Participation in any auction held by Willow Auction House, whether in person, by phone, via absentee bid or by way of a Live Internet platform such as Willow Auction House website, HiBid, Liveauctioneers, Invaluable, Bidspirit or Bidsquare requires the acceptance of our terms of sale, participation therefore constitutes acceptance of all terms listed on this page, failure to read these terms does not release the bidder from the rules and requirements set forward in these terms.

ALL BIDDERS ARE SUBJECT TO THE FOLLOWING TERMS OF SALE:

CONDITION REPORTS
Willow Auction House has endeavored to accurately describe all items being sold, but all property herein offered for sale is strictly "as is", and it is the bidder's responsibility, whether bidding in person, by mail, by e-mail or by telephone to determine the exact condition of each item. No statement in the catalog, bill of sale, invoice, or elsewhere by a representative of, or person in employ of Willow Auction House shall be deemed to be a warranty, representation, or assumption of liability with respect to age, condition, size, quality, variety, importance, provenance of historical relevance of any of these items. Items listed in the catalog are for reference use only, description of items are no guarantee to the exact condition and / or age of any described item in the catalog, we strongly recommend viewing the items in person as everyone's opinion regarding "condition" can vary.

Private viewings and previews can also be arranged to accommodate bidders, contact us for more information.

REGISTRATION
All bidders are required to register and give full identification prior to the beginning of the auction and are required to use the number issued to them when identifying themselves as the successful bidder. Bidders that sign up on the Internet platform less than 30 minutes before the start of the sale may not be approved. Any bidder with limited or no history of bidding on the Internet platform might not be approved. Bidders without prior history will have to call Willow Auction House to register and submit credit card information.
The Auctioneer reserves the right to withdraw any property prior to auction. This is a privately owned & operated sale, and we reserve the right to refuse admittance to any person and reserve the right to decline any online bidder. No transfer will be recognized from one buyer to another. In-house buyer's premium with Willow Auction House is 25% via absentee bidding and 28% via phone. All internet sales using the Internet platform are subject to a flat 28% buyer's premium. The Bidder hereby indemnifies and holds harmless auctioneer & seller from all damages, claims, or liabilities from injuries to persons or property of any type whatsoever, caused before, during, or after the auction.

WINNING BIDDERS
The auctioneer will be the final judge as to which bidder is the highest bidder. In the event of any dispute in this matter, the auctioneer shall, at his or her discretion, decide whether to reopen the bidding. Title to all merchandise shall pass to the highest bidder at the fall of the auctioneer's "hammer". The purchaser shall assume full risk and responsibility for the lot purchased once the title has passed.

PAYMENT
All items purchased must be paid for within 7 days from the date of sale. Payment is expected in full, no payment plan or other arrangements will be made. If you are a successful bidder, please contact Willow Auction House, if you have not yet been contacted by Willow Auction House, the day after the sale from 11 am - 4 pm to confirm auction details and payment method. Payment methods accepted are cash, credit cards (Visa, MasterCard, Amex and Discover) Wire Transfer, Venmo, Zelle, PayPal, cashier's check, or check (property will not be released until check clears).

A dispute will be filed after that period if payment has not been made. Once a dispute is filed, claims for unpaid items are void and Willow Auction House will have full title & claim to these items to resell them at auction. In the event of a filed dispute the bidder will have 7 days to contact Willow Auction House and arrange payment of winning bids before the dispute becomes permanent and the items re-offered.

Negative feedback will be left for unpaid lots 10 days after the auction date. All sales are final, no exceptions.
All invoices totaling over $1,500.00 MUST be paid via cash, wire transfer, Zelle, Venmo, or Money Order.

PLEASE NOTE that wire transfers may be subject to bank fees, please add an additional $25 to payment to cover these fees, contact us before you arrange wire transfers to confirm applicable bank fees.
Shipping of any gold, silver or other precious metal or stone items valued at $500 or more will be held for 45 days from the payment date if paid via credit card, or PayPal. If you would like to avoid this hold, please make payment with cash, cashier's check, wire transfer, Venmo, or Zelle.

SALES TAX
All sales are subject to Sales tax unless a tax resale certificate is on file with the auction house and/or bidding platform to be tax exempt. If you have any questions or need further information, please contact Willow Auction House.

SHIPPING AND PICK UP POLICY
Willow Auction House packs and ships select items in house, please see shipping details for more information. The buyer is responsible for ALL packing & shipping charges.
IF YOU REQUIRE A SHIPPING ESTIMATE PRIOR TO PACKING YOUR ITEM(S), PLEASE RESPOND TO THIS EMAIL WITH YOUR REQUEST OR EMAIL SHIPPING@WILLOWAUCTIONHOUSE.COM.? IF YOU REQUEST SHIPPING, AND?YOU CHANGE YOUR MIND AFTER YOUR ITEM HAS BEEN PACKED AND YOUR INVOICE HAS BEEN SENT,?YOU WILL BE CHARGED FOR PACKING AND MATERIALS.
Pick-ups are by appointment only and need to be scheduled. Willow Auction House must be notified in writing if anyone other than the winning bidder is picking up the lot. When picking up, please note the Warehouse location says "All Wrapped Up" with a green awning. Please make sure to bring ALL necessary packing supplies, paper, and boxes to pack your winning items. Please also bring enough manpower to be able to lift and remove your winning items. A loading dock is available. Please call our offices at 862-895-5700 to confirm pick-up hours, as they are subject to change without notice.
Please note: We require items to be picked up or shipped within 3 weeks from the auction date. Items not picked up or shipped within 3 weeks will incur a $10 a day storage fee per lot. Any items not shipped or picked up within 4 weeks from the auction will be considered forfeited and will become house property or be donated.

SHIPPING DETAILS
Invoice must be paid in full before requesting shipping information. Once the invoice is paid in full, shipping and pick up communications will be sent via our Shipping program, "Shipping Saint".

Small items will be shipped by USPS, FedEx, UPS, or a comparative service. We offer buyers of larger items (furniture, rugs, large artwork) our services if they are within our shipping limits. Larger items outside our shipping capacity, we will assist in securing a third-party shipper. Buyers are also welcome to use a shipper of their choice.

JEWELRY, GOLD, SILVER, OR OTHER PRECIOUS MATERIALS POLICY:
Any lots of jewelry, gold, silver, or other precious material purchased for $500 or more must be held for 45 days from payment date to avoid fraud. This is especially true for any items purchased for more than melted value. We offer a wire transfer or cash payment option, if the buyer wishes to receive the lot(s) sooner.

Behind the Curtain: The Tony Walton Collection includes more than 700 lots from the estate of theatre and film designer Tony Walton. Day three of this three day sale includes items from Walton's personal collection. A large collection of theatre posters and window cards, including many designed by Tony Walton, is among the highlights. Day three also includes original artwork, books, awards, and a large selection of Playbills from throughout Walton's career. A selection of tin litho and other toys rounds out day three. Willow Auction House is proud to present Behind the Curtain: The Tony Walton Collection. For more than 60 years, Tony Walton designed costumes and sets for some of Broadway?s most notable productions, including Chicago, Annie Get Your Gun, and Guys and Dolls. A Tony, Oscar and Emmy Award winner, he also worked on films such as All That Jazz and The Wiz, and designed for off-Broadway and regional theater productions, ballets and operas.
