This is a public auction sale conducted by Oldthreads Antique Textiles. Bidding in this Auction Sale constitutes acceptance by you ("Bidder") of all the Terms and Conditions of Auction Sale stated herein. The offering and sale of consigned property by Oldthreads Antique Textiles is subject to the following conditions of sale. Bidders shall have no recourse against the Consignor for any reason whatsoever.

2. CONDITIONS OF SALE: The following Conditions of Sale constitute the entire agreement with the purchaser relative to the property listed in this catalog. By participating in this sale, By registering, bidders acknowledge that they are bound by these terms and conditions. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty, and the results of your review leave any uncertainty in your mind, we recommend that you either have an expert examine the lot on your behalf or that you elect not to bid on any item that you question.

3. AGENT FOR SALE OF PROPERTY: Unless otherwise stated, Oldthreads Antique Textiles is a acting as an agent of the consignor for all property in this catalog offered for sale. The consignor may either be the owner of the Property or an agent for the owner. Bidders shall have no recourse against the Consignor for any reason whatsoever.

4. ABSENTEE, PHONE AND INTERNET BIDDING: We can execute order/absentee bids or allow bidding through Live Auctioneers on behalf of absentee customers or purchase of auction lots. Absentee bids and phone bids will be executed by Oldthreads Antique Textiles personnel in a competitive and confidential manner. Phone bid arrangements must be made at least 48 hours prior to start of the auction. The Auction House is not responsible for any errors or omissions, or failure by customer to purchase any lot as a result of bidding through absentee, phone or Live Auction bidding. This Auction will move quickly.

5. All winning bids must be confirmed directly by Oldthreads Antique Textiles in order to be valid. Notifications received through the LiveAuctioneers system are not final or binding until confirmed by Oldthreads Antique Textiles. The auctioneer will make every effort to ensure that online Bidders are treated equitably, accurately and identically to those from other venues. However, due to the unique features of online bidding, there is no guarantee that the item will not sell to another Bidder for less than your last intended bid due to internet traffic, or other delays outside of our control. The Auctioneer accepts no liability for failure of the Internet, FAX, phone or failure by any email to reach its destination within the expected time or at all.

6. NO RETURNS BASED ON CONDITION: It is the buyer's responsibility to be knowledgeable about the condition of the property before bidding. All lots are selling as is, an item may be missing something or altered from its original state, or have damage, etc. We suggest hands-on examination. All lots are sold AS IS and there will be NO RETURNS for any reason. No article can be removed from the premises or shipped before full settlement is made. The printed conditions and descriptions in the catalog are OPINION ONLY without legal obligation. The items sold are often of considerable age and will exhibit wear, usage and damage. Our descriptions are true and accurate to the best of our ability. We try to observe and report every defect that we are aware of to give the buyer an accurate description but to mention every single minor blemish is laborious and unnecessary. As condition and description is largely based on personal opinion, we ask that you look at the numerous photos carefully and decide the rating and pattern if applicable of this item for yourself.

7. LOT CONDITION/DESCRIPTION: All photographs in the web catalog are of the actual lots being sold. All props for instance, mannequins, hat stands and display are not included in purchase. As a service to prospective purchasers, certain lots describe physical condition. The fact that damages, repairs, restorations or other defects are noted for certain lots does not preclude the presence of any other defects which have not been described. We urge prospective purchasers to inspect all property prior to bidding. The lots condition is stated within the item description. The condition key is as follows: Pristine: Near perfect. No evidence of wear. No visible flaws. Excellent: Gentle wear or minor damage, easily repairable. Good: Garment is sound. Visible repair or in need of repairs. Fair: Significant evidence of wear or damage. Poor: No longer intact. Usable for salvage or recycling of parts.

8. The Auction House has attempted to fully describe the lots in this catalog but makes no representation or warranty with respect to the correctness or completeness of the catalog or of the descriptions of condition. Requests for additional information regarding any lot should be made at least (4) four days prior to the sale by sending an email to contact oldthreads@aol.com stating the lot number(s) and the specific questions regarding each lot. Subsequently, if a prospective buyer, or buyer?s agent, has not examined the property to their satisfaction before the auction and prospective buyer is successful, buyer understands and agrees to these terms. Prospective buyers are in ALL CASES responsible for determining the physical condition, age and any other information important to them in making their decision to bid on lots offered. This disclaimer applies to any condition or descriptions given over the phone or emailed as well.

