TERMS and CONDITIONS OF SALE:

This is a two day sale only, begining at 9AM on Friday October 16th., and ending on Saturday October 17th. 9 AM - 3PM each day, rain or shine. Items will be clearly priced. you need to bring your own help to load heavy things and your own tools to dismantle items and your own packing and tie-down straps.

PAYMENT: Cash, local bank check or bank cards.

SALE BEGINS: Friday October 16th and concludes on Saturday, October 17th, at 9AM -3PM each day. Be in line at 9AM Friday for your best selection.

PICK UP PURCHASED ITEMS: You will need to take with you your purchased items. If you cannot take your purchased items with you at the time of sale, you must make arrangements with the sales crew. We will only hold large items until you can return. This is important as we must clear the house to make ready to sell the real estate. REMEMBER... we do not ship nor will we move your purchases to another location for a later pickup. If you need shipping call The Packaging Store: 540-772-0999. M-F, 9-5. ASSISTANCE ONLY: Any information supplied by any employee or agent of MCR&A, in any form whatsoever, is intended solely as general guidance. We will try our best to help you, but in the end it is up to you to make buying decisions.

NOTICE: AS-IS means just that... what you see is what you get. please look for chips, cracks, missing parts or working in general. Once the merchandise leaves the property, we cannot make financial adjustments or refunds. WHERE-IS means you are responsible for moving the merchandise. It is up to you, the buyer to bring your own help, packing, rope, tie-downs, two-wheel dolly or other moving equipment and tools such as screwdrivers and wrenches.

REMEMBER: We represent the seller. MCRA offers no guarantees or warranties-expressed or implied of any nature whatsoever as it relates to the lots offered at any of our sales. Should there be any remaining manufacturer's warranty, it is up to you as the buyer to obtain satisfaction from the manufacturer. Each lot and every lot at MCRA is sold "AS IS, WHERE IS".

IMPORTANT DISCLOSURE:
We are estate sellers, not authenticators. We do our best to describe as best we can, based on our research, education, overall market experience and information furnished to us by the seller or other third-party sources. It is ultimately up to you, the buyer, to determine what you are buying, how it may be used, how much you should pay for it and how you plan to remove it.

INDEMNIFICATION:
You attend this sale, preview and pick up of items purchased at your own risk. Neither the seller nor the Auction company will be responisible for accidents no matter the serverity. You agree to indemnify, defend and hold harmless MCRA and its clients, consignors, employees, agents, affiliates, successors, officers, directors and assigns from and against any and all claims, demands, losses, damages, liabilities, costs and expenses, including attorney fees, arising out of or relating to any claim or action based upon your use of internet bidding or live auctions or other sales or your otherwise breach of this agreement. We cannot be held responsible for weather related issues; work stoppages due to illness; labor disputes; disruption in utility services- such as the internet; software or other computer problems; issues regarding the electric company or other utility any other circumstances beyond of our control.
As previously mentioned, all property sold "AS IS-WHERE IS" and neither MCRA nor the Consignor(s) makes any representation of warranty, expressed or implied, as to the merchantability, fitness, or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or any use or repurpose of a particular item. PLEASE double check the descriptions to make sure what you are buying. No reference to imperfections is made in the catalog descriptions or verbally by the Auctioneers. Since all sales are final, MCRA will make no refunds, and will not allow charge-backs from your bank cards. Please carefully review the descriptions, then verify the information to your satisfaction before you bid.

PAYMENT:
If you buy and item, congratulations-it's yours. We will, immediately following the sale, take your cash or charge your card. You will then be emailed a paid invoice. If you fail to pick up your purchases at the appointed time and we do not hear from you, we will consider the item(s) immediately abandoned and will charge you a $25.00 fee for each item plus any additional expense required in removing the item(s). MCRA reserves the right to hold purchases and/or titles until we get an authorization/verification and payment on your credit or bank card.

NO SHIPPING:
We do not ship. Period.
If you require shipping, there are numerous carriers for you to contact and make arrangements. We highly recommend The Packaging Store. We have worked with them in the past they are very experienced with online sales. Otherwise, a simple internet search will result in numerous qualified shippers. If you do hire a shipper, you must make sure that the shipping agent can be at the pick-up site at the appointed time. If arrangements cannot be made, please do not bid. If you need shipping insurance, that will also be between you and your shipping agent. MCRA recommends that you contact your personal/business insurance carrier and notify them of your purchase(s). MCRA will bear no responsibility for any mishaps or loss due to shipping, fire, theft or any reason whatsoever natural or man-made.

SALES TAX:
We sell locally. We work from Roanoke County, Virginia USA. We collect 5.3% percent sales tax from all buyers. If you are a merchant, farmer or otherwise sales tax exempt, it is YOUR responsibility to furnish us with the proper Virginia state forms. Otherwise, we will collect the sales tax.

ACCIDENTS:
You enter onto the property at your own risk. MCRA or the seller are not responsible for accidents that may happen to you or to someone you may harm in attending this sale. You attend the sale, preview, or loading time at your own risk. Please be careful and respectful of your fellow auction attendees. Please be mindful not to block neighborhood driveways or mailboxes. Please do not bring your pets to the sale. Carefully consider bringing small children as the sale site is in no way child-proof and may cause injury. If you cause property damage such as, but not limited to scuffed floors, busted drywall, broken windows and the like, you alone are responsible. Same goes for injury to another person, it is all on you to take responsibility.

MCRA, its agents or employees reserves the right to purchase own their own behalf items they wish to own and are bound by these same terms.
