Official Terms and Conditions of Auction
By registering for, bidding in, or otherwise participating in this auction, whether conducted online or in person, all individuals and entities (hereinafter referred to as "Bidder") hereby irrevocably acknowledge and expressly agree to be bound by the following Terms and Conditions. These Terms and Conditions constitute a legally binding agreement between the Bidder and Royal Blue Trading LLC, acting as Auctioneer. Participation in this auction signifies the Bidder's full and unconditional acceptance of these provisions.
1. Condition of Items: "As Is, Where Is"
All items are offered and sold "AS IS, WHERE IS," with all faults and without any warranties, express or implied. The Auctioneer and Consignor make no representations or warranties whatsoever regarding the merchantability, fitness for a particular purpose, condition, authenticity, provenance, rarity, or any other characteristic of any item. While reasonable efforts are made to provide accurate descriptions, it remains the sole responsibility of the Bidder to conduct a thorough inspection and due diligence of all items prior to placing a bid. The Auctioneer shall not be held liable for any errors, omissions, or misrepresentations in item descriptions. The successful bid, upon acceptance by the Auctioneer, signifies the Bidder's full acceptance of the item's condition "as is."
2. Bidding and Contract Formation
Each bid placed by a Bidder constitutes an irrevocable offer to purchase the item at the stated price. The highest bid acknowledged by the Auctioneer shall, upon the fall of the gavel or the electronic confirmation of sale, establish the successful Bidder and create a binding contract of sale. In the event of any dispute concerning bidding, the Auctioneer shall have the sole and absolute discretion to determine the successful Bidder or to re-open bidding on the disputed item. The Auctioneer's decision in all bidding disputes is final and binding.
3. Payment Obligations
The successful Bidder is obligated to remit full payment for all purchased items immediately following the conclusion of the auction, or specifically within forty-eight (48) hours of receiving notification of winning bids. Payment must be rendered in United States Dollars (USD) via credit card (Visa, MasterCard, American Express - a 3% processing fee will apply to all credit card payments), bank wire transfer, or certified check. Personal checks are not accepted. Ownership of the purchased item(s) shall transfer to the Bidder only upon the Auctioneer's receipt of full, cleared funds. Failure to comply with these payment terms within the stipulated timeframe shall result in the forfeiture of the item(s) and may subject the Bidder to collection costs, legal fees, and any other remedies available to the Auctioneer at law or in equity, including, but not limited to, the right to resell the item(s) and pursue any deficiency from the defaulting Bidder.
4. Buyer's Premium
A Buyer's Premium of fifteen percent (15%) shall be added to the successful bid price of each item. This premium constitutes part of the total purchase price and is subject to all applicable taxes.
5. Sales Tax
All applicable sales taxes, as mandated by the State of Nevada, shall be added to the total purchase price, including the buyer's premium, unless the Bidder presents a valid and current resale certificate at the time of registration and prior to the close of the auction.
6. Item Removal and Shipping
All purchased items will be shipped exclusively through LiveAuctioneers Shipping. No local pickups or personal courier services will be permitted or entertained. Shipping arrangements will be initiated by the Auctioneer through the LiveAuctioneers Shipping service following receipt of full payment. The Bidder is responsible for all associated shipping, packing and handling, and insurance costs, which will be billed separately by LiveAuctioneers Shipping. The Auctioneer assumes no responsibility for any damage or loss incurred during transit once items have been transferred to LiveAuctioneers Shipping. The Auctioneer is not responsible for any loss or damage to items during transit
7. Auctioneer's Discretion
The Auctioneer reserves the unqualified right, in its sole and absolute discretion, to withdraw any item from the auction, to combine or divide lots, to establish bidding increments, to reject any bid, and to regulate the bidding process. The Auctioneer further reserves the right to postpone or cancel the auction at any time, for any reason, without prior notice.
8. Governing Law and Venue
These Terms and Conditions, and all transactions hereunder, shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms and Conditions or the auction shall be brought exclusively in the state or federal courts located in Clark County, Nevada.
9. Bidder Registration
All prospective Bidders must complete the registration process prior to placing any bids. This process requires the provision of valid identification and contact information. The Auctioneer reserves the right to refuse registration to any individual or entity at its sole discretion. By registering, the Bidder warrants that they are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract.
10. Online Bidding Disclaimer
The Auctioneer makes no warranty or guarantee regarding the continuous, uninterrupted, or error-free operation of the online bidding platform. Online bidding may be subject to technical interruptions, delays, or errors beyond the Auctioneer's control. The Auctioneer shall not be liable for any lost bids, missed opportunities, or damages resulting from technical issues affecting the online bidding system. Bidders are advised to place bids early and not to rely on last-minute bidding.
11. Indemnification
The Bidder agrees to indemnify, defend, and hold harmless the Auctioneer, its employees, agents, consignors, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including, without limitation, reasonable attorneys' fees and court costs) arising from or relating to the Bidder's participation in the auction, purchase of any item, or any breach of these Terms and Conditions by the Bidder.
12. Severability
Should any provision of these Terms and Conditions be determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
13. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Bidder and the Auctioneer concerning the auction and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral.
15. Bid Increments
Bids will be accepted in the following increments:
? Bids up to $50: $5.00 increments
? Bids from $51 to $200: $10.00 increments
? Bids from $201 to $500: $25.00 increments
? Bids from $501 to $1,000: $50.00 increments
? Bids over $1,000: $100.00 increments
