’s Rights
The Auctioneer reserves the right to modify, postpone, extend, or cancel the auction at any time. Items may be added, withdrawn, or combined at the Auctioneer’s discretion without prior notice.
9. Limitation of Liability
The Auctioneer and platform are not liable for technical malfunctions, system errors, or interruptions that may impact bidding. The Auctioneer is not responsible for any loss, damage, or injury caused during the transportation or use of purchased items.
10. Dispute Resolution
All sales are final. Any disputes must be submitted in writing to info@millsgregory.com within 3 days of the auction’s close. The Auctioneer’s decision in resolving disputes is final and binding.
11. Privacy and Data Use
The Auctioneer will collect and use personal information solely for registration, payment processing, and auction-related communication.
