BUYER CONTRACT
Please be advised that by placing a bid, you are entering into a legally binding contract with Simmons Auction House (SAH). If you are the successful winning bidder, you have a legal obligation to purchase the item(s) won from SAH. Furthermore, a bidder acknowledges that proper and careful due diligence has been conducted prior to placing any bid, and that the bidder knowingly and willfully placed a legally binding bid. Any questions prior to bidding should be emailed to info@simmonsauctionhouse.com. Simmons Auction House reserves the right to withdraw or combine any lots listed in the auction at any time with no liability. Furthermore, Simmons Auction House reserves the right to cancel or replace an order post auction if (a) it does not successfully pass and meet our quality control standards prior to shipping, (b) is no longer available because our products may be offered simultaneously on multiple platforms, or (c) it was sold in error by our Auctioneer. In the event this occurs, SAH may provide the winning bidder with the same, similar or upgraded item at no additional charge to the bidder; or at SAH sole discretion, provide a refund. Winning bidders must pay for the entire invoice before the items are removed from our inventory or any other online platforms. Many items are consigned to Simmons Auction House and may be simultaneously offered for sale on multiple online platforms. If a listed item becomes unavailable, Simmons Auction House will attempt to remove the item from the auction on a best effort basis. Consequently, SAH may provide the winning bidder with the same or similar item at no additional charge to the winning bidder, or at Simmons Auction House sole discretion, provide a refund.


ITEM DESCRIPTIONS
We have tried to accurately describe every item. Condition and substantial defects are disclosed and/or photographed. While SAH will do its best to list any damage, repairs or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items SAH sells are antiques, vintage or used items. SAH and its employees are not a professional graders. Condition authenticity, and value are solely the opinion of SAH and its employees. You should expect signs of wear consistent with age. Accordingly, minor defects or smells may not be disclosed, which can be expected in pre-owned or vintage items. Please review images carefully as all items are SOLD AS IS. Keep in mind that on certain monitors, photos and light may depict slight color variations. Unless specified in the lot description, the item may not come with a box, papers, dust-bags, or authenticity card/certificate.

BUYER'S PREMIUM
A buyer premium of 25% will be added to the hammer price in all auctions and will be charged along with the hammer price and applicable sales tax to the credit or debit card you have on file within 24 hours of the auction end.

SALES TAX
All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale.


FORFEITURE OF ITEMS
Any items not paid for by the specified time in accordance with the SAH Terms & Conditions will be forfeited by the winning bidder. SAH requests all shipping invoices be paid within 48 hours of receipt. Failure to pay shipping cost within the above stated time can at SAH discretion result in forfeiture of the ability to ship, extra handling charge, storage fee, and or forfeiture of winning items.

Return Policy
All items are SOLD AS IS, with all disclosed faults. ALL SALES ARE FINAL. In the event an item description does not match the item received, SAH will provide a refund or exchange. Return or exchange requests may only be made within three (3) days from the date on which the winning bidder receives their items and must notify SAH of any discrepancies. SAH reserves the right to reject any returns or exchanges that do not comply with the requirements listed. All authorized returns must be received in the same condition as when they were originally shipped to the Customer, or they will be returned to the Customer at their cost. Any unauthorized returns will be discarded after 90 days and the winning bidder will relinquish any and all claims to these items. Refusal to accept merchandise delivered by SAH to the winning bidder constitutes an unauthorized return in direct violation of these Terms and Conditions.

PROHIBITED USE
You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adept, and edit from content any SAH material. Use of the content and materials for any purpose not expressly permitted in these Terms of Use is prohibited. SAH works with advertisers so you may not copy, frameset, enclose or otherwise distribute any part of SAH material without express consent. If any of the above issues really occur call SAH to work it out. Honestly this is for people who want to put items, and images on other auction sites with the assumption of winning but have not been closed yet.
