Terms and Conditions for Estate Sale:
1. Agreement to Terms: By participating in the estate sale as a buyer, you agree to adhere to the following terms and conditions.

2. Sale Format: The estate sale will follow a predetermined format wherein items will be offered for sale on an "as-is" basis. Buyers are responsible for inspecting the items thoroughly before making a purchase. Subsequently; all sales are final.

3. Pricing: All items will be priced as marked, and the prices are negotiable. Buyers are expected to pay the listed price for each item they wish to purchase. However, Luxe Estate Liquidators reserves the right to offer deals & incentives during the sale period or offer additional discounts wherever applicable at their sole discretion.

4. Payment: Buyers must pay for their purchases in full at the time of sale. Cash is the only accepted form of payment. Any purchase made greater than $1,000.00 may be paid in the form of a certified check or personal check and items purchased will not be permitted to leave the premises until the check supplied has been cleared by the bank first.

5. Sales Tax: Applicable sales tax will be added to the total purchase price of each item, as required by law.

6. Hold and Reserve Policy: We do not hold or reserve any items for buyers. Items will be sold on a first-come, first-served basis.

7. Removal of Purchased Items: Buyers are responsible for removing their purchased items from the premises. It is recommended to bring appropriate transportation and necessary assistance for large or heavy items. Additionally, Luxe Estate Liquidator employees will be on premises and available for hire to assist in the removal of items from the residence or provide end to end delivery services for an additional fee.

8. Item Condition and No Returns: All items are sold in their current condition, and no returns or exchanges will be accepted. Buyers are responsible for assessing the condition of items before making a purchase.

9. Liability and Safety: The estate sale organizers and property owners are not responsible for any accidents, injuries, or damage that may occur during the sale. Buyers agree to enter the premises at their own risk.

10. Dispute Resolution: In the event of any disputes between buyers and estate sale organizers, both parties agree to resolve the matter in accordance with applicable laws.

11. Changes and Cancellations: The estate sale organizers reserve the right to make changes to the terms and conditions, sale dates, or cancel the sale at their discretion. Any changes or cancellations will be communicated through appropriate channels.

IMPORTANT LEGAL NOTICE—READ BEFORE SIGNING

THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS. BY SIGNING IT, YOU ACKNOWLEDGE SPECIFIC HAZARDS, ASSUME CERTAIN RISKS, RELEASE CERTAIN CLAIMS—INCLUDING CLAIMS INVOLVING ORDINARY NEGLIGENCE TO THE MAXIMUM EXTENT PERMITTED BY NEW JERSEY LAW—AND AGREE NOT TO SUE ON CLAIMS THAT ARE VALIDLY RELEASED. DO NOT SIGN UNLESS YOU HAVE READ AND UNDERSTAND THE ENTIRE AGREEMENT.

1. Parties covered by this agreement

For purposes of this agreement, the “Released Parties” are:

- Luxe Estate Liquidators LLC;
- Their respective members, managers, owners, officers, employees, agents, representatives, contractors, volunteers, successors, assigns, and insurers, but only to the extent each may legally receive the protections contained in this agreement.

The “Event Premises” include all portions of the property at 448 Adelphia Road connected with the estate sale, including its entrances, exits, parking and pedestrian approaches, field, tents, walkways, barn, barn entrances and stairs, storage-container area, any storage container specifically opened to visitors, loading areas, pickup areas, and any other area through which I am permitted to pass.

Signing this agreement does not give me permission to enter any closed, restricted, barricaded, unmarked, staff-only, upper-level, storage, machinery, or private area.

2. Adult-only agreement and condition of entry

I certify that I am at least eighteen years old, legally competent, and signing for myself. This agreement may not be signed on behalf of a minor.

I understand that signing this agreement is a condition of receiving revocable permission to enter the controlled Event Premises. Luxe Estate Liquidators LLC or the property owner may deny or revoke my permission to enter or remain for safety, capacity, weather, conduct, rule violations, closure, or any other lawful reason.

