By registering, bidding, purchasing, consigning, or participating in any sale conducted by Authentique Lux, participants acknowledge they have read, understood, and agreed to these Conditions of Sale.

All property is offered subject to these Conditions of Sale and any additional lot-specific disclosures.

CONDITIONS OF SALE

Version 1.1 – Auction 001 Founder’s Collection



SECTION I — ACCEPTANCE OF TERMS

By registering, bidding, purchasing, consigning, selling property to, or otherwise transacting with Authentique Lux, participants agree to be legally bound by these Conditions of Sale.

Participation constitutes full acceptance of these Conditions.

All bids are irrevocable and legally binding.

Authentiqe Lux reserves the right to amend these Conditions at any time prior to the close of bidding.



SECTION II — PROPERTY SOLD AS IS

All property is offered:

AS IS

WHERE IS

WITH ALL FAULTS

No express or implied warranty is made concerning:

• merchantability

• fitness for a particular purpose

• investment potential

• resale value

• appreciation

• future market conditions

Descriptions, measurements, photographs, condition reports, estimates, provenance statements, and authenticity opinions reflect Authentique Lux’s good-faith professional opinion at cataloging.

These statements do not constitute warranties.

Condition reports may not identify every imperfection, repair, restoration, replacement component, manufacturing variation, discoloration, wear pattern, or defect.

Failure to request additional information before bidding waives objections that could reasonably have been addressed prior to sale.



SECTION III — BIDDING

Authentiqe Lux reserves the right to:

• reject bids

• refuse registration

• request identification

• request banking references

• require additional verification

• cancel suspicious activity

• suspend accounts

• reopen bidding

• combine lots

• divide lots

• withdraw lots

• resolve bidding disputes

Its decisions shall be final.

Shill bidding is prohibited.

Bid manipulation may result in permanent suspension.



SECTION IV — PAYMENT

Invoices are due immediately unless otherwise stated.

Accepted methods may include:

• ACH

• wire transfer

• approved cards

• LiveAuctioneers payments

• approved third-party processors

Invoices exceeding $1,500 may require ACH or bank transfer.

Authentiqe Lux reserves the right to require wire or ACH payment for any invoice.

Ownership remains with Authentique Lux or consignor until cleared funds have been received.

Returned payments, declined transactions, or payment reversals constitute default.



SECTION V — SHIPPING

Shipping may be facilitated through:

LiveAuctioneers Global Shipping

Authentiqe Lux

approved third-party carriers

Signature confirmation may be required.

Insurance may be added at the Auction House’s discretion.

Buyers are responsible for:

duties

VAT

customs fees

brokerage fees

international restrictions

import regulations

carrier surcharges

Risk transfers upon documented delivery confirmation.

Once a shipment is marked delivered by the carrier, Authentique Lux shall bear no responsibility for theft, misplacement, forwarding services, package interception, weather exposure, or loss occurring thereafter.

Shipping dates are estimates only.

Carrier delays do not constitute grounds for cancellation.



SECTION VI — BUYER’S PREMIUM

A buyer’s premium applies to all purchases.

Sales tax where applicable is additional.

Shipping is additional.

Insurance is additional.

Authentication services are additional.

Platform fees are additional.



SECTION VII — DEFAULT

Winning bidders are legally obligated to complete payment.

Failure to pay may result in:

cancellation

account suspension

platform reporting

collection proceedings

relisting

liquidated damages

recovery of costs

interest

attorney’s fees

The buyer remains liable for any deficiency realized upon resale.



SECTION VIII — CHARGEBACK POLICY

By placing a bid, purchasing property, or completing payment, Buyer acknowledges that transactions constitute binding contracts.

Buyer agrees not to initiate:

chargebacks

payment reversals

retrieval requests

bank disputes

except in cases involving actual fraud or unauthorized card use.

Improper disputes include:

buyer remorse

subjective dissatisfaction

market fluctuations

shipping delays

customs delays

value disputes

size disputes

matters disclosed in photographs

matters disclosed in condition reports

matters disclosed in descriptions

Disputes must first be submitted directly to Authentique Lux.

Improper chargebacks constitute breach of contract.

