The 2nd Store – Auction Terms & Conditions
Prior to bidding, please review our terms and conditions in full. The 2nd Store requires each bidder, whether participating in person, by phone, by absentee bid, or through one of our online bidding platforms, to acknowledge and accept these terms and conditions of sale.
1. General Terms
All lots listed in catalogues are offered by The 2nd Store LLC, either as owner or as agent for consignor(s), subject to the following terms. BIDDING AT THIS AUCTION, WHETHER IN PERSON, BY AGENT, ABSENTEE, TELEPHONE, INTERNET OR ANY OTHER MEANS, CONSTITUTES ACCEPTANCE OF THESE TERMS.
All property is sold AS IS, WHERE IS, WITHOUT RECOURSE. Neither the consignor(s) nor The 2nd Store makes any representation or warranties, express or implied, regarding size, count, weight, style, authenticity, provenance, period, material, manufacturer, artist, origin, copyright, reproduction rights, or any other warranty unless expressly stated at the time of auction. Measurements and weights are recorded to the best of our abilities but neither the consignor(s) nor The 2nd Store can be held liable for any discrepancies. All ceramics is sold as is; every piece cannot be inspected for chips. The 2nd Store is not responsible for damage to glass, frames, coverings, or works of art regardless of cause. The authenticity of signatures will only be guaranteed if so stated at auction. Descriptions are not guaranteed and may contain typographical errors.
2. Catalogues & Previews
Catalog descriptions are provided as a guide only and The 2ND Store is not responsible for any mistakes or errors in the listing processes of any of the lots offered.
3. Finality of Sales
All sales are final. No returns, no exceptions. The 2nd Store is not responsible for internet bidding errors or electronic transmission issues.
4. Rights of the Auctioneer
The 2nd Store reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to bidding. The auctioneer may reject any bid and has full discretion to determine the successful bidder. In the case of a dispute, the auctioneer’s decision is final. Absentee and reserve bids may be executed on behalf of consignors.
5. Absentee Bidding
Absentee bids may be submitted in person, by phone, email, or mail. Credit card details must be on file to execute absentee bids. The 2nd Store is not responsible for errors or omissions in executing bids.
6. Buyer’s Premium
A Buyer’s Premium will be added to the hammer price of all lots listed on the sale.
7. Payment
Payment is due within 2 days of the auction. Accepted payment methods include:
Cash, check (payable to The 2nd Store LLC), money order, wire transfer.
Credit cards: Visa, MasterCard, Discover.
Payments must come from the invoiced party only. The 2nd Store reserves the right to decline payments from third parties.
Wire transfer instructions are available upon request. Domestic wire fees: $65. International wire fees: $75. Credit card payments by phone are accepted at our discretion up to $5,000, and only from U.S.-issued cards. Larger purchases may require payment by check, money order, or wire transfer. Goods may be held until funds clear.
Returned checks are subject to a $50 service fee.
8. Taxes
All purchases are subject to 8.875% New York State and local sales tax, unless:
(a) the buyer provides a valid resale certificate prior to purchase; or
(b) the lot is shipped out of New York State by a licensed shipper.
Out-of-state resale certificates are accepted, but forms must be fully completed and submitted prior to purchase.
9. Reserves
Certain lots may carry a confidential reserve price. Lots will not be sold below reserve. Reserve prices may be adjusted at any time including after a bid has been placed.
10. Removal & Storage
No lot may be removed until the full purchase price has been paid. All items must be collected on the noted pick up day of the auction. Items left beyond the pick up days are considered abandoned, with no refund issued. The 2nd Store is not responsible for loss or damage to items left on premises.
11. Shipping
The 2nd Store does not provide in-house shipping. All shipping arrangements and costs are the responsibility of the purchaser. A list of recommended shippers is available upon request. Packing and handling by The 2nd Store, if provided, is at the sole risk of the buyer.
12. International Buyers
Buyers are responsible for complying with import/export restrictions, including regulations concerning materials derived from endangered species (e.g., coral, ivory, tortoise shell).
13. Liability
If a purchased lot cannot be delivered in the condition it was sold, or if it is lost or stolen prior to delivery, or withdrawn for any reason, The 2nd Store’s liability is limited to the amount paid by the purchaser.
14. Claims
Any claims of misrepresentation must be made in writing within 14 days of the auction by the original purchaser only. After this period, no claims or refunds will be entertained.
15. Buyers must bring there own help to move heavy items.
16. The 2nd Store is not responsible for any accidents, damages, or injuries that may occur during the purchase, handling, or moving of items, or from the subsequent use of purchased items.
17. Governing Law
All invoices, transactions, and agreements are governed by the laws of the State of New York and subject to the jurisdiction of its courts.