3. Nature of the premises and specific hazards

I understand that this estate sale is being conducted at a rural property containing a two-story barn, outdoor field, temporary tents, storage containers, stored merchandise, architectural materials, furniture, and loading activity. These are not ordinary modern retail-store conditions.

I understand that known, reasonably foreseeable, or changing hazards may include:

- Uneven, unimproved, soft, muddy, wet, icy, slippery, loose, sloped, or unstable ground;
- Holes, depressions, ruts, roots, rocks, gravel, vegetation, curbs, thresholds, cords, stakes, ropes, tent anchors, and other trip hazards;
- Steps, ramps, door sills, irregular flooring, worn surfaces, narrow walkways, low ceilings, low beams, and restricted clearances;
- Limited, uneven, temporary, changing, or absent electric lighting;
- Dust, pollen, dirt, mold, mildew, odors, insects, splinters, rust, nails, screws, sharp edges, broken glass, exposed hardware, and protruding objects;
- Heavy, awkward, oversized, antique, fragile, stacked, leaning, suspended, or potentially unstable merchandise;
- Falling, shifting, tipping, breaking, crushing, pinching, lifting, carrying, and strain hazards;
- Storage-container doors, metal surfaces, limited clearances, temperature changes, restricted visibility, and objects that may have shifted during storage;
- Temporary tents, tables, displays, racks, ropes, poles, weights, and merchandise affected by wind or weather;
- Vehicles, trucks, trailers, dollies, carts, equipment, professional movers, customer loading, backing vehicles, and active pickup operations;
- Crowds, lines, other customers, children or companions, and the acts or omissions of other visitors;
- Rain, wind, heat, cold, lightning, falling branches, and other natural or weather-related conditions; and
- Other obvious, concealed, temporary, or changing conditions typical of a barn, field, storage-container area, estate sale, and active loading site.

I understand that the foregoing list is illustrative and cannot identify every possible condition or risk.

4. Visitor safety obligations

While on the Event Premises, I agree that I will:

1. Follow all staff instructions, signs, barriers, cones, ropes, and marked pedestrian routes;
2. Remain only in areas affirmatively opened to visitors;
3. Not enter the barn’s upper level, any closed container, staff area, loading zone, or restricted area unless specifically authorized and escorted;
4. Not climb ladders, shelving, furniture, beams, displays, containers, vehicles, or merchandise;
5. Not move, lift, pull, carry, open, test, operate, or disassemble heavy or oversized merchandise without express staff permission and adequate assistance;
6. Keep clear of movers, vehicles, equipment, loading operations, and merchandise being repositioned;
7. Wear footwear and clothing reasonably appropriate for unimproved outdoor terrain and a barn environment;
8. Not smoke, use an open flame, run, engage in horseplay, or enter while impaired by alcohol, cannabis, medication, or another substance;
9. Immediately avoid and report any condition I believe may be dangerous;
10. Immediately report any accident, injury, property damage, or near miss to Luxe Estate Liquidators LLC before leaving, when reasonably possible; and
11. Leave immediately if directed by Luxe Estate Liquidators LLC, the property owner, security personnel, or emergency personnel.

5. Voluntary entry and assumption of risk

My entry is voluntary. I am free not to enter and may ask questions before signing.

With knowledge of the conditions described above, I voluntarily assume the risks inherent in or reasonably associated with entering, walking through, inspecting merchandise at, purchasing from, loading at, or otherwise being present on the Event Premises. These risks include falls, cuts, punctures, allergic or respiratory reactions, strains, sprains, fractures, head injuries, property damage, serious bodily injury, illness, permanent disability, and death.

I assume those risks whether they are presently known or unknown to me, obvious or not obvious, except to the extent New Jersey law does not permit a particular risk or legal duty to be transferred or waived.

