**AUCTION TERMS AND CONDITIONS**

This Agreement shall govern participation in any auction conducted by Sunrise Antiques & Auctioneers (hereafter "Auctioneer"). By registering to bid, the Bidder agrees to be bound by all terms and conditions stated herein.

(PLEASE NOTE THAT YOU ARE RESPONSIBLE FOR PROVIDING US A FFL LICENSE IF YOU NEED SHIPPING. WE CAN NOT QUERY YOUR FFL ON YOUR BEHALF)

**1. General Terms**
All items are sold "as is, where is," without warranty or guarantee of any kind. No returns, refunds, or exchanges will be permitted. Bidders are strongly encouraged to attend previews or contact Auctioneer with any questions before bidding. Auctioneer guarantees only the make, model, caliber, and serial number of firearms offered. Auctioneer makes no warranties as to functionality, safety, or condition.

Descriptions of items may be generated or supplemented using artificial intelligence and other automated tools. While we strive for accuracy, these descriptions are not guaranteed and may not always reflect the true condition, specifications, or history of the item. Buyers must rely on their own inspection and judgment prior to bidding.

**2. Payment**
All lots must be paid in full within the designated timeframe following the close of auction. Acceptable forms of payment for in-person pickup include cash, check, and major credit cards, wire transfer or zelle. Online purchases may be paid via credit card, zelle or wire transfer only. A 20% buyer?s premium shall be added to the final hammer price of each lot.

Failure to pay invoices within three (3) business days will result in the card on file being charged automatically. When shipping guns only you will receive two invoices. You will receive an invoice from auctionflex for the firearms purchased. Invoices for firearm shipments will be issued through Shipping Saint.
Invoices for all other items will be issued by the selected third-party shipper.

**3. Taxes**
All sales are subject to 6.625% New Jersey sales tax unless a valid resale/exemption certificate is provided. Auctioneer has no discretion over how LiveAuctioneers assesses and collects tax.

**4. Firearm Sales and Transfers**
Firearms sales are subject to strict compliance with all federal and state laws. New Jersey does not recognize Curio and Relic (C\&R) licenses. All handguns, black powder firearms, and air guns must be transferred through a licensed FFL dealer, regardless of age or classification. Antique long guns (manufactured in or before 1898) may ship directly to out-of-state buyers if compliant.

For all NJ FID card holders, NICS checks will be conducted 29 July - 1 August from 10AM - 4PM.? We will send out a scheduler so that you can block a time for the paperwork and NICs.

All New Jersey firearm purchasers must present a valid NJ Firearms ID card (FID), driver?s license, and applicable permits. A $50 fee will be assessed for all NICS background checks conducted in New Jersey.

Firearms will not be shipped without a valid copy of the receiving FFL license. Buyers are solely responsible for providing FFL information. Send licenses to ffl@sunrise-antiques.com.

**5. Ammunition and Prohibited Items**
There is no shipping available for black powder. All handgun ammunition must be picked up in person by New Jersey residents with valid NJ FID cards. All handgun ammunition will ship to a valid FFL for transfer. All other ammunition may be shipped direct vai a 3d party shipper. No exceptions.

**6. Shipping and Pickup**
Firearms will be packed and shipped in-house using UPS only. Shipping costs are the responsibility of the buyer. A packing fee of $25 per long gun and $10 per handgun will apply. Auctioneer is not responsible for delays or costs imposed by carriers.

For non-firearm items, shipping must be coordinated directly by the buyer through one of the following third-party providers. We can not act on your behalf:

Auctioneer does not communicate with or arrange services with third-party shippers on behalf of buyers.

Pickup for all non-firearm lots must be completed on **Sunday, July 27th, 2025, from 10:00 AM ? 4:00 PM only.** Items not picked up or shipped by **5:00 PM, July 27th, 2025**, will be deemed abandoned and forfeited without refund.

**7. Vehicle Titles**
All vehicle titles will be released only after full payment has cleared.

**8. Errors and Omissions**
All lots are subject to error or omission. Auctioneer will not be held responsible for discrepancies.

**9. Governing Law**
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, specifically Burlington County.
