Arcana Auctions Terms & Conditions

Arcana Auctions is in Columbus, Ohio. All Arcana Auction sales are governed by our Term and Conditions. Please fully read and review the Terms and Conditions prior to placing any bids. When registering to bid or submitting a bidder registration form you are agreeing to our Terms and Conditions. If you do not understand or agree to these terms and conditions do not register to bid. All sales are subject to the terms and conditions stated herein.

BEFORE THE AUCTION
All items are available for examination prior to sale, online or by appointment. Bidders are encouraged to examine all items in which they have an interest. We try to accurately describe the items being sold, but all property offered for sale is strictly "As is, Where is", and with all faults. It is the bidder's responsibility to determine the exact condition and authenticity of each item. No statement whether written or oral, made in the catalog, advertisement, invoice, gallery posting, announcement or comment by the auctioneer, or otherwise, shall be deemed to create any warranty or assumption of liability. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear, defect or effects of aging. Unless noted, all items have some amount of acceptable wear, scratches, nicks, etc. Estimates are of market value and are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. Estimates do not include the Buyer's Premium. By bidding, you are entering a contract and you are agreeing that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the items for you.

LOTS ARE SOLD "AS IS, WHERE IS" AND THE BUYER AGREES TO THE FOLLOWING:
Arcana Auctions is not responsible for any typographical errors, wear on furniture, flakes, surface scratches, or manufacturing flaws in glass or ceramics. No warranty is made regarding the condition of artwork frames. No warranty is made regarding the working condition of watches, clocks, electronic or mechanical devices of any sort or that any such item is in working condition or without defects, restorations, or working parts.

All measurements are approximate. Arcana Auctions makes no warranty that a buyer acquires any copyright, trademark or reproduction rights as to any lot purchased. Arcana Auctions reserves the rights to reproduce any image of any lot sold at auction. Except with disputes regarding written authenticity or definite misrepresentation by the auction house, Arcana Auctions does not accept return of items purchased at auction. All Sales are Final.

BIDDING
Arcana Auctions cannot be held responsible for missed bids or failure to execute your bid. Arcana Auctions cannot be held responsible for internet issues or outages as it may affect an auction. Arcana Auctions will not refund or rescind a sale in which the winning bidder claims to have won a bid mistakenly or unintentionally.

AGENCY
Arcana Auctions acts solely as agent for consignor(s) or owner(s) of property offered for sale.

PAYMENT & FEES
The hammer price, as executed by the auctioneer, is the final sale price. A buyer's premium of 15% to 30% depending on the auction terms for that particular auction is added to all hammer prices. Sales tax, if applicable, is added to the hammer price and, along with the buyer's premium, constitutes the total final purchase price. Another fee of around 3.9% is added to invoices paid by credit or with debit card. Buyer's premium is considered part of the total purchase price. If you have not contacted Arcana Auctions to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.

Please notify us immediately if you intend to pay using a different method of payment. We accept cash, certified check and bank transfer, MasterCard, Visa, American Express & Discover. Credit cards accepted with proper identification. Invoices greater than $1,500 require payment by cash, or wire transfer. Arcana Auctions reserves the right to hold merchandise purchased until payment has cleared the bank and additional documentation has been submitted if required.

WITHDRAWAL OF LOTS
Arcana Auctions reserves the right to withdraw any lot at any time before the auction without liability.

SUCCESSFUL BIDDERS
The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on Arcana Auctions part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, Arcana Auctions sale record is conclusive.

SELLER BIDDING
Sellers are permitted to bid on their consigned property offered at auction in the case of a forced sale (i.e. per a court-ordered settlement). Reserves are encouraged to be set with Arcana Auctions before the auction. Shill bidding, or bids placed in bad faith to artificially raise the sale price of an item, are illegal and strictly prohibited.

AUCTIONEER BIDDING
Arcana Auctions, its staff, and affiliates may participate as bidders in our auctions, subject to the same terms and conditions as all other bidders. Shill bidding, or bids placed in bad faith to artificially raise the sale price of an item, are illegal and strictly prohibited.

RESERVES/MINIMUM BIDS
The Auctioneer has the right to reject any raise of bid not commensurate with the value of the item being offered. Arcana Auctions has the right to establish a stated minimum bid, the right to reject or accept any or all bids, or the right to withdraw items from the auction before completion of the auction. The seller of the property may not withdraw lots without confirmation from Arcana Auctions.

STORAGE/PICK UP
All sales are final, and all items must be paid for each day of sale and buyers must have paid receipt to pick up items. All items must be paid for before being taken from the premises. The purchaser assumes full responsibility for items at the fall of the hammer. All property should be removed from our premises no later than fourteen (30) days following the auction. Unless prior arrangements have been made with Arcana Auctions items not removed by the specified time will be charged storage and handling fees. Removal deadlines are strictly enforced. After a period of thirty (30) days the unclaimed sold property will be considered abandoned and resold, donated, or disposed of at Arcana Auctions discretion.

SHIPPING
Arcana Auctions offers affordable in-house shipping on small non-fragile items, if we are unable to ship your items in-house we can supply a quote for white-glove shipping via U-Ship. You will receive a separate invoice for our in-house shipping after the completion of the auction, you must choose self arranged shipping on your LiveAuctioneers invoice to get our in-house shipping options. No item may be removed or will be released for shipping until full payment of merchandise has been made. Items will only be shipped to the bidder's listed shipping address.

Third-party pickups can be accommodated if you have a preferred shipper, and also require advanced scheduling. To arrange your own shipping option the buyer must complete and submit our shipper release form found at https://www.arcanaauctions.com/shippingreleaseform. Arcana Auctions holds no responsibility for items shipped through buyer arranged shipping such as LiveShipping, once the item leaves our address any subsequent damage claims are between the buyer and their contracted shipper.

SALES TAX
Arcana Auctions must have a blanket exemption certificate with permit number and signature on any tax exempt sale. If paying through LIVE Payments you will upload you tax exempt form into their system. Unless exempted by law from the payment thereof, the buyer will be required to pay any and all applicable sales, use, luxury or other required taxes and buyer will pay Ohio sales tax for all purchases picked up at our Columbus, Ohio location. If a shipper does not have a Bill of Lading and you do not have a valid certificate of exemption on file with us, Ohio sales tax will be added to your invoice. For purchases shipped outside of Ohio using a certified transportation vendor, buyers will pay any sales tax Arcana Auctions is required to collect for another state, unless the buyer provides a valid certificate of exemption. Unless exemption from such taxes is established to the satisfaction of Arcana Auctions, any buyer claiming an exemption will be required to pay the tax to Arcana Auctions and seek a refund from the governing jurisdiction. If the lot is delivered to a state where Arcana Auctions is not required to collect sales tax, it is the responsibility of the buyer to self-assess any sales or use tax and remit it to the taxing authorities in that state.

Communications & Text Messaging Consent
By registering, bidders consent to receive communications by email, text message, or phone regarding auctions, invoices, shipping, and promotions.


ACCEPTANCE OF TERMS OF SALE
Bidding on any lots indicates acceptance of these terms. If any applicable conditions herein are not complied with by the purchaser, Arcana Auctions at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages. These terms and conditions of sale, as well as the respective rights and obligations of Arcana Auctions and any purchasers or bidder at any sale of Arcana Auctions, shall be governed by and construed and enforced in accordance with the laws of the State of Ohio.
