1. Prior to a sale, all bidders must register with Juliet and Friends in person or online to participate in bidding.
2. In auctions, Juliet and Friends auction house offers properties for sale on behalf of our consignors, which may be unnamed. Juliet and Friends accept and fulfill biddings/orders acting as the consignors' agent. We do not make, endorse, or recommend any of the auction properties, we only sell auction properties on behalf of our consignors.
3. We do our best to provide accurate written descriptions and images of all auction items listed in our online catalogs through one or more digital platforms. Condition reports and additional photographs are provided upon request as a courtesy to our prospective bidders, such condition report is only an opinion and can be subjective. We do not warrant that such descriptions, condition reports, images or other information provided are accurate, complete or error-free. Before placing a bid, it is the responsibility of a prospective bidder to review all the information, arrange personal examination of any items of interest, acquire independent third-party evaluation or appraisal of an item if such an evaluation or appraisal is deemed important to a prospective bidder. All bidding is a purchase contract, voluntary and legally binding. A prospective bidder acknowledges that all auction items are sold on an 'as-is' basis and all sales are final, there will be no returns based on written or oral description of condition or age of an item, unless an item received is a completely different piece from the images displayed in the online catalog. Please refrain from bidding if a bidder does not agree with the terms of the auction house. Juliet and Friends refuse any negotiation relating to the condition or age of an item after the fall of the hammer.
4. For all in-house bidding and written absentee bidding, a premium of 22% of the hammer price will be added thereto and is payable by the purchaser as part of the total purchase price. Telephone bidding is available only for lots with estimated values above $1000 and 2% of service charge will be added to the hammer price for labor cost, thus a premium of 24% will be added to the hammer price for a lot won through telephone bidding. All online bidding through Liveauctioneers.com will have a premium of 27% added to the hammer price for a lot won.
5. All bids by New Jersey residents and all in-person pickups are subject to the New Jersey Sales Tax (6.625%) unless exempt by law. If exempt, you must present us with a valid certificate of formation of business, a resale certificate and relating documents.
6. The Auctioneer reserves the right to withdraw any property at any time before actual sale.
7. Some lots in an auction may have pre-authorized reserved prices by Juliet and Friends' consignors, a lot cannot be sold if the reserved price is not met, thus the lot will be passed and will be listed in an upcoming action if it is still available.
8. Unless otherwise announced by the Auctioneer at the time of sale, all bids are per lot as numbered in the catalog. The Auctioneer reserves the right to reject a bid from any bidder. The highest bid acknowledged by the Auctioneer shall be the purchaser. In the event of any dispute between bidders, the Auctioneer shall have the sole and final discretion either to determine the successful bidder or to re-offer and re-sell the article in dispute. If the Auctioneer determines that any opening bid is not commensurate with the value of the article offered, he may reject the bid; and if having acknowledged an opening bid he decides that any advance is not sufficient, he may reject the advance. The Auctioneer reserves the right to acknowledge an auction floor bid before acknowledging an internet and/or phone bid regardless of the maximum bid amount provided by the bidder before and/or during the auction.
9. On the fall of the Auctioneer's hammer, title to the offered lot passes to the highest bidder who thereupon will pay the full invoice or such part as the Auctioneer may require.
10. The Auctioneer reserves the right to cancel a sale or any portion thereof without prior or further notice, and to announce at any time additional conditions of sale.
11. Lots once shipped and tracking information shared to the winning bidders/receivers, Juliet and Friend will not be responsible for any damages that occurred during the shipping process, including any damages due to customs examinations and repacking, therefore full insurance for lots and shipping costs are strongly recommended.
12. Juliet and Friends reserves the right not to answer any item condition complaints after 48 hours of an item's delivery, simply because anything can happen to an item given it time. Juliet and Friends are nice and available to provide reasonable assistance to our bidders, we reserve the right to refuse to be abused.
13. For some unexpected situations, a transaction can be cancelled upon request after the winning bidder pays a cancellation penalty fee of 27% of the hammer price to compensate the time and labor cost of the auction house. In such a case, no nonpayment dispute will be filed against the bidder.
14. Juliet and Friends and its affiliates shall not be liable for any injuries, damages, or accidents resulting from the use or misuse of an item sold in our auctions. By purchasing and using the items, the buyers/winning bidders assume all responsibility for their use.
15. Any participation in bidding will constitute full acceptance of the terms and conditions herein.
