The lots listed in this online catalogue offered by OAB Auctions are subject to the following terms and conditions, and by registering to bid you are agreeing to be found by them as well.

Prior to Bidding and the auction:
We strongly advise that prospective buyers examine and ask any and all questions regarding any item that is of interest to them. Each item we sell comes with a gallery certificate of authenticity and is good for 5 years from the date of purchase. Conditions reports are available upon request, and we pride ourselves on providing accurate information that is pertinent to the piece. However, every lot is sold as is, where as, and except for the authenticity guarantee, OAB auction does not offer any warrant with regards to condition, size, quality, rarity, medium, or material. In the absence of a condition report, one should not assume the condition to be excellent. Again we encourage inquiries regarding our lots and it is appropriate to do so in this case..

Bidding:
OAB Auctions reserves the right to approve or deny and bidder at our discretion. Each buyer will complete a registration form, and may be required to show identification and financial references. Once bidders are approved, they accept liability to pay for all winning bids made through their account. This includes the hammer price, buyers' premium, any applicable taxes and shipping charges.

Absentee, Telephone and Online Bidding: Bidding through the LiveAuctioneers platform is the safest and easiest way for all parties. Absentee bids can be left privately through the site, and are prioritized by when they were received, if identical amounts shall be bid. OAB Auction is not liable for incorrectly placed bids, loss of connection, system outages or equipment failure. If we notice there is a problem with the platform, we will do our best to pause the auction until it can be corrected. We understand that not everyone might have access to a reliable connection during an auction, so we will try to reserve a limited number of phones for telephone bidding. Please register for phone bidding at least 24 hours prior to the auction, so we can do our best to secure your place.

Reserve Prices: Some lots are subject to a confidential minimum price which should not exceed the low estimate. OAB Auction has the right to start the bidding below the reserve and remove the limitation at any point. The majority of lots will open for bidding at half the low estimate, but OAB reserves the right to lower the price if no bids are received.


Discretion: OAB Auctions has the right to remove or refuse any bids, withdraw any lots, and in case of error determine the successful bidder. OAB also reserves the rights to amend, revise or waive any of these conditions at any time, without notice.

Buyers Premium: In addition to the hammer price, successful bidders agree to pay a buyer premium of 25% for any time under $100,000 and 20% above that threshold, plus applicable sales tax. The premium is the same for online, inhouse, absentee and phone bids.

Payment: All items should be paid within 5 days of the auction. Acceptable forms of payment are: All credit cards, paypal, live payments through live auctioneers, checks, wire transfer.

Tax and Tax exemptions: Lots may be subject to local taxes and fees. A winning bidder assumes all responsibility for state & local taxes, customs, duties, VAT, GST etc. If you have a valid resale permit, it needs to be on file or submitted no later than the time of payment. If an inaccurate or expired tax certificate is submitted, the buyer could be liable for the payment of taxes at a later date.

Pickup, Packaging and Shipping: OAB Auctions has the capacity to ship almost everything in house. For the majority of lots we will offer free shipping. If we cannot offer free shipping for a specific lot, it will be noted in the description. You are free to choose any shipper of your choice, but a discount will not be given if you opt for another shipping service. If you choose another service, OAB Auctions assumes no liability for loss or damage during the process. For any item shipped with OAB Auctions, 2% of the value will be added for insurance purposes and OAB Auctions can not be held responsible for any value greater than the purchase price of your item. If you decline the insurance, OAB Auctions cannot be held liable of damage incurred during shipping. We will do our best to have everything shipped within 5 days of payment. If you are using a third party shipper, we request you have your items picked up within 5 days. Any items on premise after 30 days following the auction are subject to a storage fee of $25 per lot per day. After 60 days these items may be resold to collect storage fees with a seller's premium of 20%.

Failure to Pay: If you have failed to pay within 5 days, a winning bidder is subject to:
1. Resale of the property, publicly or privately
2. Cancellation of the sale
3. OAB holding the defaulting party liable to the full extent of the law.
4. Restriction from bidding in the future.
5. Dispute through liveauctioneers.

Legal Ramifications.

The rights and duties of all parties, with respect to these terms and conditions, any concerns pertaining to the auction or OAB Auctions are governed by the State of Minnesota. If any part of these conditions is found to be invalid, only that portion remains invalid with the remainder in full extent.
