Condition of Items: All property is sold AS IS, WHERE IS with no warranties or guarantees, expressed or implied. All sales are final and non-refundable. It is the bidder's responsibility to inspect items, determine value, condition, authenticity, and suitability, and ask questions prior to bidding. Descriptions and photographs are provided as a convenience only and are not guaranteed.
Item Descriptions & Coin Grading: While we strive to describe items accurately, MBE&A is not responsible for errors or omissions. Coins are not professionally graded unless specifically stated. Any grade listed reflects the opinion of the auction company only.
Reserve Auction: All auctions are conducted with reserve. MBE&A reserves the right, at its sole discretion, to suspend or revoke bidding privileges, reject or cancel any bid, withdraw any lot, or refuse service to any bidder as permitted by law.
Auctioneer Bidding Disclosure: At the request of the auction company, this auction permits bids to be placed by the auctioneer or an employee of the auctioneer. While Proxibid's Unified User Agreement generally prohibits this practice, UCC 2-328 permits such bidding when clearly disclosed. Absolute auctions do not permit bidding by the seller or the seller's agent.
Participation Requirements: A valid credit card is required for bidding approval.
Sales Tax: Sales tax will be automatically calculated at checkout based on applicable federal, state, county, and local tax laws, the shipping or pickup location, and the type of item purchased. Buyers claiming a sales tax exemption must ensure their exemption documentation is current and approved through Proxibid/ATG Pay prior to payment.
Internet Buyer's Premium: 18%
Accepted Payment Methods: Visa, MasterCard, Discover, American Express, ACH, cash, check, and wire transfer. Processing fees may apply to certain payment methods.
Payment Instructions: Winning bidders will receive an invoice directly from Proxibid/ATG Pay via email. Payment is due at the close of the auction unless otherwise stated by the auction company. The credit card on file may be charged at the close of the auction unless prior payment arrangements have been approved by MBE&A.
Invoices totaling $1,000 or more, and purchases containing gold, silver, coins, bullion, jewelry, vehicles, titled assets, or other high-value items, may require payment by wire transfer, cashier's check, or cash at the sole discretion of MBE&A. Buyers paying by cash, check, or wire transfer should contact MBE&A for payment instructions.
Previewing Items: Bidders who do not preview items in person accept the risk of relying solely on photographs and descriptions. Mixed Bag Estate & Auction Services, LLC. strongly encourages all bidders to inspect items in person prior to bidding so they are fully aware of the condition, completeness, and suitability of each item.
Pickup: Winning bidders will receive an email from Shipping Saint after the auction closes (typically the following day) to schedule a pickup appointment or request shipping. Pickup is by appointment only during the published pickup dates and times. Items not removed by the stated deadline, unless prior arrangements have been approved by MBE&A, will be considered abandoned and may be resold or otherwise disposed of without refund.
Shipping: Shipping is available for select small items only. Buyers requesting shipping may ask that lots be combined or non-essential bulky items removed to help reduce shipping costs. Requests must be submitted by text to 440-305-4463 before the auction closes. Requests are reviewed on a case-by-case basis, are not guaranteed, and may be subject to a disposal fee. MBE&A reserves the sole right to approve or deny any shipping modification request.
Default: Failure to pay for or remove purchased items may result in cancellation of the sale, resale of the property, suspension of bidding privileges, and the buyer being held responsible for any resulting loss or fees.
Heavy Equipment Removal: Some equipment must be removed by authorized riggers or licensed contractors only, as determined by Mixed Bag Estate & Auction Services, LLC. Required riggers and contractors must provide a Certificate of Commercial General Liability Insurance with minimum coverage of $2,000,000 per occurrence, naming Mixed Bag Estate & Auction Services, LLC. as an Additional Insured before removal will be permitted.
Items connected to electrical, gas, water, air, steam, hydraulic, sewer, ventilation, or other building utilities must be disconnected by the appropriately licensed electrician, HVAC contractor, plumber, or other qualified licensed trade professional, as applicable. The purchaser is solely responsible for arranging and paying for all required licensed contractors.
The purchaser is solely responsible for all rigging, loading, transportation, cleanup, environmental compliance, permits (if required), and any spills or leaks occurring during removal.
Buyers may remove no more than one (1) foot of wiring, piping, conduit, tubing, hose, or other utility connection extending beyond the purchased item, unless otherwise authorized in writing by Mixed Bag Estate & Auction Services, LLC. Removal of additional building wiring, gas lines, water lines, conduit, junction boxes, electrical panels, plumbing, ductwork, or any other building infrastructure is strictly prohibited.
Any damage to the building, utilities, surrounding property, or equipment caused during removal shall be repaired at the purchaser's expense and is the sole responsibility of the purchaser.
Loading Assistance: There is NO forklift or loading assistance available on-site. Buyers are responsible for providing all labor, equipment, and transportation necessary to safely remove their purchases. Mixed Bag Estate & Auction Services, LLC. strongly recommends hiring a professional mover or qualified rigger, as appropriate, to safely remove and transport heavy or oversized items.
Titled Vehicles: No titled vehicle will be released until payment has been received in full and all funds have cleared.
Auction Company Rights: MBE&A reserves the right to add, remove, re-catalog, divide, combine, or withdraw any lot prior to the close of bidding. MBE&A also reserves the right to reject or cancel bids, suspend bidding privileges, or refuse service to any bidder at its sole discretion, as permitted by law. The auction company's clerking, records, and interpretation of these Terms & Conditions shall be final.
Any announcements, corrections, or updates made by Mixed Bag Estate & Auction Services, LLC. prior to or during the auction, whether made verbally, electronically, by email, text message, on the bidding platform, or by other written notice, shall take precedence over any previously published advertising, catalog descriptions, photographs, or these Terms & Conditions.

Arbitration: Any dispute arising from this auction shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Venue shall be Cuyahoga County, Ohio.

Known as the "Accidental Anchorwoman," Tolliver went on to a celebrated career as a reporter and anchor for WABC-TV Eyewitness News, WNBC, and News 12 Long Island, earning a reputation as one of the most trusted voices on New York television.
