Items are offered at the listed price and are available for purchase while supplies last. There is no bidding and no buyer’s premium. Buyers are charged a **$2.95 marketplace service fee for each item purchased.**
An item is not considered sold until the online purchase has been successfully completed and payment has been processed.
All items are sold **AS IS, WHERE IS**, with no guarantees or warranties expressed or implied. All sales are final except as otherwise specifically provided in these Terms & Conditions.
Descriptions, photographs, measurements, and condition notes are provided as a courtesy to buyers. Estate sale merchandise is generally pre-owned and may show age, wear, use, damage, repairs, missing pieces, or other imperfections. It is the buyer’s responsibility to review all available information and photographs carefully and determine condition, authenticity, completeness, and value before purchasing. Variations in color or appearance may occur due to lighting, photography, and screen settings.
Yellow Moon Auctions makes reasonable efforts to provide accurate information but does not guarantee the accuracy of descriptions, measurements, identification, age, maker, material, condition, or completeness.
Yellow Moon Auctions reserves the right to correct errors in descriptions or pricing, withdraw items, cancel a listing, or modify sale details at any time prior to purchase.
Buyers must be 18 years of age or older. Yellow Moon Auctions reserves the right to refuse or cancel transactions when reasonably necessary due to suspected fraud, payment issues, listing errors, or violations of these Terms & Conditions.
PRICING & PURCHASE TERMS
This is a **fixed-price sale. There is no bidding and no buyer’s premium.**
Each item is offered at the price shown in the online sale.
A **$2.95 marketplace service fee is charged for each item purchased.** This fee is separate from the listed purchase price and any applicable sales tax.
Items are sold on a first-come, first-served basis through the online sale platform. Placing an item in a cart does not guarantee ownership unless the platform specifically indicates otherwise. The first buyer to successfully complete the purchase and payment will receive the item.
Where multiple objects are offered together as a single listing, group, set, or lot, they are sold together as described in that listing. Marketplace service fees are assessed according to the marketplace platform’s policies and its determination of the number of purchased items.
All purchases are final once payment has been successfully processed, except as otherwise specifically provided in these Terms & Conditions.
DISCOUNTS & MARKDOWNS
Discounts and markdown schedules, if any, will vary by sale. Any applicable discount schedule will be stated in the individual sale details.
Yellow Moon Auctions does not guarantee that any item will be discounted. Items may sell at any time at their current listed price and are available only while supplies last.
Buyers who choose to purchase an item before a scheduled or potential markdown are purchasing the item at the price shown at the time of purchase.
**Discounts and markdowns are not retroactive. No price adjustments, credits, or refunds will be issued for items purchased before a price reduction.**
Yellow Moon Auctions reserves the right to modify or discontinue discounts when reasonably necessary due to errors or circumstances affecting the sale.
PAYMENT TERMS
A valid credit or debit card may be required to complete your purchase.
Payment is due at the time of purchase and will be processed through the online sale platform.
For purchases exceeding $1,000, Yellow Moon Auctions may require an alternate form of payment, including cash, wire transfer, or verified credit card with matching identification at pickup.
All sales are final except as otherwise specifically provided in these Terms & Conditions. Buyers should contact Yellow Moon Auctions promptly regarding any legitimate billing or transaction issue before initiating a payment dispute.
Fraudulent or improper chargebacks may result in permanent removal from future Yellow Moon Auctions sales and may be subject to legal recovery.
SALES TAX
Indiana sales tax will be collected in accordance with applicable law unless a valid resale certificate or other tax-exemption documentation has been submitted and approved as required.
It is the buyer’s responsibility to ensure any applicable exemption documentation is submitted and approved before completing the purchase.
PICKUP TERMS
All items must be picked up during the **designated pickup date and time stated in the sale details.**
Pickup times are firm and are established to allow the estate to be cleared efficiently.
**Do not purchase an item unless you are able to pick it up during the designated pickup window or have received prior written approval from Yellow Moon Auctions for another arrangement.**
Alternate pickup dates are not guaranteed and are available only with prior approval from Yellow Moon Auctions.
Buyers are responsible for bringing adequate help, tools, carts, dollies, packing materials, and an appropriately sized vehicle for their purchases.
**Yellow Moon Auctions staff does not provide lifting, loading, moving, packing, or disassembly services.**
Buyers are responsible for safely removing their purchases. Any damage caused to the home, building, grounds, fixtures, doors, walls, floors, landscaping, or other property during removal is the responsibility of the buyer.
Yellow Moon Auctions reserves the right to stop or postpone the removal of an item if, in its reasonable judgment, the buyer does not have sufficient help, equipment, tools, or an appropriate vehicle to safely remove the item without unreasonable risk of injury or property damage.
If removal is stopped for these reasons, the buyer remains responsible for arranging proper removal within the designated pickup period unless another arrangement is approved by Yellow Moon Auctions.
