Buyer?s Premium: A 28% buyer?s premium will be added to the hammer price of each lot. Empire Auctioneers pays all LiveAuctioneers fees directly. B. Payment Methods: Payment accepted via wire transfer, personal check, money order, cashier?s check, or credit card (Visa, Mastercard, Amex) for purchases up to $20,000. Purchases over $20,000 require wire transfer only. Any returned checks incur a $25 fee; if not cleared after a second attempt, the purchaser will be liable for all related fees and storage costs until full payment is received. C. Tax: NJ sales tax (6.625%) applies unless valid exemption provided. 2. As-Is Sale; Condition: All items are sold as is. Empire Auctioneers makes no guarantees or warranties, express or implied, about the authenticity, age, condition, value, or quality of any lot. Item descriptions, appraisals, and photographs are for reference only. Minor imperfections or wear may not be listed, but will be visible in photos. Appraisals are for insurance only and may not reflect true market value. Inspection is the bidder?s responsibility; Empire Auctioneers is not responsible for discrepancies between reports and the actual item. 3. Dispute Resolution; Chargebacks: A. Binding Jurisdiction: By bidding, you consent to the jurisdiction of the courts in Elmwood Park, New Jersey. New Jersey law governs all disputes. B. Sole Dispute Method; Waiver of Chargebacks: The exclusive method for resolving any dispute is as described herein. By bidding, you irrevocably waive any right to file a chargeback or payment dispute with your bank, credit card, or any third party. Initiating a chargeback or payment dispute is a direct violation of these terms and will incur a minimum $300 administrative fee, plus all hourly legal costs and damages. C. Confession of Judgment for Fraud: If you violate these dispute provisions, you agree to immediately confess judgment for fraud in favor of Empire Auctioneers, and to pay all damages, costs, and attorney?s fees incurred. 4. Shipping: Free shipping within the U.S. on orders over $1,000; international free shipping over $2,000. Purchases below these amounts, or any taxes/duties, are the buyer?s responsibility. Empire Auctioneers is not liable for shipping delays or loss/damage after delivery to carrier, but all items are fully insured until delivery. 5. Reserves, Acceptance, and Liability: Empire Auctioneers reserves the right to accept or reject any bid. Lots may carry reserves set by the consignor; the auctioneer may bid to protect a reserve. Empire Auctioneers assumes no liability for errors in condition reports, catalog descriptions, photographs, or omissions. In the event of fire, theft, or similar loss, liability is limited solely to the amount paid for the item. 6.
