DECANTER AUCTION TERMS AND CONDITIONS
Agreement to Terms: By registering for or bidding in this auction, the bidder acknowledges that they have read, understood, and agreed to these auction terms and conditions.
Buyer?s Premium: A 20% buyer?s premium will be added to the final hammer price of each lot.
Sales Tax: Applicable sales tax will be charged unless the buyer has provided a valid resale certificate or other legally recognized exemption before invoicing.
Binding Bids: All bids are final and binding. The highest bidder acknowledged by the auction platform or auctioneer is the purchaser.
Payment Deadline: Full payment is due within one day of the auction.
Current Contact Information: Buyers are responsible for maintaining a current email address and telephone number on their auction account.
Communication: Auction-related questions and arrangements should be made by email so that all instructions and agreements are properly documented.
Sold As Is: All items are sold as is, where is, with no warranties or guarantees expressed or implied.
Bidder Inspection: Buyers are responsible for examining all photographs, descriptions, measurements, condition information, and other available information before bidding.
Photographs: Photographs are considered part of the lot description. Buyers should review every photograph carefully for the exact appearance, size, contents, box status, seal status, and condition of each item.
Condition Statements: Condition statements represent the auction house?s good-faith opinion and are provided as a courtesy. They are not a guarantee that every flaw, repair, alteration, missing component, or sign of age has been identified.
Measurements: Measurements are approximate unless specifically stated otherwise. Buyers should rely on the photographs and information provided for each individual lot.
Age and Wear: Vintage and antique items may exhibit age-related wear, discoloration, crazing, staining, residue, fading, label wear, cork deterioration, tax-strip wear, surface loss, manufacturing irregularities, or other imperfections consistent with age.
No Returns: All sales are final. No returns, refunds, exchanges, or bid cancellations will be accepted based on condition, age, size, color, odor, contents, shipping expense, or a buyer?s failure to review the photographs and description.
Estimates: Auction estimates are opinions only and are not guarantees of value or final selling price.
Risk of Loss: Once a lot has been sold, responsibility for the purchased property belongs to the buyer, subject to the auction house?s reasonable care while the property remains in its possession.
Decorative Decanters: Hatman Auctions is selling decorative and collectible decanters. Any liquid contents remaining inside a decanter are incidental to the sale of the decorative container.
Legal Compliance: The buyer acknowledges that they are acting in compliance with all applicable federal, state, and local laws concerning the purchase, possession, transportation, delivery, and receipt of spirituous liquor.
Buyer Responsibility: It is solely the buyer?s responsibility to determine whether they may legally purchase, possess, transport, receive, or arrange delivery of a sealed or liquid-containing decanter in their jurisdiction.
Age Requirement: Buyers purchasing sealed or liquid-containing decanters must be of legal drinking age and legally eligible to possess the item in their jurisdiction. A valid U.S. Driver?s License will be required on pickup - no alternate ID?s and no exceptions.
Sealed Decanters: Decanters identified as seal intact are pickup only by appointment and will not be shipped.
Empty Decanters: Empty decanters may be eligible for shipping unless the individual lot is identified as pickup only or is too large, fragile, heavy, or otherwise unsuitable for ordinary shipment.
Pickup Location: Pickup will be in Thayer, Missouri, by appointment only.
Pickup Hours: Regular pickup is available Monday through Friday from 8:30 a.m. until 3:30 p.m.
Advance Notice: Buyers must provide at least 24 hours? notice before arriving for pickup.
Pickup Arrangements: Buyers may pick up their purchases personally or designate a third party to pick up or deliver the property on their behalf, and a 21 year old US valid Driver?s license will be required by the person picking up regardless of who purchased at the auction.
Third-Party Pickup: The buyer is responsible for authorizing the designated person or company and providing the auction house with the necessary pickup information.
Storage: Hatman Auctions can store purchased property indefinitely when arrangements have been made with the auction house.
Delivery Route: Delivery MAY be available for an additional fee along scheduled routes to St. Louis, Chicago, Green Bay, Michigan?s Upper Peninsula, the west side of Michigan, and western Indiana.
Delivery Arrangements: Route delivery is available only by advance arrangement and on established delivery dates and is not guaranteed to be available. Buyers must email Hatman Auctions before the auction if route delivery will affect their decision to bid.
Delivery Fees: Delivery charges are separate from the purchase price, buyer?s premium, sales tax, packing charges, and other applicable expenses.
Delivery Dates: Delivery routes operate on firm scheduled dates. Buyers must be available or make arrangements for someone to accept delivery at the agreed location and time.
In-House Shipping: Our streamlined in-house shipping is available, shipping charges are calculated only after the items have been pulled, packed, measured, and weighed.
Separate Shipping Invoice: In-house packing and shipping charges may be billed separately from the original auction invoice.
Carrier Selection: Hatman Auctions may select the carrier and service based on the package?s weight, dimensions, value, fragility, and destination.
Oversized Items: Oversized or unusually heavy items may be shipped by UPS or another appropriate carrier at the buyer?s expense, delivered by prior arrangement, or held for pickup.
Shipping Time: Shipping and packing may take up to three weeks following the auction and receipt of payment.
Shipping Costs: The buyer is responsible for all packing, handling, insurance, carrier, delivery, and related shipping charges.
Shipping Damage: Carrier claims are governed by the rules and procedures of the selected carrier or LiveShipping provider. Buyers must retain all packaging and documentation required for a claim.
Unshippable Property: If an item cannot be shipped legally or safely, the buyer remains responsible for payment and must arrange pickup or designate an eligible third party to retrieve the property.
Failure to Pick Up: Failure to pick up an item does not cancel the sale or relieve the buyer of payment, storage, delivery, or other obligations.
Auction-House Discretion: Hatman Auctions reserves the right to withdraw a lot before it is sold, reject a bid, resolve a bidding dispute, combine or divide lots, or correct clerical and cataloging errors when necessary.
Platform Issues: Hatman Auctions is not responsible for internet outages, delayed bids, missed bids, software failures, platform errors, or other technical problems outside the auction house?s direct control, and reserves the right to edit or cancel bids post auction if there is a technical glitch or clerical mistake.
Governing Terms: Any special instructions appearing in an individual lot listing apply to that particular lot and take precedence over conflicting general shipping or pickup provisions.
Auctioneer?s Decision: The auctioneer?s decision regarding bidding, lot disposition, and auction procedure is final.
