Terms and Conditions of Sale

Buyer's Premium and Applicable Fees

Buyer's Premium: a buyer's premium equal to twenty percent (20%) of the final Hammer Price will be added to the price of each Lot. This premium is the sole responsibility of, and payable by, the Buyer.

Buyer Responsibility for Fees: The Buyer is responsible for paying all fees associated with their purchase. These fees include, but are not limited to, shipping and handling, applicable sales taxes, online payment processing fees, and any associated delivery charges.

Condition of Items and Disclaimer of Warranties

Disclaimer of Warranties ("As Is, Where Is"): All Lots are sold "as is, where is, and with all faults." Dust Factory Auctions and the consignor provide no guarantees or warranties, express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. All sales are final; no returns or refunds will be accepted for any reason.

Absence of Representations: Item descriptions and condition statements reflect the auctioneer's opinion only. They are not guaranteed representations of age, condition, authenticity, materials, or other features. Dust Factory Auctions assumes no responsibility for the value or accuracy of any Lot description.

Finality of Sale: All sales are final.

Bidder Due Diligence and Examination

Bidder Due Diligence: Bidders are solely responsible for conducting their own independent research and thoroughly examining all photographs and details prior to placing a bid. By participating, the bidder agrees to rely exclusively on their own judgment.

Acknowledgement and Reliance: By placing a bid, the Buyer acknowledges and agrees that they are relying solely on their personal judgment, examination, and assessment of the lot.

Item Examination: No public viewing period is offered for this auction. Requests for additional information or images may be submitted via email to dustfactoryauctions@gmail.com. Such requests are subject to the auctioneer's sole discretion and may be declined based on operational scheduling or item availability.

Sales Tax and Payment Terms

Sales Tax: Applicable sales tax will be calculated, added to the Buyer's invoice, and collected by the LiveAuctioneers platform.

Autopay Authorization: Invoices will be processed through the LiveAuctioneers Autopay system. If a valid payment card is on file with the platform, it will be automatically charged.

Payment Sufficiency: All payment methods provided must be valid and sufficiently funded to cover the total amount due on the invoice.

Default and Late Payments: Failure to complete payment within the required timeframe may result in the cancellation of the order, forfeiture of the purchased items, and restriction from participating in future auctions.

Shipping

Live Shipping Service (via LiveAuctioneers):

This option uses LiveAuctioneers' integrated shipping service.

Binding Terms: By choosing this service, you are bound by the rules and cost structure of LiveAuctioneers' LIVE Shipping.

Rate Acceptance: Electing this service means you automatically accept the shipping rate provided to you at checkout by LIVE Shipping.

Auction House Role: We do not set, negotiate, or manage Live Shipping rates or logistics. All terms are controlled exclusively by LiveAuctioneers.

Buyer Arranged Shipping:

This option places the responsibility for packing and shipping arrangements directly with the buyer.

A. Using Our Shipping Partner

Our Connection: We will connect your order with a local, third-party shipping partner after the sale.

Buyer's Responsibility: The buyer is solely responsible for contacting the designated shipper directly to arrange and pay for all packing and shipping services. The shipper's contact information will be shared with the buyer after the close of the auction.

B. Using Your Own Service

Notification Required: Notification Required: If you prefer to use your own shipping company, you must notify us with the following information before the auction closes: (Name of Shipping Agent, Company Name, Address, Phone Number, Email Address)

Pickup Deadline: You are solely responsible for coordinating and having your order picked up by your shipper no later than 15 days after the close of the auction.

C. Quotes and Risk Transfer

Requesting a Quote: We can provide contact information for local shipping partners so you can get estimates prior to the auction closing. To request this, please email us with the name of the sale and the specific lot numbers you are interested in.

Risk Transfer: Our responsibility for the item ceases once it is transferred to the designated carrier. The buyer assumes all risk of loss or damage from that point forward.

Local Pickup:

Required Action: Buyers must schedule an appointment within three (3) business days after the auction's close.

Contact: Scheduling must be arranged exclusively via email to auctions@dustfactoryauctions.com.

Coordination: We will coordinate with you to determine a mutually agreeable pickup date/time, contingent upon our availability.

Denial of Service: Buyers who arrive without a confirmed, scheduled appointment will be denied service and required to book a formal pickup time.

Auction House Handling Fee (All Shipped Orders)

Fee: A non-negotiable handling fee of $15.00 will be applied to all invoices for shipped orders.

Note: This fee is separate from any handling charges imposed by LIVE Shipping or third-party shipping companies.

Item Abandonment

Definition: Any purchased Lot not retrieved within the agreed-upon window is considered abandoned.

Forfeiture: Upon abandonment, the Lot is forfeited by the Buyer, and no refund will be issued for the purchase price or premium.

Re-cataloging: The Lot may be re-cataloged and offered in a future auction at the auctioneer's discretion.

Bidder Eligibility and Account Responsibilities

Minimum Age Requirement: All individuals participating as bidders must be at least eighteen (18) years of age. By registering to bid, the individual affirms they meet this age requirement.

Account Registration and Security: Bidders are obligated to provide accurate and complete registration information. The registered account holder assumes sole responsibility for all bids placed and any actions taken under their account credentials.

Online Bidding Platform and Auctioneer's Discretion

Online Bidding Platform Disclaimer: Dust Factory Auctions LLC utilizes the LiveAuctioneers platform for online bidding services. Dust Factory Auctions LLC is not liable for any missed bids, technical failures, service interruptions, or other issues related to the operation of the online bidding platform. Bidders utilize the platform at their own risk.

Auctioneer's Reserved Rights: The auctioneer reserves the absolute right, exercisable at any time and at their sole and final discretion, to: Pause, delay, or restart bidding. Withdraw any item or lot from the auction. Re-catalog or edit the description of any lot.
