WE WILL NO LONGER ACCEPT RETURNS. Attic To Auction reserves the right to refuse individual admission and participation in our auctions, and to withdraw any lot at any time from auction. Although it is not a standard practice. The terms of this agreement may be modified without notice. We reserve the right to pass an item that does not meet the minimum bid / reserve by our consignors. We reserve the right to bid on an item that has a reserve per any request by our consignors.*PLEASE NOTE: Absentee or MAX BIDS are completely confidential. We cannot see any MAX BIDS that bidders leave. Bid with complete confidence if you cannot participate in the live auction.

REGISTRATION:
By registering to participate and bid in this Attic To Auction, LLC. auction, Buyer agrees to the Terms and Conditions of Sale as follows:
Attic To Auction, LLC. via LIVE AUCTIONEERS LIVE PAYMENTS also reserves the right to process payments using the payment on file immediately upon the auction close with the exception of WIRE TRANSFERS. Declined payments will be attempted 2 more times, after which future auction participation will be denied until payment is made in full. If the WIRE transfer payment is not completed within 48 hours of the auction close, then the bidder will automatically reverted back to instant payment on file for ALL subsequent auction.

WARRANTIES & REPRESENTATIONS:
All property is sold AS IS, WHERE-IS, and without recourse. Attic To Auction, LLC. for itself and as agent for the seller, makes no warranties expressed or implied.

Nothing said or done by Attic To Auction, LLC. shall be deemed a warranty of representation or an assumption of liability by Attic To Auction, LLC. We do our best to represent items for sale on our auctions. All weights and dimensions are approximate. Items may vary from the photos online due to variances in individual computers monitors. We are not responsible for variance of any kind. ALL FEES are non-refundable including payment processing fees.

Condition reports state our professional opinion and should not be treated as a statement of fact. As such, Attic To Auction, LLC. is not responsible for any omissions or errors to these condition reports.
The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or free of imperfections. It is the bidders responsibility to read all of the description and view all photos. Bidders are responsible for asking any question about condition PRIOR to auction close by emailing attictoauction2@gmail.com or using the contact link through the respective auction. No questions will be answered within 6 hours of the auction closing. While we do our best to describe items, it is the bidders responsibility to ask questions about items PRIOR to the auction close. Please view ALL PHOTOS as they are part of the description. If an item arrives damaged, you MUST notify the shipper and Attic To Auction within 15 days of receipt of the item. Any requests or claims after that point will be denied.

BUYERS PREMIUM:
Buyer agrees to pay Attic To Auction, LLC. a buyer's premium of 28%.


SALES TAX:
All purchases are subject to the sales tax rate as stipulated by their city and/or state unless a valid tax-exempt certificate is supplied to Live Auctioneers Auctioneer.

PAYMENT POLICY:
ALL SALES ARE FINAL and Non-Negotiable.
PAYMENTS ARE PROCESSED IMMEDIATELY FOLLOWING THE AUCTION. If payment is declined for any reason, Live payments will send you a notification and make 2 more attempts. If no payment is captured after 3 attempts and we do not hear from you, a DISPUTE will be filed and your bidding privileges may be suspended on the Entire Live Auctioneers site. Please make sure your payment method is updated.


PAYMENT METHODS: *WIRE TRANSFER OR ACH IS REQUIRED FOR JEWELRY PURCHASES OVER $5,000.00 UNLESS PRIOR APPROVAL BY EMAILING:attictoauction2@gmail.com WIRE TRANSFER IS $25.00 THIS WILL BE ADDED TO YOUR INVOICE. YOU MUCH NOTIFY US IF YOU WISH TO PAY VIA WIRE TRANSFER PRIOR TO THE AUCTION CLOSING. PAYMENT FEES ARE NON-REFUNDABLE IF WE DO NOT RECEIVE NOTIFICATION.

By placing a bid, bidder has agreed to full responsibility, risk, and liability of Lot, and to remit full payment including hammer price, applicable sales tax, and respective buyer's premium in the event buyer is acknowledged as highest bidder by auctioneer. ALL BIDS ARE CONSIDERED LEGALLY BINDING AND NON-NEGOTIABLE.

Attic To Auction, LLC. accepts ACH DEBIT via Live Auctioneers LIVE PAYMENTS, WIRE TRANSFERS, CASH PAYMENTS *with prior notification. Again, fees will not be refunded if you do not notify us that you wish to pay in cash. THERE IS NO PAYMENT FEE FOR CASH PAYMENTS- YOU SAVE 3.5%. ALL MAJOR CREDIT CARDS. ACH Debit and Credit Cards are processed via LIVE AUCTIONEERS LIVE PAYMENTS and will incur a 3.5% Processing payment fee.

No credit cards will be accepted over the phone. There is a 3.5% card processing fee added to the invoice. To save money, you can set up ACH direct payment through Live auctioneers. The fee is 1% plus 50 cents per transaction. We also accept WIRE TRANSFERS and CASH with prior notification.. The fees will be added to your invoice.

Attic To Auction, LLC. will not release item(s) for shipment or to the winning bidder until payment has been cleared through their respective financial institutions. This may take up to 5 days.
Should Buyer fail to pay the balance of their invoice within 10 business days of invoice being sent, or otherwise comply with these Terms and Conditions, Attic To Auction, LLC. shall be entitled to one or more the following remedies:
(1) to recover from Buyer all monetary loss arising from the resale of the Lot (including all costs of any resale or attempted resale);
(2) to retain any deposit or partial payment paid by Buyer;
(3) to recover from Buyer all of its costs and expenses of collection including attorney's fees of twenty five percent (25%) of the outstanding balance, interest on the outstanding balance of up to 10% per month, and other related attorney court costs;
(4) all other relief and remedies allowed by law. Pennsylvania law applies and jurisdiction and venue over all disputes involving these Terms and Conditions shall be in Berks Count, Pennsylvania.
NOTE: It is the bidder's responsibility to ensure that the Auctioneer is provided with correct email address for invoice delivery.



LIABILITY:
By participating in Attic To Auction, LLC. online auctions, buyer agrees to hold harmless attic to auction for any injuries, illness, accidents, damage of any kind regardless of the condition of items won. Attic to auction, LLC assumes no liability for defective products, injury sustained by any products sold by Attic to Auction LLC, or damage to sold property beyond the pick-up time frames provided in this Agreement. We assume no liability for items picked up and shipped by the 3rd party shipper. All 3rd party shipper claims should be directed to the 3rd party shipper. By participating in this auction you agree to release your items for shipping to the 3rd party shipper listed under the shipping By liability for loss or damage or loss once the items have been released to the shipper listed under the shipping terms of this sale. Any and all claims or complaints must be directed to the shipper.