ACCESS TO THE PROPERTY
Buyers and anyone accompanying them may enter only those portions of the property designated or authorized for pickup.
Buyers may not enter closed, restricted, private, or otherwise unauthorized areas of the property.
Buyers may not open, move, handle, disturb, or remove merchandise or other property they did not purchase unless specifically authorized by Yellow Moon Auctions staff.
Buyers are responsible for the conduct of any individuals they bring to assist with pickup or removal.
Children and other accompanying individuals must remain under the buyer’s supervision at all times.
Yellow Moon Auctions reserves the right to require any person who fails to follow pickup instructions or creates an unsafe or disruptive situation to leave the property.
#PERSONAL PROPERTY & CONTENTS
Unless an item listing specifically states that contents are included, the purchase of furniture, cabinets, desks, drawers, containers, boxes, storage pieces, vehicles, or other items does **not** include personal property or contents that may be found inside them.
Yellow Moon Auctions and/or the seller may remove personal belongings, photographs, documents, financial records, identification, medications, keys, digital media, family papers, or other personal or sensitive materials discovered before or during pickup.
If personal or sensitive property is discovered in a purchased item during removal, the buyer must notify Yellow Moon Auctions before leaving the property and allow the material to be removed.
UNCLAIMED PURCHASES
Buyers are responsible for picking up all purchases during the designated pickup period unless alternate arrangements have been approved in writing.
Failure to pick up a purchase does not automatically entitle the buyer to a refund.
Unclaimed purchases may be handled, stored, relocated, disposed of, or otherwise addressed by Yellow Moon Auctions in accordance with applicable law and the circumstances of the sale.
Yellow Moon Auctions is not responsible for storage or safekeeping of purchases left beyond the designated pickup period except as required by applicable law.
Failure to pick up purchases as required may result in restriction from participating in future Yellow Moon Auctions sales.
SHIPPING TERMS
**This is a local pickup sale. Shipping is not available unless an individual item is specifically marked as eligible for shipping.**
Buyers should assume that **all items require pickup during the designated pickup date and time** unless the individual item listing specifically states otherwise.
If an item is marked as eligible for shipping, all applicable shipping, handling, and insurance costs are the responsibility of the buyer. Shipping arrangements and charges will be handled separately following the purchase.
The availability of shipping on one item does not mean that other items in the sale are eligible for shipping.
**Do not purchase an item requiring pickup if you are unable to pick it up during the designated pickup window.** Purchasing an item and later requesting shipping does not obligate Yellow Moon Auctions to ship the item and does not entitle the buyer to a refund.
Yellow Moon Auctions is not responsible for carrier delays, loss, or damage after an item has been transferred to the shipping carrier, except as otherwise required by applicable law.
ITEM AVAILABILITY, WITHDRAWALS & ERRORS
Because this is an estate sale involving previously owned merchandise, Yellow Moon Auctions reserves the right to withdraw an item before purchase if it is discovered to be missing, damaged, incorrectly identified, incorrectly priced, claimed by the seller or estate, or otherwise unavailable.
In the rare event that an item becomes unavailable after a completed purchase due to an inventory error, duplicate sale, undisclosed damage discovered before pickup, seller or estate withdrawal, or another circumstance preventing Yellow Moon Auctions from providing the purchased item, the transaction for that item may be canceled.
If Yellow Moon Auctions cancels a completed purchase because the purchased item cannot be provided through no fault of the buyer, the buyer will receive a refund of the amount paid for that item.
Such a refund will be the buyer’s sole remedy for an unavailable item.
PLATFORM & INTERRUPTION DISCLAIMER
In the event of technical issues, internet disruptions, payment-processing problems, marketplace errors, or platform outages, Yellow Moon Auctions reserves the right to pause, extend, modify, or reschedule the online estate sale as reasonably necessary.
Yellow Moon Auctions is not responsible for a buyer’s inability to complete a purchase due to the buyer’s internet connection, device, browser, payment method, or other technology outside the control of Yellow Moon Auctions.
LIABILITY & HOLD HARMLESS
Buyers enter the estate, residence, property, or other pickup location at their own risk.
Estate properties may contain stairs, uneven surfaces, narrow passages, low ceilings, exterior terrain, or other conditions commonly associated with private residences, garages, barns, basements, outbuildings, and similar properties. Buyers are responsible for exercising reasonable care while on the property.
Yellow Moon Auctions, its owners, employees, agents, representatives, and the property owner are not responsible for accidents, injuries, theft, or damages occurring during pickup or removal except to the extent liability cannot legally be waived.
Buyers assume responsibility for the safe removal, loading, transportation, and subsequent use of their purchases.
By participating in the sale and entering the pickup property, buyers agree to release and hold harmless Yellow Moon Auctions and its representatives from claims, damages, or losses arising from the pickup, removal, transportation, or use of purchased items, to the extent permitted by law.
ACCEPTANCE OF TERMS
By completing a purchase through this online estate sale, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
