1. Items Sold "As Is" – No Warranties All items are sold “as is” and “where is,” with no warranties, guarantees, or representations of any kind, expressed or implied. Condition, authenticity, functionality, and suitability for any purpose are not guaranteed. It is the bidder’s sole responsibility to inspect descriptions and photos prior to bidding. No refunds, exchanges, or price adjustments will be issued for any reason. --- 2. No Returns, Refunds, or Exchanges All sales are final. Once an auction ends, the winning bidder is legally obligated to pay in full. No refunds or credits will be provided due to buyer's remorse, misunderstanding, or failure to read descriptions. Bidding equals a binding agreement to purchase. --- 3. Binding Bids – No Bid Retractions All bids are final and legally binding. No bid retractions are allowed under any circumstances. Any attempt to back out of a winning bid will result in suspension from future auctions. --- 4. Payment Policy – Declined Cards, Late Fees & Suspensions Payments are processed automatically at auction close using the card on file. Ensure your payment method is valid and has sufficient funds. Buyers claiming tax exemption or wishing to pay cash must notify us before the auction ends. Otherwise, your card will be charged. If your card is declined: You will be notified and must pay within 24 hours. A $25 late fee will be added to your invoice. Your account will be suspended until the balance is paid. If unpaid by month’s end, your account will be permanently banned. --- 5. Sales Tax & Tax-Exempt Buyers Sales tax is automatically applied where required by law. Tax-exempt buyers must submit proper documentation before bidding. No tax refunds will be issued after the auction ends. Texas Coin & Bullion Exemption: U.S. coins and legal tender bullion are exempt from Texas sales tax if they meet the legal definition of currency or precious metal bullion. Contact us before bidding with any questions about eligibility. --- 6. Item Pickup – Deadlines, Forfeiture & Lot Policy All items must be picked up during the designated time. Failure to pick up on time will result in: $25 late pickup fee Forfeiture of items after 10 days (no refunds) Mandatory full lot pickup – cherry-picking is not allowed Refusal to take full lot = buyer's premium increase from 15% to 20% on future auctions We will attempt to contact you via email, text, or phone. Failure to respond within 10 days will result in forfeiture. Repeat no-shows may be restricted from future bidding. --- 7. Shipping Policy – Requirements & Liability Shipping is automatic for buyers located 100+ miles from the pickup location. If you prefer to pick up your items, you must notify us within 12 hours of auction close by email or text. Shipping charges will include: Shipping cost $2.50 per lot handling fee (maximum $50 per invoice) Required insurance based on the winning bid amount Once shipped, we are not responsible for lost, stolen, or damaged packages. All claims must be filed with the carrier. --- 8. No Loading or Packing Assistance Buyers are responsible for bringing their own help, tools, and materials. Staff will not assist in lifting, loading, or packing items. --- 9. Communication & Marketing Consent By registering, you agree to receive auction notifications, business updates, and promotional messages via email and SMS text messaging. You may unsubscribe from marketing emails and SMS marketing texts at any time by following the opt-out instructions provided. Note: You cannot unsubscribe from transactional communications (such as payment reminders, pickup instructions, or auction results) related to active auctions. --- 10. Communication Policies – Response Expectations Primary contact method: Email Secondary contact: Text message Phone calls: Only used for urgent matters and may not be answered. Buyers must respond to auction-related communications within 24 hours to avoid penalties or delays. --- 11. Failure to Comply – Consequences Violations may result in the following: $25 late fee and account suspension for non-payment within 24 hours Permanent ban for unpaid invoices by the end of the month Permanent ban for chargebacks, repeated bid retractions, or harassment Forfeiture of items not picked up within 10 days Increased buyer’s premium to 20% for refusing to pick up full lots Immediate and permanent ban for disrespectful behavior toward staff
