General Conditions
All items are sold ?AS IS? and ?WHERE IS? with no warranties or guarantees of any kind, expressed or implied. All sales are final. No refunds, returns, or exchanges will be accepted under any circumstances. Condition notes in the catalog are provided as a courtesy only and are not comprehensive. Descriptions, dimensions, provenance, artist names, materials, and authenticity are provided to the best of our knowledge but are not guaranteed. Bidders agree they are not relying on catalog descriptions or statements in making a purchase.

Condition of Property
Measurements and weights are approximate. Gold, silver, and diamond content are guaranteed. Functionality of clocks, lighting, and electrical items is not guaranteed and buyers assume all responsibility for wiring and safety. Artist names and signatures are believed to be correct but are not guaranteed unless accompanied by a certificate of authenticity or verified provenance.

Buyer?s Premium and Taxes
An 18 percent buyer?s premium will be added to the hammer price of each lot. New York State sales tax of 8.625 percent (Nassau County) will be applied to the total invoice unless a valid resale certificate is provided prior to bidding. Internet bidders are subject to the same requirements. All mistaken or accidental bids remain binding and subject to the buyer?s premium.

Bidding and Reserves
Some lots may carry a confidential reserve set by the consignor. X Marks The Spot may execute reserve bids on behalf of the consignor. The auctioneer reserves the right to reject bids, reopen bidding, or withdraw lots at any time. The auctioneer?s declaration of ?sold? is final and binding. Title and risk pass to the buyer immediately upon the fall of the hammer.

Payment Terms
All payments must be made through LiveAuctioneers for secure processing and accounting. The only exception is cash upon pickup, arranged in advance. We do not accept checks, wire transfers, credit cards, or debit cards outside the LiveAuctioneers system unless pre-approved in writing. Invoices must be paid within seven days of the auction close. Unpaid invoices may result in cancellation, relisting, loss of bidding privileges, and referral to collections. Bidders are responsible for all collection costs, attorney?s fees, and interest incurred in enforcing payment.

Pickup, Storage and Shipping
All items must be picked up within ten business days of auction close. After that, a storage fee of $10 per lot, per day will be charged. Items left beyond 30 days may be resold without reserve and no refund will be given to the original buyer. X Marks The Spot is not responsible for damage, loss, or theft of items left beyond the pickup period. X Marks The Spot does not provide in-house shipping. Buyers must make their own arrangements. We can recommend local carriers upon request but assume no liability for delays, damages, or losses caused by third-party shippers. Risk transfers to the buyer once the item is collected by the buyer or their shipper.

Limitation of Liability
In the rare case of loss, damage, or theft before pickup, our liability is limited to the hammer price plus buyer?s premium actually paid. X Marks The Spot is never liable for consequential, incidental, or punitive damages.

Governing Law
All bidders agree that these terms are governed by the laws of the State of New York. Any disputes shall be resolved exclusively in Nassau County, New York. The auctioneer?s decision in all matters is final and binding.