9. AS IS: All property is sold "as-is, where-is" and neither Oldthreads Antique Textiles nor the consignor makes any warranties or representations of any kind or nature with respect to property or its value. In no event shall Oldthreads Antique Textiles nor the consignor be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, condition or estimate of value. No statement (oral or written) in this catalog, at the sale, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. All measurements, if provided, are approximate. Any such warranty is WAIVED. ALL SALES ARE FINAL AND NO SALE RESCISSONS WILL BE MADE ON THE BASIS OF CONDITION, NO EXCEPTIONS.

10. PER LOT: Unless otherwise announced by the auctioneer, all bids are per lot as numbered in the catalogue. Bids are for the entire lot and each lot constitutes a separate sale. No lot will be broken up unless otherwise permitted by the Auctioneer. All props in photos, for instance all mannequins, hat stands, and display are not included in purchase. Lots will be sold in their numbered sequence unless Auctioneer directs otherwise. Purchaser will pay a $18.00 per lot for properly packaging lots for preparation to ship, with handling charges included. Shipping charges are separate.


11. PRICE ESTIMATES: As a convenience to our customers, we furnish low and high pre-sale estimates for all catalogued lots in the sale. These estimates reflect our characterization of the lot and the condition as described. The estimates are merely guides for Bidders and an opinion by Oldthreads Antique Textiles of the wholesale trade price the lot may bring at auction. Estimates should not be relied upon to predict the actual retail price the lot will command at the sale. The final hammer price may be significantly higher or may occasionally sell below the catalogue estimates. Oldthreads Antique Textiles will not be liable if the actual selling price is different from the estimate range. Estimates do not include the buyer's premium, or any applicable taxes or any other charges.

12. Online Registration Requirements: Registration online is for a specific auction only. Oldthreads Antique Textiles has the authority to approve or disapprove an individual for bidding. In addition to the requirements, Oldthreads Antique Textiles may require an individual to submit a Proof of ID or valid credit card prior to the auction to be accepted for bidding.


13. Customs Policy: Purchaser will pay a $15.00 per lot for packaging lots and for preparation of all international shipping labels and customs documents. All items will have the hammer price of lots used as the declared value. Bidders requesting shipment to non-US locations are responsible for compliance with customs and/or any other regulations as may apply. Auction House will provide needed documentation but makes no representation as to suitability of lots for export. An export license may be required from governmental agencies or departments for the export of lots purchased. It is the sole responsibility of purchasers to familiarize themselves with any license requirements or limitations. Oldthreads Antique Textiles will have no responsibility with regard to these matters. Inability to obtain a license to export purchased lots into foreign countries shall not constitute a basis for cancellation of any purchase.



14. Buyer's Premium: Buyers premium is 25% plus a third party buyer's premium of 5% to be added to the hammer price of each lot if paid for by credit card. If paying by Credit Card (Visa, Mastercard, or Discover) an additional 3% surcharge will be added to the total invoice. Checks are accepted but purchases will not be shipped until funds are clear. No article can be removed from the premises or shipped before full settlement is made. Lots sold through LiveAuctioneers will be subject to an additional third party buyer's premium of 5%.
This is necessary due to a fee structure change by LiveAuctioneers.

15. Buyer's Review of Lots: Bidders should examine all lots prior to bidding as all items are sold as-is. If you need condition on any items, please contact us prior to the auction starting at 716-557-2452.

17. GOVERNING LAW AND JURISDICTION: These Conditions of Sale and Terms of Guaranty, as well as the purchaser's and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of New York. By bidding at the auction, whether present in person or by agent, order bid, telephone or Internet bid, the purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the State of New York. If any section of these Terms and Conditions of Auction Sale or any term or provision of any section is held to be invalid, void, or unenforceable by any court of competent jurisdiction, the remaining sections or terms and provisions of a section shall continue in full force and effect without being impaired or invalidated in any way.


18. LIMITATION OF LIABILITY If we are prevented by fire, theft or any other reason whatsoever from delivery of any property to the purchaser, our liability shall be limited to the Hammer Price of a lot provided that the transaction has completed. If there has been no completion, Oldthreads Antique Textiles accepts no liability to the buyer.

19. IMPORTANT NOTICE:
Oldthreads Antique Textile Auctions usually auctions items at a rate of approximately 80 lots per hour. On some occasions, your local Internet connection may not be able to keep up with the pace of the auction. We recommend placing a realistic absentee bid as insurance to avoid disappointment. By bidding, you agree that Oldthreads Antique Textile Auctions may award the lot to another bidder at its sole discretion under the circumstances described above or any other reasonable circumstances.
