• Valid payment information is required to bid or list, and the buyer must be authorized to use the card and keep it current. Each bid is binding; the winning bidder must pay and arrange pickup, shipping, or delivery. Invoices under $5,000 are charged in full to the primary card; invoices over $5,000 are charged a 10% deposit, with the balance due before release. An 18% buyer’s premium and 7% sales tax apply. Bid retractions are not permitted within three (3) hours of auction close. Failed or overdue payment may result in suspension or revocation of bidding privileges, collection efforts, and lawful late fees.
2. Pickup, Holds & Forfeiture
• Winning bidders must collect purchases during the scheduled window unless approved shipping or delivery arrangements are made. Buyers must provide their own tools and labor for large or heavy items, including items on stairs, in basements, or in outbuildings. Contact Caring Transitions before pickup if an alternative time is needed; approval is not guaranteed, and pickup of items outside the studio carries a $50 fee. Studio lots not collected on the designated day incur a $10 storage fee after seven (7) days from the original pickup date; items left for seven (7) days without buyer communication are forfeited without refund. Unpaid or uncollected purchases may be resold or donated. These deadlines and fees do not apply while Caring Transitions is holding a firearm solely for a legally required transfer or background check; firearm releases remain subject to the terms below.
3. Shipping
• Shipping is available only for lots marked “Available for Shipping.” “Pickup Only” items require arrangements with Caring Transitions of Greater Omaha before the auction closes. Standard packing and handling fees depend on the size and number of boxes; carrier charges are separate. Items needing professional packing may be identified for third-party service through the local UPS Store, with the buyer coordinating and paying UPS directly for packing, shipping, insurance, and related services. Shipping costs may exceed the winning bid, and buyers are responsible for all applicable packing, handling, insurance, transfer, and shipping charges. Failure to meet shipping requirements may result in forfeiture without refund, subject to the Firearm-Specific Terms & Conditions; firearms also require the shipping and FFL procedures below.
4. Item Condition
• Caring Transitions strives to describe items accurately, but used, vintage, and antique goods may show normal wear and not every flaw is listed. All items are sold “AS IS, WHERE IS,” without warranties or returns. Working order is not guaranteed for clocks, watches, electronics, mechanical devices, or firearms, and dimensions may be approximate. Firearms are also governed by the condition and mechanical-safety provisions below.
5. Auction Close
• Auctions use a soft close. If a bid is placed in the final minutes, the ending time will extend briefly to allow additional bids, simulating a live auction.
FIREARM-SPECIFIC TERMS & CONDITIONS
These terms apply to all firearms offered in this auction and are in addition to the general Terms & Conditions above. By placing a bid on a firearm, the bidder acknowledges and agrees to these terms.
6. FFL & Applicable Law
• Firearm transfers are conducted through our Federal Firearms License (FFL) and will be completed in accordance with applicable federal, state, and local laws and regulations.
• No firearm will be released or shipped when the transfer would be unlawful.
7. Buyer Eligibility & Responsibility
• By bidding on a firearm, the bidder represents that they are legally eligible to purchase, receive, possess, and own the firearm.
• It is the bidder’s responsibility to determine BEFORE BIDDING whether the firearm and any included magazines or other regulated components may legally be purchased, transferred, received, and possessed in the bidder’s jurisdiction.
• Caring Transitions of Greater Omaha does not guarantee that a firearm offered in this auction is legal for a particular bidder or jurisdiction.
• IF YOU ARE NOT LEGALLY ELIGIBLE TO RECEIVE THE FIREARM, DO NOT BID.
8. Form 4473 & Background Check
• Firearm transfers to nonlicensed individuals will be completed in accordance with applicable federal and state requirements, including ATF Form 4473 and a NICS background check when required.
• A winning bid does not guarantee that the buyer will be legally eligible to take possession of the firearm.
• No firearm will be released until all legally required transfer requirements have been satisfied.
9. Buyer of Record / No Substitution
• The firearm will be transferred only to the lawful transferee/buyer completing the required firearm transfer documentation.
• If a winning bidder is denied or otherwise legally ineligible to receive the firearm, another individual may not be substituted for that buyer for the purpose of completing the transaction.
10. In-Person Transfers
• Nebraska residents may take possession of firearms at our licensed premises after satisfying all applicable transfer requirements.
• A qualifying rifle or shotgun may be transferred in person to a nonresident when the transaction is permitted by federal law and complies with applicable laws of both Nebraska and the buyer’s state of residence.
• Handguns and other firearms that cannot lawfully be transferred directly to an out-of-state buyer must be transferred through an appropriately licensed FFL in the buyer’s state of residence.