6. Limited release of liability—including ordinary negligence

TO THE MAXIMUM EXTENT PERMITTED BY NEW JERSEY LAW, I release and discharge the Released Parties from claims belonging to me for bodily injury, illness, death, property damage, or other loss arising from my voluntary presence or activities on the Event Premises, including a claim caused in whole or in part by the ordinary negligence of a Released Party.

This release applies only to claims that New Jersey law permits me to release in advance.

THIS AGREEMENT DOES NOT RELEASE OR WAIVE LIABILITY FOR GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL OR WANTON MISCONDUCT, INTENTIONAL MISCONDUCT, FRAUD, A VIOLATION OF A NONWAIVABLE STATUTORY OR REGULATORY DUTY, OR ANY OTHER CLAIM THAT CANNOT LAWFULLY BE WAIVED.

This agreement releases only my own claims to the extent legally permissible. It does not purport to release an independent claim belonging to a person who did not sign it.

7. Limited covenant not to sue

To the maximum extent permitted by New Jersey law, I agree not to commence or maintain a lawsuit or claim against a Released Party concerning a claim validly released under Section 6.

This covenant applies only to the lawful scope of the release. It does not prevent the assertion of any claim that New Jersey law prohibits me from releasing or waiving.

8. Emergency services and medical expenses

If staff reasonably believes that I require emergency assistance, I authorize Luxe Estate Liquidators LLC, the property owner, or their representatives to contact 911, police, fire, emergency medical services, an ambulance, or another emergency provider on my behalf.

I understand that the Released Parties do not control the treatment, transportation, billing, or decisions of independent emergency responders or medical providers.

To the extent permitted by law, I accept personal financial responsibility for ambulance, emergency-response, hospital, physician, medication, transportation, and other medical charges provided to me and billed to me or my insurer. I understand that this provision does not transfer or eliminate legal responsibility that cannot lawfully be transferred or eliminated.

9. Responsibility for my conduct and limited indemnification

I am responsible for injury, loss, or damage caused by my own negligent, reckless, intentional, or unauthorized conduct; my violation of event rules; or the conduct of a mover, contractor, companion, or other person I personally bring onto the Event Premises.

To the maximum extent permitted by law, I agree to indemnify the Released Parties against third-party claims and property damage caused by such conduct. I do not agree to indemnify a Released Party for that Released Party’s own independent gross negligence, recklessness, intentional conduct, or other nonwaivable liability.

10. Revocable permission, refusal to sign, and removal from property

I understand and agree that:

- If I refuse to sign, I do not have permission to enter the controlled Event Premises;
- If I enter without authorization or my permission is revoked, I must leave immediately upon being directed to do so;
- Luxe Estate Liquidators LLC, the property owner, or an authorized representative may communicate that revocation orally or in writing; and
- If I knowingly remain after receiving actual notice that I must leave, law enforcement may be contacted, and my conduct may be addressed under applicable New Jersey trespass law.

Nothing in this agreement declares that I have committed a criminal offense; that determination belongs to law enforcement and the courts.

11. New Jersey law, severability, and complete agreement

This agreement is governed by New Jersey law. Any proceeding concerning this agreement shall be brought in a court of competent jurisdiction, subject to otherwise applicable law.

If any provision is held unlawful or unenforceable, that provision shall be severed or narrowed to the maximum lawful extent, and the remaining provisions shall remain effective.

This agreement contains the entire agreement regarding the subjects it covers. I am not relying on an oral promise that contradicts this document. No staff member may orally modify it.

12. Final acknowledgment

By signing below, I certify that:

- I have read every page of this agreement;
- I understand that it affects important legal rights;
- I was given sufficient time to read it and an opportunity to ask questions;
- I understand that I may decline to sign and not enter;
- I understand the hazards and safety rules described above;
- I am signing voluntarily and without coercion;
- I am at least eighteen years old; and
- The identifying information I provide below is accurate.
