Terms & Conditions

The lots listed in this catalog will be offered by The Arts Auction House, as owner or as agent for consignor(s) subject to the following terms and conditions:

1. PICKUP:

The auction pickup will be held on March 16th through April 6th between 10 am and 4 pm BY APPOINTMENT ONLY, excluding holidays. Please email info@theartsauctionhouse.com to schedule a pickup appointment or call (917) 400-0811.

a. The pickup location and address will be included on the invoice sent by The Arts Auction House.
b. Items not picked up during the specified pickup time frame, will be charged a storage fee of $10 per day / per item. Please expect to pay fees if you are unable to pick up your items or cannot procure a shipper to collect your items by the designated deadline. There will be no exceptions and your items will not be released until the storage fee is paid. Storage fees are to be paid by cash, Venmo or Zelle at the time of pickup.
c. Items remaining 30 days post-auction will be considered abandoned and forfeited without a refund and become the property of The Arts Auction House.
d. The winning bidder or their shipping agent must bring all necessary packing material and help to move larger items.
e. The Arts Auction House is not responsible for moving or loading items into vehicles due to insurance liability.
f. Damage that occurs during shipping by a confirmed third-party shipper is the responsibility of the shipper.
g. All invoices must have a signature from the bidder or shipper before leaving our facility, which confirms the item(s) have been picked up and are in the condition as stated in the auction catalog.
h. Items will not be released without confirmation of a shipper's name and arrival date. All confirmations must be in writing through email and on file by the end of the specified pick-up window.

2. SHIPPING:

The Arts Auction House DOES NOT offer in-house shipping or packaging. Shipping for this auction will be handled by UPS. If you need shipping for your item(s), please call or text The Arts Auction House at (917) 400-0811 or email them at info@theartsauctionhouse.com at the conclusion of the auction. The auction house will drop off your item(s) to UPS and provide UPS with a copy of your invoice. Once UPS is in possession of your item(s), they will contact you directly for the payment. If you need a shipping quote prior to drop-off, please call UPS at (914) 337-7255 or email them at store5446@theupsstore.com. The Arts Auction House DOES NOT provide shipping quotes.

You may also use Gravity Boxes for your shipping needs. For a price quote, please call Gravity Boxes at (845) 217-5533 or you can email them at Ship@GravityBoxes.com.

a. A sale cannot be voided due to unforeseen shipping costs.
b. Shipping and insurance are the responsibility of the bidder.
c. The Arts Auction House does not offer in-house shipping services.
d. Shipping through LiveAuctioneers is an option on checkout. If you have questions pertaining to shipping through LiveAuctioneers, please call LiveAuctioneers directly.
e. It is the responsibility of the Bidder to obtain an estimate of the shipping cost before bidding on an item.
f. All gold, silver, and luxury items will be held until payment has been received and cleared before items can ship or be picked up by a confirmed shipper.

3. BIDDING:

a. The Arts Auction House reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding.
b. The purchase price payable by the buyer shall be the sum of the final bid ("hammer price") plus a buyer's premium of 25% and any applicable sales tax.
c. Unless listed as a NO RESERVE auction, a percentage of lots may have a reserve price, which is the confidential minimum price below which such lot will not to be sold. No reserve will exceed the low estimate of the lot. Reserves are agreed upon between consignor(s) and The Arts Auction House.
d. The Auctioneer may execute bids on behalf of absentee bidders and on behalf of consignor(s) up to a reserve price.
e. The Arts Auction House reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the Auctioneer will be the purchaser. In the event of a dispute between bidders, the Auctioneer has the final discretion to determine the successful bidder or to re-offer the lot in dispute. If any dispute arises after the sale, The Arts Auction House's sale record shall be conclusive.
f. All bidders registering to bid via Live Auctioneers must provide a valid Visa, MasterCard or Discover card and a current email address.
g. Bidders anticipating placing bids of $10,000 or more must speak with a rep from The Arts Auction House for approval to bid.

4. WARRANTIES AND GUARANTEES:

a. All property is sold AS IS, where is and without recourse, and neither the consignor(s) nor The Arts Auction House makes any representations or warranties, expressed or implied, with respect to size, count, weight, style, authenticity, period, material or manufacturer, copyright or reproduction right or any other warranty except as specified below on any lot sold.
b. All measurements and weights are approximate.
c. The Arts Auction House is not responsible for typographical errors.
d. Bidders are strongly encouraged to ask any questions prior to bidding. Unless noted on the listing, all items are previously owned (NOT NEW).
e. Bidders must expect signs of wear consistent with age and use. All images will try and reflect the most accurate color possible. Keep in mind there is no photography equipment and/or software that can match the EXACT color. If you have questions about the color of an item, please contact The Arts Auction House directly.
f. The catalog details are meant as a descriptive guide only. Buyers are encouraged to use the scheduled preview time to examine merchandise in hand. Descriptions are based on the opinion of The Arts Auction House. All images are deemed part of the description.
g. There are NO RETURNS, CREDITS, OR EXCHANGES. Everything is sold AS IS.
h. The Arts Auction House will not guarantee the authenticity of any signature unless so stated at the time of auction and will only guarantee the medium in which the particular work is executed.
i. In the event The Arts Auction House guarantees authenticity (stated at the time of auction); the Buyer must notify The Arts Auction House within seven (7) calendar days of receiving any information which causes the buyer to question the authorship, and such notice shall be given no later than thirty (30) calendar days from the date the lot was delivered to the buyer or authorized representative.

5. PAYMENTS:

a. Payment types accepted through LiveAuctioneers: Mastercard, Visa, American Express, Discover.
b. Payments accepted in-house: Cash, Certified Bank Checks, Zelle, Venmo, Wire Transfer, International Wire Transfer, or ACH.
c. We do not accept personal checks, Paypal, or international credit cards.
d. Invoices in the amount of $10,000 and over must be guaranteed funds such as wire transfer/ACH. International wire transfers are subject to a bank service fee of $50.00.
e. Precious metals and luxury items must be paid for with guaranteed funds when exceeding $10,000. Guaranteed funds are considered wire transfers, ACH transfers, certified bank check, and cash.
f. Bidders give The Arts Auction House permission to charge the credit card supplied at the time of registration if payment is not made within the auction's specific payment time frame. All bidders will have a dispute placed on their account that will be visible to all other auction houses and will be blocked from bidding if payment is not made within the designated payment period. The dispute will be resolved only once the payment is received. The credit card supplied at the time of registration may be charged if payment is not made within the auction's specific payment time frame.
g. The payment timeframe is 3 Days after Auction closing.
h. All LiveAuctioneers bidders will receive an invoice through LiveAuctioneers and payment will be processed through LivePayments, which will carry a processing fee of 3.75%. The credit card limit is $10,000; anything above that amount will require an ACH through LivePayments with a processing fee of 1%. The Arts Auction House reserves the right to hold purchases until the buyer's check clears our bank. Returned checks are subject to a $50.00 service charge.