Buyer agrees that Authentique Lux may submit evidence including:

photographs

videos

serial numbers

Entrupy reports

GIA reports

IGI reports

emails

text messages

bid records

invoices

tracking information

delivery scans

signatures

platform records

authentication files

communications

to contest disputes.

Buyer shall remain responsible for all administrative expenses, collection costs, platform penalties, and reasonable attorney fees incurred.



SECTION IX — AUTHENTICITY POLICY

Authentiqe Lux represents that all items are believed authentic based upon experience, documentation, expertise, provenance, and information reasonably available at cataloging.

Authenticity opinions are made in good faith.

They do not constitute perpetual guarantees.

Authenticity claims must be initiated within seven (7) calendar days of delivery.

Supporting evidence must be provided within fourteen (14) additional days.

Authentiqe Lux may consider:

brand service center findings

Hermès Spa determinations

Rolex Service Center findings

Cartier Service Center findings

Entrupy

GIA

IGI

manufacturer reports

other recognized institutions

Acceptance of supporting evidence shall remain within the reasonable discretion of Authentique Lux.

Failure to provide timely documentation waives all claims.



SECTION X — RETURN REQUIREMENTS

Items submitted for review must remain exactly as delivered.

Returned items must include:

boxes

cards

dust bags

accessories

certificates

booklets

packaging

protective materials

Items that have been:

used

altered

polished

repaired

resized

cleaned

modified

damaged

serviced

disassembled

will not qualify.



SECTION XI — REMEDIES

If an authenticity claim is substantiated, Authentique Lux reserves the right to determine an appropriate remedy, including:

repair

replacement

store credit

refund

rescission

The selected remedy shall satisfy all obligations relating to the claim.

Shipping, taxes, insurance, buyer’s premiums, customs charges, and related expenses may be excluded.



SECTION XII — RECORD RETENTION

Buyer authorizes Authentique Lux to maintain:

bidding records

videos

photographs

serial numbers

tracking

communications

payment records

authentication reports

Entrupy files

GIA reports

IGI reports

platform logs

delivery confirmations

These records may be used in arbitration, litigation, collections, fraud prevention, platform investigations, and chargeback defense.



SECTION XIII — COMMUNICATIONS

Participants consent to receive communications relating to:

payments

invoices

shipping

identity verification

account activity

catalog releases

auction announcements

special offers

event invitations

Communications may occur through:

email

telephone

SMS

WhatsApp

mail

automated systems where legally permitted.

Participants may unsubscribe from marketing communications.

Transactional communications may continue.



SECTION XIV — BUYER CONDUCT

Participants may publish truthful opinions and experiences.

Participants agree not to knowingly publish:

false statements

material misrepresentations

defamatory statements

fraudulent accusations

misleading claims

regarding:

Authentiqe Lux

employees

consignors

services

transactions

items purchased

Nothing contained herein limits rights protected under consumer protection laws.



SECTION XV — CONFIDENTIALITY

Participants agree that proprietary information including:

pricing models

internal procedures

authentication methodologies

supplier information

private negotiations

business strategies

consignor information

operational processes

shall remain confidential except where disclosure is required by law.

Nothing herein prohibits lawful consumer reviews.



SECTION XVI — FORCE MAJEURE

Authentiqe Lux shall not be liable for delays or failures arising from:

natural disasters

acts of God

war

terrorism

government action

customs intervention

cyber incidents

carrier disruptions

labor shortages

epidemics

pandemics

utility failures

internet outages

events beyond reasonable control.

Performance obligations shall be suspended for the duration of such event.



SECTION XVII — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Authentique Lux shall not be liable for:

indirect damages

consequential damages

punitive damages

special damages

loss of profits

loss of opportunity

market losses

investment losses

The maximum liability of Authentique Lux shall not exceed the purchase price paid for the specific lot giving rise to the claim.



SECTION XVIII — GOVERNING LAW

These Conditions of Sale shall be governed exclusively by the laws of the State of Texas.

Venue for all disputes shall lie exclusively in Bexar County, Texas.

Participants consent to personal jurisdiction within Bexar County, Texas.



SECTION XIX — ENTIRE AGREEMENT

These Conditions constitute the complete agreement between the parties.

No oral statement, social media communication, advertisement, conversation, or representation shall modify these Conditions.

Only a written amendment issued by Authentique Lux shall alter these Conditions.
