Auction Terms & Conditions ? Binding Agreement
By registering and participating in this auction, you agree to the following binding contract with Magen H Gallery. Please read carefully, as these terms govern your rights and obligations as a bidder and buyer.

General Terms
All items are stored at our warehouse: 491 Bergen St, Brooklyn, NY 11217.
All sales are final: Everything is sold AS IS, WHERE IS, without warranties or guarantees. We make every effort to provide accurate descriptions, but neither Magen H Gallery nor consignors make any representations regarding authenticity, condition, or provenance.
Condition Reports & Inquiries: We encourage buyers to request condition reports and additional photographs before bidding. If you have questions, ask before the auction, as bidding is a binding commitment.
Payment & Taxes
Accepted Payment Methods: VISA, Mastercard, or wire transfer (EFT). Payment is due within 3 days of the auction date.
Sales Tax: Purchases are subject to NYC sales tax (8.875%) unless a valid resale certificate is provided before payment. Items shipped out of state are not subject to local taxes.
No Early Release of Merchandise: Items will not be released before the auction session concludes. Magen H Gallery reserves the right to hold merchandise until full payment is received.
Shipping & Pickup
Buyer Responsible for ALL Shipping & Handling Costs and Arrangements: We strongly encourage buyers to obtain shipping estimates before bidding. Shipping costs are not related to the purchase price of an item.
Pickup Location: 491 Bergen St, Brooklyn, NY 11217.
Pickup Scheduling: All pickups must be scheduled in advance via auction@magenxxcentury.com.
Pickup Deadline: All lots must be picked up within 10 business days of the auction.
Storage & Abandonment Policy
Items not picked up within 10 business days will incur storage fees:
$5 per lot per day for items under $1,000.
$10 per lot per day for items valued at $1,000 or more.
Abandonment Clause: If no shipping or pickup arrangements are made within 30 days, the item will be considered abandoned. Magen H Gallery reserves the right to resell, donate, or dispose of the item, with no refund issued to the buyer.
Extensions: Buyers may request an extension in writing before the 30-day deadline, subject to approval.
Bidding, Reserves & Auctioneer Rights
Some lots may have a reserve price, which is a confidential minimum bid. The auctioneer may open and advance bids on behalf of the seller up to the reserve amount.
Magen H Gallery reserves the right to withdraw or combine lots at any time.
The auctioneer's decision is final in the case of any bidding dispute. The auction house?s records shall be conclusive.
Magen H Gallery reserves the right to refuse bids from unverified buyers.
Default, Legal Enforcement & Buyer Obligations
Binding Agreement: By placing a bid, you enter into a legally binding contract.
Failure to Pay: If payment is not received within 3 days, Magen H Gallery reserves the right to pursue legal action and/or report the buyer as delinquent on LiveAuctioneers.
Breach of Contract: If the buyer defaults, Magen H Gallery may take any and all actions to recover losses, including legal proceedings.
Final Reminders
New York State law states that "title passes on the drop of the hammer," meaning the buyer assumes full responsibility at the time of sale.
If you have any doubts or questions, ask BEFORE bidding. We are happy to provide non-binding condition reports, provenance details (when available), and expert opinions upon request.
By placing a bid, you acknowledge that you have read, understood, and agreed to these terms.