11. Shipped Firearms
• Firearms requiring shipment will be shipped only to an appropriately licensed Federal Firearms Licensee (FFL), except where otherwise permitted by law.
• The buyer is responsible for locating a receiving FFL and arranging for that dealer to provide us with a current copy of its license and any information we require to complete and document the transfer.
• The buyer is responsible for all applicable packing, shipping, insurance, receiving-dealer transfer fees, and other associated charges.
• No firearm will be shipped until payment has been received in full and all required FFL information has been received and verified.
12. NICS Delay
• A NICS “Delayed” response is not a denial.
• If a firearm transfer is delayed, Caring Transitions will retain possession of the firearm until the firearm may lawfully be transferred under applicable law and our FFL procedures.
• The ordinary auction pickup deadline and storage/alternative-pickup fees will not apply solely because a firearm is being held pending the required background-check process.
13. NICS Denial / Buyer Ineligibility
• If a winning bidder receives a final NICS denial or is otherwise legally ineligible to receive the firearm, the firearm WILL NOT be transferred to that buyer.
• The buyer’s inability to complete the legally required firearm transfer does not constitute cancellation of the transaction without charge.
• In such circumstances, the hammer price of the firearm will be refunded. The 18% buyer’s premium and any transfer, processing, shipping, handling, return-shipping, storage, or other actual costs already incurred are non-refundable.
• The firearm will remain in the possession of Caring Transitions of Greater Omaha and may be offered for resale.
• If the buyer is pursuing a formal challenge or appeal of a denial, the buyer must notify Caring Transitions promptly. Caring Transitions may hold the firearm for a reasonable period while the matter is pending, subject to applicable law and our FFL procedures.
14. Firearm Condition & Mechanical Safety
• All firearms are sold AS-IS, WHERE-IS.
• No warranties or guarantees, express or implied, are made regarding condition, functionality, accuracy, safety, merchantability, or fitness for any particular purpose.
• Unless expressly stated otherwise in the individual lot description, firearms have been visually inspected for identification and cataloging purposes only and have NOT been test-fired or mechanically function-tested.
• Any statement concerning condition is based upon visual observation and should not be interpreted as a representation that the firearm is safe, functional, accurate, or suitable for firing.
• ALL FIREARMS SHOULD BE INSPECTED BY A QUALIFIED GUNSMITH BEFORE LOADING, FIRING, OR USE.
15. Firearm Identification & Catalog Information
• We make reasonable efforts to accurately identify and describe each firearm.
• Manufacturer, model, caliber/gauge, serial number, markings, configuration, approximate age, condition, and other information are provided to the best of our ability based upon available markings, records, visual inspection, and research.
• Bidders are responsible for reviewing the complete lot description and all photographs before bidding. Photographs are considered part of the lot description.
• Any discrepancy or question regarding identification, configuration, condition, or description should be raised BEFORE BIDDING.
16. Magazines & Jurisdictional Restrictions
• Firearms and included magazines or components will not be shipped or transferred into jurisdictions where their transfer or possession is prohibited.
• Caring Transitions will not modify a firearm, alter magazine capacity, substitute components, or otherwise change an item in an attempt to make it compliant with a particular jurisdiction.
• If a firearm or included component cannot legally be transferred to you as offered, DO NOT BID.
17. Antique Firearms
• Any firearm specifically identified by Caring Transitions as an “Antique Firearm” will be handled according to applicable federal, state, and local law.
• The age, appearance, or use of black powder alone does not necessarily establish that a firearm is legally exempt from federal firearm transfer requirements.
18. Curio & Relic Firearms
• The age or collectible status of a firearm does not automatically make it eligible for transfer to a Type 03 Curio & Relic licensee.
• A C&R transfer will be permitted only when both the firearm and license qualify under applicable federal law and the license has been verified.
19. Secure Storage / Safety Devices
• An appropriate secure gun storage or safety device will be provided with the firearm at the time of transfer.
• This applies where required by law.
20. Final Transfer Determination
• Caring Transitions of Greater Omaha reserves the right to refuse, delay, or discontinue any firearm transfer when necessary to comply with federal, state, or local law, ATF requirements, or our obligations as a Federal Firearms Licensee.
• Payment for a firearm and a winning auction bid do not override firearm transfer laws. No firearm will be released when the transfer would be unlawful.

The Terms & Conditions contain special information and requirements relating to firearm purchases, including background checks, regulatory fees and interstate transfer fees through FFL Dealers; review them before bidding.
